Can you file chapter 7 against a divorce settlement ?

My ex-husband is preparing to file chapter 7. In our divorce settlement he is to pay me ,000.00 over a period of 5 years. This amount is to repay me for money I used to help him pay his bills off that he had before we met and to help him open a business. The amount and terms of repayment were all his idea and now he does not want to repay me. I have taken him back to court twice, with no good results and now I am afraid he will file against me. Can he legally do this ?

    Laws vary by state. Is the debt listed as alimony? He probably can not get out of paying you. Harass him legally and get the SOB to give you your money back. Too bad he didn’t have to pay you for the time out of your life he wasted.

    You have a court order previous to the declaration of his bankruptcy. You are, behind the IRS, the first in line to take his money.

    It is within his legal right to file bankruptcy.

    He can not list you as a creditor.

    Interesting question. If he names you in the bankruptcy, you will get a notice to fight it before the bankruptcy is complete. You really need a consultation with an attorney as it may not be legal. You can also type in your State/Chapter 7 and read what the rules are where you live.
