How long do you have to wait to file bankruptcy a 2nd time?
I filed Chapter 7 bankruptcy in Aug 2001 and it was discharged in Dec 2001 in IL. I now live in Vegas and have a writ against me and they are going to garnish my wages. I have 2 options file a "Claim of Exemption" or file bankruptcy?
If you actually have an exemption, file the exemption. Don’t file bankruptcy for one incident like that. I know in Florida the head of household is exempt from wage garnishment. I don’t know about Vegas tho, you might want to check on that w/ an attorney.

7 years. It appears you did not learn a lesson from the first time.

July 5th, 2009 at 5:30 amIf you file bankruptcy, don’t you have to pay a percentage now? I though they change the law or something.

I filed chap 7 in 1998. I could have swore it’s every ten years for chapter 7. Different person now. I now own two paid for cars, investing heavily in my retirement, refuse to buy anything on credit(including my cars) and have a nice savings. On rare occasions bankruptcy is the result of unfortunate incidents, but 99% of the time it’s behavior. If you’re a member of ebay you need to get this book and read it. Your life will never be the same:
