My GF has about 30k in debt…mostly credit cards Just found this out a few days ago and asked her to sit with me and tabulate everything. She has not defaulted on any part of it, but, I guess that could be a possibility down the road. Anyway, the only thing that I have my name on with her is the lease to our apartment (though the bill comes in my name and in the lease it specifically says that any money from the security deposit goes back to me and only me) Also, we have our names together on our internet/tv/phone bill.
I can cover these bills on my own if it becomes absolutely necessary. Obviously I don’t want to and don’t plan to…but I can if the only alternative is being evicted or having services cut off.
My concern stems from this. If a person declares ch 7, I understand that the creditors can basically take anything and everything you own. Would this have any impact on MY personal assets?
Thanks for your help.
Thanks to all who took the time to respond. I appreciate the help!

As you can see, I’ve put myself in the worst of messes. I am either going to federal prison or at least several years probation for criminal charges (not related to anything financial). I have 20,000 in credit card debit, and my lawyer needs another 10,000 that has not been paid for yet. I still have a good job for the time being and I rent an apartment. Would I be able to put the next 10k for the lawyer on a credit card and then file bankruptcy? I have a few thousand saved up, however the account its in is in my name as well as a family member. Due to both our names being on that account, could that money be taken?

My wife moved out of our house and got her own apartment. Now I am stuck with a house payment I can’t afford and I also have a car payment and a bunch of credit cards in my name. She didn’t give me any warning of this move. Now the mortgage payment is due and I can’t afford it by myself. What would be some options or paths I could take at this point. Can someone explain how the different chapters of bankruptcy work? Should I just let the house foreclose if I can’t afford it? Can I file bankruptcy on my car and credit cards by thereself. If I took all my credit card bills and my car payment out I might be able to afford the house by itself. What chapter would this be callled? Someone explain to me every option I have at this point that has had experience with this same situation.

I have accumulated approximately ,000 in CC debt, and about ,000 in Medical bills. My credit score is around 525, and I have had most of these debts for 3-6 years. I’m 25 with no college degree, a job making ,000 Net year, and I live in an apartment. I own 2 cars, One with no engine in it valued at ,000 with an engine ,500 w/out an engine, and another valued at 0. I usually have about -100 left over every month for extra. 20-40% of that I try to put in a "cushion fund" for if I have a medical emergency.
I don’t plan on buying a new house for atleast 2-5 years, and my next car (If i get one) will be, at a max ,000.
My question is; Would filing for a Chapter 7 bankruptcy be an option for me, and If so what are the repercussions?

We are currently in a chapter 13, and we had to relocate for my husband’s job. Are we allowed to lease and apartment and would an apartment complex be willing to rent to us?

I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.

If you have filed for bankruptcy, will the housing authority still consider you for an apartment if you are on SSI and they know you have a lot of mental and emotional problems?

I am 62 years old and have recently had to file bankruptcy. As my time on this earth is limited, I would like to foreclose on my home and get into an apartment that I can better afford. More money is going out than coming in and I’m not living happy.
At my age, credit is not an issue for me. I’ve got a newer car that is paid off. My house was on the market for 1 year and wasn’t able to sell it. I have no equity in it. I have family members that can help me get into an apartment.
I just want to get the house from underneath me and move into an apartment where my payments would be a savings of ,000 a month. I want to live the rest of my life happy and be able to buy things for myself from time to time.
Is it bad for me to want to foreclose??

Ok,I’m 25 and I just got a 04 Pontiac Grand Prix with 112,109 miles on it,for ,000 but got slammed with a 21% interest rate. I tried before hand to get a lender/bank/credit union going in but No one would fiance me because I have 540 credit score. I had to take the deal because the truck I had was a gas hog and was falling apart and I need a way to get to work, so I sold that to get the down payment for the Pontiac. Here the issue,I have had it for 3 months and I have no problem paying the car note(1-a month) but when the economy shot 2 year ago and my job gave pick slips to me and hundred of people, unfortunately I had lost my home and voluntary returned a 02 Monte Carlo to the bank.As you may know now I have a for-closer and an repossession on my credit which is the reason for the low score. I currently have had a job now for the past two years so I making it even tho it get ruff at times with other things like college and apartment bills. I cant find any lender on the net to refinance a car with that many miles and it doest help that my credit score is so low. I was told that since I’m still young I should file bankruptcy to clear my dept and start over now. The only issue I have is I want to keep the car I just got but is there a way in the bankruptcy that I can keep the car and get the lender/bank to lower the interest rate so I can keep it?Or do I have to give it back or keep it out of the filing altogether? I’m a perfect example of bad thing happening to good people because I held a job all life and payed bills on time but you know what the say "sh** happens" Please provide me with some good meaningful advice .on what the best possible decision Thanks!!!

