bankruptcy in state of california?
any one know how to file bankruptcy by yourself in the state of california exempting your Workman’s comp settlement coming into you on your own since you cant afford to pay thousand dollars for them to do it for you i really don’t want my money garnished and i don’t want my settlement taken away from me what do i do some one please help me

Your paperwork will list this settlement as an asset but your paperwork official forms will have a section for "Exemptions" You will list this asset into this section. As a matter of protection place this money into a separate account and pull out the money as you use it.
California Worker Compensation benefits are exempt from attachment/execution under Code of Civil Procedure Section 704.160. A full list of all California exemptions can be found in California Judicial Council form EJ 155.
Do not be afraid of lawyers. You will find many willing to represent you for $500. Paralegals and Document Preparation services might do the paperwork for as little as $175-$300.
July 27th, 2009 at 2:48 pmYour Workman’s comp settlement is already exempt (that means it cannot be seized by judgment of owed money) You do not have to pay income taxes on this settlement. This money is exempt – the only portions to be paid out will be to the attorneys you hired and the doctors who gave you medical treatment and are waiting for your settlement to be paid. No other entities can put any claims against this money. Please ask your attorneys for more clarification.
