To make a long story short, I have managed to bury myself with almost ,000 in credit card debt I did not want to file bankruptcy. I have been able to pay around ,500 a month towards credit cards consistently which usually cover a little more than the minimum payment. I was doing the math and even with getting interest lower this is going to take me anywhere around 8-10 years. So I decided to join a debt settlement program that allows me to pay 75 a month for 36 months and it will get me out of debt by settlement. I have never been late on anything before but this month I have been advised by the company I decided to work with to stop paying the creditors. Does anyone know if the debt settlement companies send pfd’s or are they just trying to settle and get their share? What are somethings that I should expect to happen to my credit in the next 3-5 years? Does anyone have any success stories about settling their debt? I am just trying to sleep good at night with this decison.TY

My husband (47) seems to continually repeat the same things over and over again: it sounds daft, but it’s got worse over time (the last 10 years.)
He tells the same ‘jokes’ over and over which are very old jokes that he has told many times and laughs out loud at them, so much so that he has to pull off his glasses to wipe the tears from his cheeks at things that are not funny (and things he has said 100 times…) In addition, he repeats stories and tales from 10 to 20 years ago, (and beyond,) some which are wildly exaggerated, (especially when telling others… as if to impress or shock…)
And he tells me something that has happened, (at work or whatever,) some 5 or 6 times, until i say I KNOW this, you told me already… like 5 times! He must have told me his first single he bought and first album and how he and his dad went to the plough pub to pick up his mom every week and she was always late, 100,000 times….This is just a few of dozens and dozens of things he continually REPEATS over and over!
He only ever sings any one of 3 songs, and keeps continually putting Red dwarf and the i.t. crowd and the inbetweeners on dvd every day over and over….it’s like he has an obsession with the same 3 songs and the same 3 comedy series….there’s millions of other songs, and 1000s of other tv programmes and yet he is obsessed with the same 3 of each. I have started to leave the room when he puts this stuff on; I like them all, but it’s a pee take now.
He tells constant lies too..and he exaggerates hugely, and I think he believes the stories himself! He told people at work the other week that I had been severely ill and hospitalised, when I had had a 3 day cold! One of his colleagues saw me in town and said ‘I hear you were in intensive care…’ I just said meekly, er I am better now…knowing he had probably lied.
And he has had several occasions where he has made out he has gone and demanded money back on something and screamed and stamped his feet til he got his own way, and I found out later that he just bought another item and didnt kick off at all…He yelled at 3 kids for smoking in the street the other week, but when we saw 3 huge beefy black men smoking 10 minutes later, he said nothing. I said, ’say to them put yer effing fag out then!’ and he ignored me. Its like he could only shout at 5 ft tall 13 year olds, and not real men.
He also talks down to me sometimes as if I am thick and don’t know the simplest most obvious things…He acts like he SOOOO much more intelligent. He tries to give me instructions on things I have done 100 times… I just say ‘i don’t know WHAT I would do if I didn’t have you to guide me through life..and God knows how I got through the first 23 years of life before I met you.’
He makes out that he is the king at his workplace and the place wouldn’t run without him, yet he has been there 7 years and is still a crew member on 22.5 hours a week on minimum wage while people half his age have made manager after 2 years. He thinks my family are nasty common chavs and his were middle class and special, when his dad was sacked for the RAF for stealing and is brother has a criminal record for fraud!
He seems to have a massive superiority complex, but has nothing to back it up, no decent job, no qualifications, and his massive spending on materials items in the 1990s and early 2000s, (running up £50K debt) resulted in us going bankrupt because he couldnt keep up the payments…) Also, his family were really nothing….certainly no better than mine…. And his wage is so lame that we live partly on tax credits (we have 2 kids And I work 16 hours a week and I do EVERYTHING in the house including most of the childcare…)
He makes so much sh1t up…and believes it himself… I have caught him out in so many lies and wild exaggerations over the years, from saying he used to be a milkman, and a policeman and he used to own his own business, to lying about how women always used to chat him up when he was with his friends at the pub… it would take too long to explain, but I have found him out over the 25 years we have been together..
Even our 2 daughters think its odd how he always repeats everything over and over and sings the same 3 songs and tells the same stories and ‘jokes.’ And sometimes he just has a go at them for next-to-nothing; no reason at all, and talks down to them, like he is intelligent and superior..he doesnt have a gcse to his name and has spent his life working factories and at mcdonalds..
our younger daughter even asked me why dad doesnt work full time like their friends dads. He said he will get a better paid job, but within a week its as if he forgot the conversation!
Is there some personality disorder here?

