Is hiring a lawyer absolutely necessary to file a bankruptcy?
Most attorneys want 00 or more for a bankruptcy. If I had that much money around I probably wouldn’t need to file bankruptcy. Is hiring an attorney absolutely necessary? Or, can I use a paralegal or document preparer to do the forms? What suggestion might you have?

Well, 10 years ago when I filed bankruptcy I did it myself. I didn’t find it that hard. I did a chapter 11 first but then converted it to a chapter 7. I got an attorney THEN. All he did (FOR $500 at the time) was use my very same forms! He did a few addendums but that was it! There weren’t any changes that I could tell. You should also shop around for attorneys; some charge more and some less.
January 24th, 2010 at 12:17 amIf $2000 would keep you out of bankruptcy, do NOT spend the money on filing fees. Unless you have a great deal of debt and no job or assets, you are most likely going to end up in a payment plan. The court will take your income, distribute it to creditors, and you have to pay court costs, legal fees, bankruptcy trustee fees, etc. It is faster and cheaper to work out a payment plan with your creditors and pay them all off yourself.

January 24th, 2010 at 12:17 amNo you don’t need an attorney. You can file it yourself but you need help so attend a bankruptcy clinic. The local Legal Aid where I live has them and all the forms you need. Of course, you have to pay filing fees of around $300 where i live.

Before you leap off that bridge—think of the old saying " he who represents himself has a fool for an attorney".
You can do it yourself, but i would strongly advise against it…