My fiance has some bad debt, seriously in the red, hasn’t been payed in…forever kinda debt. With the price of houses around here we want to start looking because we would be spending less the what were paying for our apartment. Because of me being considered a subcontractor and since he makes pretty good money I would prefer to just be the co-signer. Now obviously before anything happens we need to fix his credit score. How low will companies generally go to settle the debt in full and how would I go about handling that? For instance one company offered to settle for 50% which was taken care of I’m more concerned with the companies who haven’t offered anything. Also, is there any working with utility companies like cable to get them to lower bad debt?

Are judgements discharged in chapter 7 bankruptcy. Example if you were evicted from an apartment or house. Also if you own your vehicle will they take that or do you get to keep it? And how long does it take for your credit score to improve and for you to be able to apply for credit again?

I have had two financial advisers tell me to declare bankruptcy when I graduate from college, or sooner to eliminate my credit card and school loan debt, and one telling me that I should probably get more financial aid (all from different firms)…. The interest rates on private loans for schools are ridiculous (I am going through Sallie Mae), and I am already freaking out about how much I am going to have to pay back…
I don’t really have any family, and I am currently in my Junior year in college. I have been working full time, and paying my school on my credit cards, apartment etc etc.. (I have 3 with a total of 00 credit line, and they are usually maxed out when new semesters start). I get a little bit of money from the federal government (FAFSA) for school, but it obviously is not enough… I also have a bit of private loans from my grand mother who is co-signing for them.
So should I declare? When if I should?
I am not trying to skeeze my way out of it, and I am fine with paying it all back with the career I get when I graduate, but I am really scared about the whole thing (private loans), and I would like to know if there is an ALTERNATIVE route without having to sell my first born child. The gov. and my full time job do not provide enough income for school and such, and I can only work so much taking an average of 18 credit hours a semester.
If I declare bankruptcy, will it affect my grandmother since she is co-signing?
Please help me out. I am open to all constructive help and legitimate ideas that don’t involve anything illegal.

I want to start paying off my old credit card and (1) cell phone debts, but now 4 of them are up to ,000. And 1 is 0. I didn’t even get up to those amount on each debt. It was all the debt collector companies. Is there a way I can settle with them for what my original bill was? I thought that was allowed, (to only pay what you originally owed). They are all asking for more than they should because they want money in their pockets and I’m not paying them! I want to pay my original bill and be done with it. Is that possible? And I don’t mean call the original company because I know that they don’t own the bill anymore, but most of the added on fees was from the debt collector and I don’t want to pay them. Also, A lot of them say, "No debit card numbers, only bank number and check numbers." I refuse to give my bank account numbers! And I don’t trust money orders. What if it gets lost in the mail somehow and I put 0 on one.. Then I would have just lost 0 dollars. There is no insurance on the things. At least if I give my debit card numbers, if something goes wrong then I can cancel my debit card and get another. So, what should I do? I want to get all these debts settled before my bf and I get our first apartment that he has to put under his name because i’m an idiot and screwed up my credit at 18! Doy!

I am currently enrolled in a program with CCCS of MD and DE, and pay about 0 less per month than when I was paying my creditors individually. I will make this payment for the next 4 years. I was told about debt settlement, but I am worried about how not paying my cc’s until I have the settlement amount will afect my ability to rent an apartment. Any thoughts? Pros/cons on each? Thanks

I heard there’s ways to pay off debt for like 10% – 20% of what you owe. I’m just wondering how this works and how I can do it. I need to get out of debt fast as I need to rent an apartment. I would also like to get a new car, but I am ,000 seriously past due.
Please help me. This is getting so out of hand. Everytime I turn around I have another bill. I know I need to stop spending. I plan on buying that Rich Dad, Poor Dad book soon, but I just want to get out of debt.
I will be working an awesome job this summer and it would be a shame if that money went to waste on something. Which is why I’m looking for advice now before it gets to be too late.
I am looking at about grand to credit card companies, grand to hospitals and grand to banks and old phone bills.

