Bankruptcy question: We are in Chap 13 and we were both just laid off? Any suggestions?
My husband and I are currently in a Chapter 13. We have made all our payments on time since 2005. My husband was laiod off in April 2008. And I was just laid off. Any suggestions? Do we have alternatives? There is no way at this point that we can continue to make those payments. We are barely paying our mortgage each month.
If you both have been laid off and there is no income..contact the attorney handling your case, they are your attorney the entire time you are in the chapter 13 and tell them. They may be able to convert to a chapter 7, without the payments made, yes the case will dismiss, for a small fee they may be able to convert you over. Are the payment for the home running thru the plan??? If so, you need to contact your attorney asap so you don’t lose the home….but..call them today!….Good Luck!