I live in Rhode Island and all debts can be collected for up to 10 years and my scores are over 700. Does this mean whatever damage has already been done and I should go for the settlement instead of if I could,pay the full amount?

okay I am married and we are currently overly in debt. My husband is working a great job while I on the other hand lost my job due to the economic ways we are in. we are about 18,000 in credit card debit that we stop paying in general. we have a 38,000 car loan that we have been paying and have had it for a year now. than of course we have all the other basic bills FPL, Cable, Car insurance , rent which is 1,000 a month. since one side has been bring in money we have only be able to pay for the basics and car payment, car insurance, and rent.
There is really anything else we can do.. there is no managing money because all of the money goes directly to bills.. there is nothing we can sell to gain money for all our debt.. it just seems like its getting worse and worse and we thought about bankruptcy. Yes, I agree it’s a horrible thing and it stays on your credit for 10 years YES THAT IS RIDICULOUS bad.. but really what is there else to do.. the interest rates on the credit cards are so high that because of 1 month not paying the minimum jumped up 700.00 so i don’t even want to check what it is now!! We don’t have much options besides that.
If we decide to do it how will it effect his current job? Does his current job have to know we filed bankruptcy?
How would it effect our car loan?
How would it effect us paying RENT to our landlords..

Thank you for all that is giving me their opinions.. and to add on… yes a 38,000 car loan is ridiculous. But we all do things in life that isn’t perfect. So, it doesnt matter our age not everyone makes the correct decisions regardless it doesn’t change the situation that we are in. so call it stupid or whatever you like… All i am trying to DO is get opinions to better my situation and to answer me questions I have.

I saw on a talk show that someone had their identity stolen, and of course their credit was destroyed. That isn’t my case, but last year, my employer discriminated against and terminated me (from a desk job – not hard labor) all because I had a stiff back for one day. My doctor said I was okay to work, but the employer still took the job away, and even told me that they were happy with my job performance, so it had nothing to do with that. Since then, I have been looking for a new job, and have not been able to find one. All my money (which wasn’t much to begin with) is drained and I have to file bankruptcy. I know that typically, a person has to go through up to 10 years to restore their credit, but I didn’t bring this on myself, and had excellent credit before all of this happened. So, is there some way that I can have my credit score restored to what it was a year or so ago? I don’t see having the next 10 years of my life ruined because of some unethical employer.

Ok, I’m planning to send my first payment on a settlement offer a collection office has arranged with me for a past due debt(pending two details). They are also waiving the interest.
Everyone I’ve spoken to, says they’ve never heard of a collection office providing such a generous amount of time to pay off a past due debt, with such low monthly payments().
Have others been offered arrangements like this, and after the debt was paid, that was the end of it? Or is it just that people who have had bad experiences with collectors speak the loudest and most often which makes this arrangement seem unusual?
This debt is four years old, and the SOL is 10 years. However, as long as I’m making payments as scheduled, the agreement says there will be no action to sue or sell the account. By the way, I hope to pay off the debt in 5-7 years, though the written agreement gives me much longer.
I’ve already checked on the 7 year SOL for lawsuits, and 7 year reporting period for credit reports. Starting new payments will not restart the 7 year period on reports, and the SOL for this debt is 10 years, so the collectors still have six years left to sue if under the current contract. However, the written agreement I have says they will not pursue further action as long as my payments are timely.
Also, if I don’t accept this settlement, and the company sues, I will have to pay twice as much with interest, court costs, ect.

I am 22 years old and have ,000 worth of credit card debt and ,000 in student loans that I have to start paying off in 2 months. I talked with a credit counselor and asked him his opinion whether or not I should do the program or declare bankruptcy. He could not give me a specific answer, but he was leaning towards bankruptcy.
I just graduated college and have a job making very little money and paying off the debt is going to take me over 10 years because my monthly payment (with the credit counselor) is very high. I know even if I continue with the credit counseling, it will still hurt my credit.
My parents declared bankruptcy 5 years ago and had no problems getting a new car and built a brand new house with an average interest rate. I know some employers look at credit reports, but credit counseling will affect that anyway. I just want to start over and need some advice. I appreciate it!!

The mortgage is in good standing but its not reporting to the credit agencies. If I have proof of payments to the mortgage company is it necessary to try and get added to the credit reports by reopening the case and filing the reaffirmation? My credit is already shot for 7-10 years because of the BK.

