I have a few concerns and questions that I need answered. I have Googled the laws extensively but would like some human perspective.
I have a friend who downloaded software from Vuze.com. The software is a language software and the torrent he downloaded contained files from a bunch of different languages offered by the company. My friend can burn the files onto a DVD and the DVD can be used on any computer. There is no installation required or anything like that. He has posted the software for sale or trade in various cities on Craigslist.com. Originally he was posting the listings and including the name of the software. Soon after he received a cease and desist letter from company demanding that he remove the listings and stop. After that, my friend decided to post the listings but this time not include the actual name of the company. In the postings he does not write the actual name of the software, but rather posts listings such as "language learning software for sale or trade". Since then he hasn’t received anymore notices from the company. Once my friend receives emails from people who are interested he informs them of the name of the software and arranges to mail them the software. He later received payment via mail or PayPal. Like I said, I looked up all the technical legal punishments such as 0,000 fines, etc. I need your input on a few different questions.
1. Does the fact that the name of the software isn’t publicly advertised matter at all?
2. How exactly are people usually caught? I’ve read that the FBI investigates these matters, but is that typical? Are they doing it on their own or are they asked to by the companies?
3. If caught, what is a realistic punishment? I have seen people sent to prison, but in the story I read the defendant had made millions off of the pirated software and had cars, etc. seized. Could you really go to prison?
4. If you are found guilty in civil court and are demanded to pay an astronomical figure in the hundreds of thousands, what do you do? Would you be forced to claim bankruptcy? Are you allowed to claim bankruptcy since theres no practical means for obtaining that kind of money?
5. Would you have any further warnings or would your house just get raided in an attempt to look for evidence?
6. What kind of lawyer would you need to defend yourself and how much would it cost? What could they do to help you?
Obviously this is a serious matter and your advice is greatly appreciated. I am aware of the laws and have looked up as much as I can but I value your personal input and would like to hear opinions on what would happen realistically.

Well I know I can, i have a bunch of credit card debt and medical bills no property or judgments. can i file myself? i talked to two attorneys and they both stated i am a good candidate for chapter 7. i basically can not afford an attorney so i want to try to file myself.

The 5th is not incriminating yourself. So now we know that illegal activity occurred by them taking the 5th, what will Obama NOT say since his office urged the money to be approved?

So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!
I am considering chapter 7 bankruptcy. I am 5 months behind on payments and been getting threatening calls from the bank, I only have a year and a half let on my note (started out as a 6 year contract). I have unpaid medical bills which is only about 00 along with a early termination fee from sprint and tmobile and I owe to GE money bank. Back last march I ended up homeless and worked any job I could but still wasnt able to get on my feet. So for those of you with comments like "poor money management" keep your comments to yourself. My bills were always paid on time until our economy went to shit. Now that I mentioned that I will get to my question. Is there a way to get around this to not file bankruptcy so my car wont get repossessed (something quick before they take further action) and all my debt paid? I don’t have much money to file bankruptcy. Is there a way to get help so I can pay it out?
I was able to get one credit card a while back soon thereafter filing and kept paying off the balance each month. Recently put on permanent disability so my income is set and very limited so I can only pay X amount each month and now have found myself at the cards limit beacause the interest rate is so astronomical that any payments I make only about goes to prinicipal. I’ve applied for other cards that offer 0% for a year hoping to be able to transfer my balance so the payments might actually make a dent. Unfortunately every application has come back denied due to (1) insufficient income and (2) filed bankruptcy in 2000. This sucks and I feel totally screwed and stuck, any feasible ideas would be much appreciated.
I just got my discharge notice from the courts. I’m kind of happy about, mostly not if you know what I mean. Problem is that I don’t know where to go from here. I’m in a bind and need some really good advice. Bit of a long story but please read.
I’m 33 years old, living with mom and dad since sept 2007 and have been working at a part-time minimum wage job since nov 2007. I filed chapter 7 in july 08 and just got my discharge notice saying I’m cleared. My truck was repo’d in august 08 and now I drive a 49cc scooter. I closed my checking and savings accounts in oct 07 and recently opened up new ones.
Obviously, not my finest hour here. I’m lost and depressed and pissed off in general, and don’t know what to do or where to go from here. My only real skills and experience job-wise are customer service and supervising, and I hate supervising. My one supervising job lasted 3-1/2 years and I quit because I hated it and management. First job that I’ve ever left on really bad terms.
Quiting is how I got into this mess unfortunately, I had a new vehicle that cost a lot but was affordable with the job. I moved in with my brother (a financial risk in itself) when he came back to town to help him. The next job in sales (third big mistake), didn’t cover me financially. I got a second job, but that still didn’t make ends meet. Finally I gave up at everyone’s insistence and quit both jobs, moved home to mom and dad, then searched for a new job (4th mistake, quitting before finding new job). After that, it was all downhill, the folks pushed me to file bankruptcy and even made the appointment for me, which I went to and then filed for (mistake? I’m not sure YET).
Here’s the toppings, I have mild spastic cerebral palsy which is screwing me up physically and the part-time job is pushing that along. I need a sit-down job like with the supervising job but without the supervising part of it. The economy is crap to boot and I’ve never been good at getting jobs to begin with before this economy mess (12% unemployment rate right now in my town). To say the least I feel like I’m in hell right now. I’m not seeing any real options to get my life back.
I thought about college but now my folks are definitely moving in 2 years (but no destination yet) and I’m stuck putting college on hold until we do move or at least know where we’re moving too so that I can contact a nearby college for potential credit transfers.
Anyhow, I just don’t know where to go from here. I seem to be questioning every choice I want to make to the point that I can’t make any decisions any more. I just cannot seem to get my head back on right after this major mess I got myself into.
So here’s the multimillion dollar question: What do I do now to get my life back on track financially?
I only have 1 credit card and it has a 00 limit only. I hear online about people saying they racked up ,000 or ,000 in credit card debt and can’t pay the creditors. My first question is how in the world did a credit company let this happen? And don’t most of these people have credit card limits?
I know for credit cards, you suppose to pay within 30 days or so and if you don’t pay, interest is piled on. But wouldn’t after say 6 months where a person can’t pay off their credit card bills, then the credit card company would shut down their account? I hear people talk about maxing out their credit cards but what in the world are they buying where they rack up credit card debt that is ,000? I mean, you can’t buy a car with that since i don’t think you can buy a car with a credit card right? And don’t most people have limits? I would think most credit card limits are max ,000 a month unless they have a very decent job.
Can someone explain how people rack up so much in credit card debt? Do they get 10 credit cards with 00/month max and then max it every single month for 5-6 months? I understand when people rack up debt in medical bills, student loans, taxes and those things but i just don’t get how can people rack up so much in credit card bills. I mean after a person owes ,000 to the credit card company and can’t pay it back, why would they continue using it? I understand if you use it to buy food and support yourself and your family but do people rack up credit card bills b/c of food? I don’t think so right?
And if a person cannot pay it back, i assume they can file bankruptcy right in the united states? And i hear people talk about fleeing the country because of credit card debt. Do they do so successfully? And usually what countries do they flee to? I’m sure canada isn’t one of them right since you can only say 6 months max? What countries do people flee to? Do they ever get caught? So if they stay there after a certain amount of time, wouldn’t they be there illegally? And since they have to support themselves and make money, wouldn’t the us government know that they are making income and thus could garnish their wages even if they live in the other country? Or do these people just try to make money off the table and just live and hide? I mean, are there people that have huge debt , leave the us and then become successful later on in the country they flee to and then become rich? Because if they do become wealthy, wouldn’t they be caught eventually for fleeing the country? If they then decide to pay back their debt after they made money, would everything be fine or would they face huge penalties for fleeing the country? Or do they just have to stay below the radar and can’t live in a nice place because of it?
I’m very curious about this because i read so much about credit card debt and people leaving the country. I just can’t believe a person could have credit card debt this high because i assume the CC company would freeze their cards after they don’t pay after a few months if the balance is high.
My question is the debt that I incurred, will it fall off my credit report after 7 years or do I filed bankruptcy for a second time?
of my paycheck. He is now dying. Should I file bankruptcy for myself, jointly, or not at all and collect the ins and pay my bills only and of course the joint ones. My mom filed bankruptcy last year and she just can’t afford to help me. I am 20 yrs i will claim about 16-17k on my tax return from doing landscapeing this year. I pay for school, rent(8months where i go to school and i give my mom about 250 a month in the summer), car insurance, truck, and really everything except i’m on my mom’s health insurance(teacher). Can i claim myself? and how would it hurt my mom not being able file me as a dependent, and how much would it help me as far as paying taxes on my business and paying for school? Thanks
As you can see, I’ve put myself in the worst of messes. I am either going to federal prison or at least several years probation for criminal charges (not related to anything financial). I have 20,000 in credit card debit, and my lawyer needs another 10,000 that has not been paid for yet. I still have a good job for the time being and I rent an apartment. Would I be able to put the next 10k for the lawyer on a credit card and then file bankruptcy? I have a few thousand saved up, however the account its in is in my name as well as a family member. Due to both our names being on that account, could that money be taken?
Im filing chaper 13, and i have to show 3 years of tax returns. 2 of them are back taxes that i am just now going to be dealing with and then my 2007 return.
my lawyer says he needs copies of all 3 of the returns which i have. does he notify the irs that i am filing bankruptcy and turn in my tax copies?
it seems redundent if im going to be mailing them in and paying them myself.
plus i dont want to go to kinkos and copy 10 million pages of tax stuff…..

