Can I file bankruptcy without my husband?

I’m considering filing bankruptcy on my unsecured debt. and medical bills, but my husband doesn’t want to. Can I file on my own debt?

    Yes you can. If the debts are in your name only, then you can file without him and get the debts discharged, or set up plan payments. You would have to include his income as median household income required by the bankruptcy courts. You need to consult with a bankruptcy attorney in your area, most will see you free the first consultation. They will look at income, assets, debts and taxes and be able to tell you what you qualify for. If the debts are joint and in your hubby’s name and you file bankruptcy they will default to him being the sole responsible party. You need good legal advice.     yes you can. Now any thing he signed for cannot be included as he is not filing. So Credit cards where he is a user cannot be filed and medical he signed as guarantor cannot be filed

    Yes. But you should speak with a bankruptcy attorney. Usually the first visit is free. I’m not sure if you could include your medical with the bankruptcy.
