Am I able to claim medical bills that were filed in a Chapter 13 bankruptcy on my taxes?

I’m uninsured and was rushed to the hospital and the total bills were over ,000.00. I ended up having to file Chapter 13 bankruptcy since I don’t make enough to pay them back. I need to know if I can file it on my taxes since I’m paying them back but not all of it.

You can only claim medical expenses that you PAID in 2007, and only those expenses that exceeded 7.5% of your income for the year.

No. You can only claim medical bills on your taxes if you actually paid these bills.

You cannot write off any unpaid medical bills on your taxes.

    Good luck.

No because you didn’t pay the bill, you can only claim the expense, of which there is no expense because you didn’t pay the bill.

the hospital charge doesn’t count as a deduction unless you paid it. that’s when it becomes a legitimate expense. surely this makes sense.

You can deduct them if you pay them when you pay them. All or part.

You might be able to claim the amount that actually gets paid, but I would talk to your bankruptcy attorney and your tax advisor, and get a breakdown of what’s been sent to your medical providers through the bankruptcy.
