Is a long story but to cut it short, I can’t get back my money now. I was being setup as boyfriend and gal friend. The girl pretending to be my gal friend told me that she was in financial difficulty and ask me to help her out by swaping my credit card in advance first after which she will pay me back at end of month. She bought herself clothes, shoes & bags which amounted to RM4.5K. It is only through trust and verbal agreement i agreed to help her out. Later on I found out that she was cheating me of my money. Right now, she refuses to settle her debt and even threaten to file sexual harassment report against me not unless I cancel off her debt. I thought of taking this to small claims court but then I was told that if I do not have any written agreement to support my claim it will be of no use. I do have recording evidence but was told it cannot be accepted as an evidence. Has anyone come across this situation before? I do not know what to do now. *sigh* Any advise is welcomed.
The person who passed me the small claims forms told me that recording evidence cannot be accepted. I will check further on the law in my country.
My legal advisor told me that audio or video cannot be used as evidence in court as the contents can be manipulated.

My spouse & I are in serious financial problems. I think we need to file bankruptcy because he has stopped paying his credit cards. i’m keeping up with the utilities and my own credit cards. we own 2 homes, 1 of which is on the market and my spouse refuses to bring down the asking price and now the morgage company has started foreclosure on that property. he’s been able to sort of keep with the morgage payments on the home we live in. my ? is, is debt settlement a good option? I don’t know where to turn to anymore. My spouse wants to "keep up the fight".

I filed for Chapter 7 bankruptcy in 2005 and we did not include the house. Now my wife & I will be getting a divorce. Is it possible to file a Joint Bankruptcy when it has been only 4 years since I filed myself? We’re in Tennessee if that matters.

Husband has only VA insurance but apparently they won’t pay much of the bill because he reported it past 90 days (or something close to that). Not sure what bankruptcy entails but I know it means "start from scratch" but we also don’t have anything to give….so can a person on welfare file?

I have listed all of my outstanding debts on my bankruptcy (including the 2 mortgages on my home), although I had planned on keeping our home and continuing to keep up the payments. My atty told me that if I needed to walk away from the home at any point after the discharge, that the bankruptcy would help me to avoid any judgements as long as I didn’t refinance the loans. But even without paying the debts that I am filing on, we are still finding that our monthly expenses are far outstrapping our income, so we are thinking about short selling and getting a smaller rental home for a while until we get back on our feet. My domestic partner is on SSI, and is "judgement proof" from what my atty says, so between that and my chapter 7 simply walking away is an alternative to short selling. My question is: what is the best thing to do for the long term?? At this point, both my partner and my credit scores are in the toilet anyway. I’m just worried about never having credit again.

I have had two collection agencies recently try to settle debts with me that are very old and do not show on any three of the credit agencies’ reports. Do I have to pay them or are they just trying to make money off me? I have heard this referred to as "zombie debt." Thanks for your help.

Solutions to Islamic Terror:

1) Do nothing at all (extreme Christian/Leftist view)
2) No military action, but seal every nook and cranny (mainstream Christian/Leftist view)

Choices 2 & 3 are not solutions. Islamists realize that either choice leads to bankruptcy and ruin. Its impossible to seal every nook and cranny, and even if it was, we would go bankrupt before sealing 20% of the "vulnerablities".

Iraq, Afganistan or any other Islamic theater of war is another "bleeding" alternative, as we can see now. Because American culture believes in a lefitst-santized version of "war", we give the enemy the advantage. America soliders are not soliders, they are "security" personel waiting for the Islamist to shot him.

If we banned Islam, would we need to seal every port and plane or fight overseas? Ok…go on being PC…go on.

I filed for bankruptcy a few years ago & I have no intention of getting another one, especially for a company I will leave at the end of this year. My company is known to make you pay the balance yourself & then they reimburse you (usually 60 days later). I think this would be a bad idea since I doubt I could pay off the balance at the end of the month.

How do I gracefully get out of this delicate situation and find a solution that will not inconvenience them?

Summary
1) Bankruptcy filing makes high percentage rate & impossible to pay off in a month
2) I don’t plan to stay with the company long term
3) I have a convention I have to go to next week and I have to find a solution pronto!

