  1. SoCal Attorney:

If you file for bankruptcy, the automatic stay would require your creditors (and their attorneys) to stop contacting you. You should contact a member of the National Association of Consumer Bankruptcy Attorneys for a consultation.

It costs $1000 or so to file for bankruptcy.

If you have no job, no savings an no assets, they might eventually sue you, but eventually, especially if you have no plans on working, they would have to give up.

For $5k, you could just go take a job, any job, and start sending the lawyer as much as you can.

    Good luck

You don’t want to spend $1,500 to file for BK over $5,000 in debt.

FYI: As long as you are unemployed and without money/assets, it would be pointless of them to take legal action. Even if they won a judgement, they cannot garnish non-existent wages. Be sure to inform them of your status.

Don’t assume that any legal threat for debt collection is a real legal threat. Debt collectors really LOVE to scare people with bogus legal threats and will often misrepresent themselves as "Attorney Smith" or misrepresent their collection agency as a law office. If they make any legal threats against you, immediately state the following:

Per the Fair Debt Collection Practices Act, I would like the full name of the attorney who will be taking action against me and his/her license # in the state bar association. I will be calling the state bar association to verify your attorney’s information.