Question, About 5 years ago, I got in a situation I was unable to get myself out of and Filed for Bankruptcy. In addition to Credit Cards I filed on a Loan I got from a Local Bank. After the Finalization of the Bankruptcy, I got a not so nice letter from the Bank Manager, basically stating I am NEVER allowed to bank there again, Understandable… BUT… is there any loop holes.. I loved that bank, I even called to ask if I could pay it off,and they said yes, but it is too much for me at this time… But do the Banks records ever Expire? Like is there a MAX time frame they hold onto documents? Lets say I went back there in 10 years.. would they STILL have my bankruptcy on file and deny me service? ** If I haven’t pd them back** – THANKS

I would like to hear from people who filed and experience chapter 7 bankruptcy. I want to know to if it actually stays on your credit report for 10 years. Is it also possible to get an apartment and a checking account from credit unions or banks?

have been laid off for a while. I have a personal loan, phone bills and about four credit cards. All my credit adds up to about 20k. I just got a new job and I am making about 2400 a month. My rent is 600 a month and I have about 200 monthly bills. All my credit went into collection agencies. Does anyone have any advice…Its not so easy just to pay it off because of my other expenses and settlements usually require 2 or 3 payments to pay off the whole debt. My loan alone was 8 thousand dollars. I want to pay all this off. Can you please give me advice how to pay it all off and than gradualy how can i rebuild my credit. Another option is bankruptcy…I live in New York. If I do bankruptcy, how bad would that affect my future. Also, would it affect me inheriting a house? Would it be a good option? I know it stays on my credit report for 10 years but can i still build credit after filing bankruptcy and how soon? thanks.

I wrecked a car my wife was having financed in her name and we couldn’t afford to make payments on it at the time. So in 2006 they sued her on a civil judgment and won and it was placed on her credit file in the public records. They have until July 2013 to refile for another 10 years on her credit file. She doesn’t want this to happen, but we do not have ,160.00 to pay the debt. Does anyone know how much we should try to offer(%) of the debt to try to settle without making them feel insulted. I am honestly lost about this so if anyone has been through this before with any information would help us. Thanks.

My mother’s friend owes ,000 on a credit card and the bank has been charging her 30 percent interest. Eventually she just refused to pay.
After months of threats the bank relented and offered her a five-year plan to pay off the debt at six percent interest.
She says that will simply be paying back the bank its 30 percent (in the total accrued so far) over a longer time. Plus, she can hardly afford the 5 monthly payments.
Her debt is more than 10 years old and she’s payed back so far more than twice what she borrowed on the card.
She offered the bank 10 percent to call the account settled but they scoffed. She wonders, given that they did finally quit threatening her and made her an offer, are they likely to soften further if she holds her ground and prepares for bankruptcy?
Would the bank be likely to accept a counter offer from her of their five-year-plan on a lesser total amount?
How much would the bank get if they wrote off the account and sold the debt?

I am 20 years old and got myself into a mess. I have a car that IM way behind on and cant afford and will be repoed soon, car insruance, cell phones, medical bills, credit cards, and a gym membership. I cant afford to pay all this back while trying to live. cant get any help from anyone, and i think this would be my best option. i have learned my lesson, and i am WAY better at making the right money decisions. i just need some good advice. ps. im almost 20,000 in debt. what do you guys think?
also, im not worried about my credit in the next 10 years, i will be okay.

This debt is 20k with interest accruing. Looks like this company is gonna succeed in garnishing my wages but I can’t afford it because it would be a hardship on me. If working with the plaintiff to get the debt reduced doesn’t work, can I file bankruptcy on it or will the judgment still be good for them to collect? I can’t afford to get my wages garnished.

I am employed by one of the companies that has been envolved with the back dating of stock options and I was in a 12 month blackout and lost 500K and could not sell to pay my taxes from a sell I did two weeks before the black out and extended black out due to the SEC investigation and during that time the stock just dropped from to . Now I have no stock that isn’t underwater and I don’t know what to do. I owe about 66k . I racked up credit card dept to help me out during this time. I have been reading all the books from NOLO.com and Larry Winglet. I’m tired of being tired and I feel like I have failed. This situation has been very emotional for me I have worked here for 10 years and was ready to pay all of my dept off and instead i’m buried. I’m 53 and I feel like just walking away, but thats not my style. I have never been late on any of my bills CC/auto etc… Thanks for listening and wish me luck!

The last 10 years have been pretty rough, all and all, I know he’s wearing down, physicall and mentally.
Its hard on him because hes worked just as hard as so many other people who are retiring right now at his age. And I know there are so many other countless people who have lost their jobs and homes….and he’s aware of that too….but sometimes I know when my dad gets down….and its hard on me. Im 30….and he’s late 50’s….he tells me now and then how he gets tired and worn out, and I stress about the horrible time in my future that I will lose him….(he’s a night time drinker and 24/7 smoker). He’s one of the hardest working people I know, and I just worry. I also work with my father, we are self employed. Through the 5 years we’ve worked together, we’ve almost gone bankrupt so many times….seeing our bank account go down to the mark of hundreds…knowing how quickly it will dissipate. Right now we’re ok, we’ve brought our money in, but just never lasts. you know how that goes…..any encouraging words or wisdom/advice?? I’ve heard bankruptcy can affect someone’s credit upto 10 years. My home is my only debt but it’s a big debt I can’t pay at this time and as a result is in foreclosure. I don’t have anywhere to go and I’m afraid my credit is bad as a result of this foreclosure process. I fear I won’t be able to even rent an apartment. Will filing bankruptcy delay foreclosure or the bank selling your property so I can stay in my house longer?

In the most tactful way. I am 21, My parents recently got divorced and my father was the one that filed. He cheated on my mom over the internet for 2 years prior and finally filed. All my life growing up he was condescending, insulting and patronizing to my mom. He also was unemployed and refused to get a job for almost 10 years, thus forcing us in to foreclosure and making my mom go bankrupt twice. I know he has mental health issues and my mom began to pity him so she stayed but i dont believe thats a good enough reason. Granted, he never layed a hand on any of us(i have younger brothers) but he used to scream, insult my my mom and when he was in a bad mood it would wreck havoc on the entire household.Even neighbors and friends of ours from CHURCH were suggesting and offering to help my mom finacially get a divorce. To me that speaks volumes if christians whom are taught not to divorce are even suggesting. He now has a new gf that he is verbally abusive too imo and i also think he cheats on. I dont want to hurt my mom but i cant help how i feel. Please give me suggestions this is taking so much out of me I cannot concentrate on my studies.
ill add there was a summer about 8or 9 years ago she did really attempt to leave with the assistance of a friend/ neighbor, but my dad said he wanted to go to counseling instead

a friend committed fraud…did time in prison and now 10 years later is receiving a notice from the Franchise Tax Board for an outstanding balance for restitution. He has no collateral, horrible credit and no savings. He is currently making monthly payments, but they are impacting his living expenses. Can he file bankruptcy despite this court-ordered debt?

They clame I own them 3 I would like to settle this debt a and get my service back some day. Since I stuck with loser pre-paids for now. I not willing to pay the whole thing since they lie to me when got my up grade phone. I been with them 10 years and over 2 phone numbers.
I would like to get it Down to around 0.

I am an Australian that lived in the US for 10 years and while I was there I managed to rack up K in credit card debt through a series of bad luck events (medical expenses for cancer treatment, job loss, loss on sale of a house).
I moved back to Australia at the beginning of this year because I couldn’t find work in the US and have been trying to get back on my feet. I have been thinking the best option for me is to just file bankruptcy in the US and have my credit card debt go away, but that was before I was considering returning to the US!
Now, I am thinking I’ll probably want to come back to the US in the next few years and I’m keen to get my debt situation there resolved ASAP so I can start paying for my mistakes. I just ran my credit report and have a credit score of 591 with a Charge Off status on one of the credit card accounts.
I could try to negotiate the credit card debt down as I have access to some cash from my parents to pay off my debt, but only have K in cash and K in debt. I have no assets in the US, only this debt so I don’t have a lot to lose at this point.
What is the best course of action? Should I just file bankruptcy or should I try to negotiate with the creditors? It’s a lot of money and my credit is already wrecked!!
Any advice would be appreciated but please don’t criticize my previous actions – I can’t change what has happened, I can only make improvements from here.

CC company have offered to reduce the tot. amt. by 1/3 and settle or pay the total amount with very low interest rate. Which is better. According to them 2nd option is better( b/c of credit rating ). But 1st option look good to me.
So either i can pay .33 cents for each dollar owed and settle or pay plus 2% interest per dollar owed and pay in full.
1st option will show "settled" for 7-10 years, while with 2nd option my credit rating will not be effected.

I have tried it all and can’t qualify to buy. I have ongoing medical bills, unpaid medical bills, charge offs, apartment judgements (2), old repossessions, a secured card that stays maxed out. I am caring for my family of 6 on my income only which is around K a year. I usually have trouble just paying rent, food, car note, fuel, insurance, electricity, water and cell phone and internet (I use it for work).
I don’t even pay for gas service in my house until winter b/c it is only used to power my heater. My student loan debt from my bachelors and masters programs is huge but I have it consolidated. I don’t have a home phone, cable or any of that frivolous stuff. Yet in all honesty, I cannot see myself raising my credit score enough to buy because everything I try I can’t keep up (like the secured card). I max it out on food or gas every month.
Now you know my financial story, would bankruptcy help me? Someone told me not to file because I won’t be able to buy a house for 10 years, but at the rate I’m going I won’t be able to anyway unless I have a rich uncle or a genie.