I want to file bankruptcy but can’t afford an attorney & the only legal aid office around has a waiting list. I have been researching and it looks pretty difficult to do it by yourself. I do have a house & almost every site I go to says that if any of the paperwork is filled out incorrectly I could lose my house. I live in Arizona, have you or anyone you know filed for bankruptcy without a lawyer? Is it really that difficult?

Considering I can’t do debt consol and would very much like to avoid bankruptcy….I am trying to put my life back together after ex husband in TX surprised me by divorcing me after 14 yrs. and then filed bankruptcy himself instead of filing as a couple (which he had told me he would do-as a couple) and in doing so dumped debts on me. TN has the higest rate of personal bankruptcies in this country.
Obama voted against the 2005 BK bill which Bush signed into law. McCain voted for it.
This new law was a gift to the CC/banking industry & has caused many who need the fresh start of BK more hardship.
Yet, McCain is probably going to win TN in the general election.
He will never make any amendments to this law. Given the chance, Obama may.

We are filing bankruptcy due to high debt. We own our home which we are going to try to sell…if not, then we are going to do a short sale. We’ve NEVER been late on any payment (both mortgage or bills) but are struggling each month and it’s ruining our lives. My question is, every one requires a credit check these days (to rent). How do we find a place to live? I want to keep my children enrolled in the school but the other alternative would be to separate living arrangements and move to our parents homes (I wont live with my in laws & my husband wont live with mine. We can rent a house for what an apartment goes for in another city. How do we get a landlord to look past the bankruptcy and see that before it, we made every payment on time (while struggling to do so). We could easily make the rent (minus all the extra debt we had).

I am a single dad with 3 kids. I filed Ch. 13 bankruptcy about three months ago, so it is far from discharged. I got a note on my apt. door from mgmnt saying they would NOT be renewing my lease 4/30/06. So I have to find a new place to live. With my being in bankruptcy, my credit could not be worse. So I will have to come up with a 1st, last, & security payment to move in. I want a 3br (the kids) but the move in costs for a 3br are astronomical. I was thinking about NOT paying March and April rent to the place I have to move out of, to use the money to be able to find a new place. I know thats not the standup thing to do, but I dont want me and the kids to be homeless, either. Anyone know how long it takes after you get a 3day notice demanding rent payment before you ACTUALLY have to remove yourself and your property from an apartment? Im in Florida, btw. Any serious input is appreciated.

When I was in my 20’s, I dated a married guy, fell in love, married him, was miserable, got divorced, became addicted to shopping, filed bankruptcy, started drinking & sleeping around.

I don’t do those things anymore, am in therapy and on medication, but yet I still think about my past all the time. I think about the lives I’ve ruined (no I can’t get in touch and ask for forgiveness), and I think of where I might be if I hadn’t of done what I did.

I just can’t seem to get over and forgive myself. Anyone have any ideas at all?

I owe about 22,500 in debt, and got a letter to settle for 15,700. It is extremely tempting but what are the negatives of having to file a 1099C if I continue to have good, regular income? I had extreme debt & bad luck paying it off, then got an awesome job and sold some stock so I am in the clear. Should I take that 7K discount or will it bite me bigger than that in the end? What I mean is will it bite me by either having that on my record, or paying more taxes? Thanks for the replies – I am trying to research online also.
Do 1099C’s go on your credit report as bad debt? I am so naive…! Or showing that you have a 1099c and settled is a plus? Should I get bakc in the game for the long haul and pay that extra 7K? (worth not tarnishing my credit further?)

Today I called about my gift card for Bennigan’s and I received the following message.

The companies that filed bankruptcy cases are popularly known as Steak & Ale, Bennigan’s and Tavern restaurants. However, not all stores using these trade names have filed bankruptcy. For example, stores operated by franchisees are not named as debtors in these filings.

"It is our understanding the Michelle Chow will be appointed as Chapter 7 trustee for the entities that have filed. These are filed as liquidation cases. Future decisions regarding the affairs of the debtor companies will be determined and administered by the trustee.
