Can I file chapter 7 bankruptcy without a lawyer?

I am considering chapter 7 to wipe out my debts. I am unemployed and do not want to pay for a lawyer to file.

    Yes, but you will get some backlash. A while back when the bankruptcy laws changed, an individual is now required to first attempt credit counseling before filing bankruptcy. The catch here is that you have to go to credit counseling service, and if they determine that bankruptcy is the best option for you, then the judge will let you file a petition. You can have a CPA analyze your situation but you must make an attempt to avoid bankruptcy.

    Remember the bankruptcy laws are designed to protect the debtor. Creditors cannot exploit you.

    Filing the paper work if the judge allows the petition is easy. Go to office supply stores and they have packets for about $30 – $50. Anyone can answer the questions. In my opinion this is one of the easiest things lawyers ever do. I would bet most of the work is done by a secretary or legal assistant with the lawyer just signing his or her name.

    Use legal services. You should at least have a lawyer to consult you through the process. The credit companies’ and your other debtholders will exploit your lack of knowledge in the process, and use the court to try to keep their debts intact. You might even ask a paralegal to help you also. Good Luck.

    You would be foolish not to employ a professional to help you with this.

    Don’t be surprised if your petition for bankruptcy gets denied because you didn’t fill things out fully or correctly.

    Save some $$$ and hire a professional. They do this all day long. A consult with a bankruptcy attorney is free and they will tell you if you even qualify to file!