i should also add that im going to be asking for the payment plan would it be best to call or just fill out the form for that? would the payment plan include all 3 of my taxe years or do i need to file a seperate payment plan for each one?
My wife moved out of our house and got her own apartment. Now I am stuck with a house payment I can’t afford and I also have a car payment and a bunch of credit cards in my name. She didn’t give me any warning of this move. Now the mortgage payment is due and I can’t afford it by myself. What would be some options or paths I could take at this point. I am 26,000 in credit card debt. My life turned around completely last year and I lost many things in my life, family, job, etc. I am not making enough on my job to pay the basics and have been using up all may savings. Now I have no savings left and am short 600 month just for basics and providing for my daughter although she doesn’t live with me. She lives with my mom who is living on ss. I need to file chapter 7 but can’t afford the fees and am not smart enough with paper work to do it myself (I’m terrible with directions). I can scrape together money for the useless credit counseling stuff (so they can figure out how I can pay 1800 bills on 700 income, lol) if I don’t buy groceries for a couple weeks but I have no way of getting 500 dollars. My employer cuts hours every week and it’s that way on all retail jobs. I can’t just get a better job and even with that, i would only have the money I need for the basics. My small tax refund will only be 30 dollars.
If I was able to get a second job (not easy with no transportation and if I work after dark, I have to take a taxi (I spend 20 dollars a week now on taxi rides when I get off at night as my neighborhood is very dangerous and I can’t move). If I can find extra work hours, it will just keep me from being homeless a couple months longer, it will not cover bankruptcy costs. I have no resources, family and friends have no money to help. Is there anywhere in Houston where I can find free legal help (not just a consultation but actual filing assistance without cost?) If I have to pay the fees, I will not be able to pay rent. At the rate I am going, I will be homeless as of July 1st providing I don’t lose my job or have any more hours cut.
They are only a week late but I am already getting calls all day during the week. No one leaves a message on my machine so I presume it’s one of my creditors. I need to file bankruptcy because if I don’t they will sue me and freeze my bank account which only contains my pay deposits which are only 700 but if they take that, I can’t pay my rent. I had to file 4 years ago but now I want to buy me myself a new truck, the one I’ve got is kind of screwed already. Went to the car dealer and the best they could get me was 36% APR because i still have that thing in my credit. I don’t think that’s fair so I told they guy I’ll come back after I erase the bankrupt, see what you got for me then. Now I need to figure how can delete it from my report

I am married but I live separate from my husband. We live in two different towns in Oklahoma. We keep our finances separate and only my car is in both our names. I pay the car loan myself. My husband’s name is considered the primary borrower and I am considered the co-borrower. I was planning on reaffirming my car loan so I could keep my car. I would like to know if I file for bankruptcy do I have to enter my husbands income for the means test? Also if I file bankruptcy will it affect my husbands credit negatively?

‘Married, not filing jointly, with declaration of separate households’: By checking this box, the debtor is literally declaring, under penalty of perjury, that “My spouse and I are legally separated under applicable non-bankruptcy law or my spouse and I are living apart other than for the purpose of evading the requirements of § 707(b)(2)(A) of the Bankruptcy Code.” This means that the debtor should be prepared to testify under oath, and to also document the fact if requested to, that the non-filing spouse’s income is truly not available to contribute toward the debtor’s expenses, and that the debtor is not merely pretending to be separated so as to exclude the spouse’s income from the means test calculation.