Besides a bad credit score, does anything else happen to you? Are you still able to use your credit cards after that? My good friend just filed for bankruptcy yet insists that we should be buying more stuff for our apartment, spending more money on things. I know he will just get right back into debt again. Sometimes it makes me angry to think people like this just get everything wiped clean with no real penalty, to do it all over again. Just curious. thanks

I’ve heard bankruptcy can affect someone’s credit upto 10 years. My home is my only debt but it’s a big debt I can’t pay at this time and as a result is in foreclosure. I don’t have anywhere to go and I’m afraid my credit is bad as a result of this foreclosure process. I fear I won’t be able to even rent an apartment. Will filing bankruptcy delay foreclosure or the bank selling your property so I can stay in my house longer?

Where to begin…you know I accept the fact that life is unfair but WTF did I do to deserve to be in the situation I’m in now. Well my life sucks and I have no clue how to make it any better. This story starts about 6 years when I gave up on feeling anything and realized I am depressed but I did not let it get to me because I have a vanity that burns greater than anything, it consider it my most prized possession that no one can take away. So I even accept the fact that I’m depressed but I move on and put a mask on that I’m just great and nothing wrong. Anyway my rich grandmother died and left all the grand kids 0,000 but she put it in a account with a trustee and my uncle who was the trustee took all the money and left the country. So I’m out 0,000 and on top of that my grandmother had a family company that my other uncle stole and bankrupted and took all the money to himself and left my mother and other uncle with nothing from that. Aside form easy money my mother was a real estate broker and the market dried up 6 years ago and now we are poor. On top of all that my parents got a divorce when I was 13. Let’s fast forward, to 2009. I had few friends in high school, never had a girlfriend and hated most of the people there. I finished high school and my parents have no money for school and no one will cosign with me for a student loan so I am forced to go to a community college even tho I am much smarter than that. Also I live in the suburbs so I can’t walk anywhere and got no car and can’t a job because I got no ride. Also the job market is awful and it’s so hard to find a job. The money I saved over the years I used to pay for my classes and books with no help form anyone. My mother was not getting paid on time at her old job and she foreclosed on the house and we have to get out by next month to a apartment. I am 19 and I feel my life passing me by without even living and that makes me very depressed because I am very nice person who will go out of the way to help someone and do charity work at my church sometimes. The fact that I could have had it all with that 0,000 is the biggest slap in the face ever. So everyone else is busy doing their own thing looking out for themselves and no one care about me. IDK I hope things get better, any help or input would be nice.
Also I think I kinda ugly too so any self improvement tip are welcomed, sorry for it being so long but I feel a lot better having all this off my chest.

I have tried it all and can’t qualify to buy. I have ongoing medical bills, unpaid medical bills, charge offs, apartment judgements (2), old repossessions, a secured card that stays maxed out. I am caring for my family of 6 on my income only which is around K a year. I usually have trouble just paying rent, food, car note, fuel, insurance, electricity, water and cell phone and internet (I use it for work).
I don’t even pay for gas service in my house until winter b/c it is only used to power my heater. My student loan debt from my bachelors and masters programs is huge but I have it consolidated. I don’t have a home phone, cable or any of that frivolous stuff. Yet in all honesty, I cannot see myself raising my credit score enough to buy because everything I try I can’t keep up (like the secured card). I max it out on food or gas every month.
Now you know my financial story, would bankruptcy help me? Someone told me not to file because I won’t be able to buy a house for 10 years, but at the rate I’m going I won’t be able to anyway unless I have a rich uncle or a genie.

Here’s my problem… I am 22 years old, and I went to college for 2 years. during that time I racked up some pretty large bills that I couldn’t handle. I have about 7500 dollars charged off and in collections from credit cards. 2200 of that I have a judgment against me for and they said that they could garnish my wages soon if I don’t pay it off. I had a repossession 14 months ago and owe Wells Fargo ,000 to pay it off. Last but not least, I subleased an apartment to a stranger 2 years ago and I moved out of town. Now I have found out that that person stopped paying the rent and that because I subleased the apartment I am responsible for the rent that was not paid which come out to about 00. So, all together I owe about ,000. I have called all of the creditors and asked what it would take to settle. After calculating that all up it comes out to about ,000. The only thing I have paid perfect is 2 student loans and that’s it. I have no car and I cant get a car loan. I have been rejected for an apartment because of the judgment on the sublease issue. Basically, I am better off dead but I cant bring myself to do that. So I have to decide what to do….Is bankruptcy the way to go?
