Can i file bankruptcy and still get a accident settlement?
I was in a car accident in july, but have no idea how long the settlement will take. The guy that hit us had no insurance, so my lawyer said i half to sue my own insurance company. If i file for chapter 7 bankruptcy can they take my entire settlement? It will cost 1100 bucks to file for bankruptcy, which i will half to make payments on. If i get my settlement before im done paying for bankruptcy, can they still take it? Is there anything i can do??

Yes, if you receive your settlement before your bankruptcy is discharged, the trustee will take it and distribute the funds to your creditors.

January 7th, 2010 at 7:34 amIt depends on the "exemptions" available in your state. Chapter 7 bankruptcy is a liquidation, and the settlement moneys are an asset, but there may be "exemptions" available to protect those moneys from the liquidation.