After having been wrongfully terminated August of last year, and being out of work for nearly 4 months with no income, my car was repossessed. On top of owing close to ,000 for that, I owe for a cell phone bill, as well as 4 credit cards, one of which I got to help out while I was out of work. Are there any other options to get myself out of debt without spending years and more money than actually owed to avoid filing bankruptcy? Some of these credit cards have gone up 4 times the amount that was initially owed. One of my major concerns is that I was paying the payment protection plan and none of the companies honored it. I would have easily been able to pay my debt had they honored the payment protection plan. I could dispute that and get the amount owed down to the actual amount, but where does that leave me with paying off a car I don’t have? Please, any advice would be greatly appreciated. I’m only 26 and the last thing I want to do is file bankruptcy.

In November, I made the decision to file bankruptcy and it was filed a week ago today. My problem is I recently purchased a car (4/4/11) and I have a car loan, but I want to surrender the car under the bankruptcy. The problem is the car is not in good shape as they told us it was (they said they replaced the transmission, but the transmission is stalling and jerking), and they are not willing to switch the car/trade it. I also called the bank and they are more concerned with getting their money than actually helping me (go figure). Will this look bad on my part or is it fine to do? I am wondering because I have to make another payment tomorrow and I would rather not if I can surrender the vehicle, and I don’t want to pay if it will jeopardize my bankruptcy. I emailed and called my lawyer, but he left early for the day :0) Please help!!!!
I am filing because I was sued twice and a lawyer told me to do nothing, so now I have a judgment. I am the only income in my home, and trying to get a reliable vehicle, I opted for a car loan thinking that was going to ensure I had a good vehicle.
I also make sure I work overtime so i can afford the car to be able to work. With a family I am trying to do what I can, but I can’t do that and pay back ,000 that was run up in my teens. Long story short in order for my parents to obtain their home I co-signed. Then they obtained a modification for 50 thousand. Up until yesterday I didn’t know that my parents were told to stop paying for the second loan of 50 and now they owe that amount. The realtor suggested filing for bankruptcy. I was shocked I told him im 23 years old how the hell would filing for bankruptcy look on my credit. Mind you my credit looks awful due to my parents not being able to afford their home. However the realtor said that it wasn’t that bad that id be able to get my own home and obtain loans in 2 years. I was told that if my parents file bankruptcy and I don’t that the entire loan would fall on me and I would owe that entire amount. Im just soo pissed that my parents would allow this to fall on my shoulders. On one hand if I don’t include myself in the home modifications my parents will loose their home but if I do my credit and the ability for me to ever buy my own home is f—. I am trying to repair my credit myself and was told that if I negotiate with my creditors to settle for a lower payoff that it would make my credit worse? My debts are 2-3 years old, so what happens to my credit if I pay them or if I file bankruptcy?
Can you file Bankruptcy and still do a short sale at the same time? So, the dreaded question… File bankruptcy or not?
I was kicked out of my house at a young age (16 to be exact), and the only thing that helped me not be homeless was the dreaded credit card, since there’s only so much money a 16 year old can make.
So now with the credit debt, the school loan debt, the car payments, etc etc, I am in over my head (over 15k). My question… Should I file bankruptcy or not? Also, should I file Chapter 7? Also, what would the best attorney for me be? (I was looking at Peter Francis Geraci, but I can’t find anyone that has filed with him). Also, what is the time frame i’m looking at till I CAN actually file bankruptcy (I heard it takes over 2 years?)
Please, ANY help will be beneficial. I wasn’t a "bad kid" that got kicked out into the streets… I built myself a life in a state by myself and tried making it, but unsuccessfully.

I am trying to figure out how to buy a tiki bar(that I constructed) that is part of a hotel and does not have a seperate property address.
How would I be able to set this up so that I can own the tiki bar and protect myself in case the hotel owner files bankruptcy or defaults on the mortgage on the hotel?
Is there a way for it to be titled to me, a land lease, a construction lien or what?
Please help with any creative suggestions as well
I saw on a talk show that someone had their identity stolen, and of course their credit was destroyed. That isn’t my case, but last year, my employer discriminated against and terminated me (from a desk job – not hard labor) all because I had a stiff back for one day. My doctor said I was okay to work, but the employer still took the job away, and even told me that they were happy with my job performance, so it had nothing to do with that. Since then, I have been looking for a new job, and have not been able to find one. All my money (which wasn’t much to begin with) is drained and I have to file bankruptcy. I know that typically, a person has to go through up to 10 years to restore their credit, but I didn’t bring this on myself, and had excellent credit before all of this happened. So, is there some way that I can have my credit score restored to what it was a year or so ago? I don’t see having the next 10 years of my life ruined because of some unethical employer.
