Can i file bankruptcy and still get a accident settlement?

I was in a car accident in july, but have no idea how long the settlement will take. The guy that hit us had no insurance, so my lawyer said i half to sue my own insurance company. If i file for chapter 7 bankruptcy can they take my entire settlement? It will cost 1100 bucks to file for bankruptcy, which i will half to make payments on. If i get my settlement before im done paying for bankruptcy, can they still take it? Is there anything i can do??

    Yes, if you receive your settlement before your bankruptcy is discharged, the trustee will take it and distribute the funds to your creditors.

    It depends on the "exemptions" available in your state. Chapter 7 bankruptcy is a liquidation, and the settlement moneys are an asset, but there may be "exemptions" available to protect those moneys from the liquidation.
