I have tried it all and can’t qualify to buy. I have ongoing medical bills, unpaid medical bills, charge offs, apartment judgements (2), old repossessions, a secured card that stays maxed out. I am caring for my family of 6 on my income only which is around K a year. I usually have trouble just paying rent, food, car note, fuel, insurance, electricity, water and cell phone and internet (I use it for work).
I don’t even pay for gas service in my house until winter b/c it is only used to power my heater. My student loan debt from my bachelors and masters programs is huge but I have it consolidated. I don’t have a home phone, cable or any of that frivolous stuff. Yet in all honesty, I cannot see myself raising my credit score enough to buy because everything I try I can’t keep up (like the secured card). I max it out on food or gas every month.
Now you know my financial story, would bankruptcy help me? Someone told me not to file because I won’t be able to buy a house for 10 years, but at the rate I’m going I won’t be able to anyway unless I have a rich uncle or a genie.

I have got myself into a real financial mess. My husband has been living off of me for years and not working so I was forced to take out some of these payday loans (I had NO other options) believe me if I did I would have used them. anyways now we are separating and I can’t afford to move and live with paying those loans. Can I file bk on those kind of loans to sort of start over. I am basically being kicked out of our apartment. PLEASE only answer if you really know the laws in Wisconsin. Thanks a lot

Here’s my problem… I am 22 years old, and I went to college for 2 years. during that time I racked up some pretty large bills that I couldn’t handle. I have about 7500 dollars charged off and in collections from credit cards. 2200 of that I have a judgment against me for and they said that they could garnish my wages soon if I don’t pay it off. I had a repossession 14 months ago and owe Wells Fargo ,000 to pay it off. Last but not least, I subleased an apartment to a stranger 2 years ago and I moved out of town. Now I have found out that that person stopped paying the rent and that because I subleased the apartment I am responsible for the rent that was not paid which come out to about 00. So, all together I owe about ,000. I have called all of the creditors and asked what it would take to settle. After calculating that all up it comes out to about ,000. The only thing I have paid perfect is 2 student loans and that’s it. I have no car and I cant get a car loan. I have been rejected for an apartment because of the judgment on the sublease issue. Basically, I am better off dead but I cant bring myself to do that. So I have to decide what to do….Is bankruptcy the way to go?

I have about 25,000 dollars in credit card unsecured debt. I live at an apartment. I do not own any houses. The only asset to my name is my car and my 401k from my company work about ,000. Is it possible to file for bankruptcy and not liquidate my 401k and my car? I make about 55k a year and the monthly payments are very difficult to make.

I got a house in my name but me and my aunt were going to pay for it 50/50. This month we had a disagreement and she said she is going to stop giving me her half and she is moving out, i don’t have anybody that can move in with me. We bought the house for 285,000 and it’s now worth 235,000 (Los Angeles, CA) I can’t pay it by myself so I was thinking to wait until the bank foreclosures. Can I file for bankruptcy and will I have to pay some of the money back? I make 2000 dollars a month and the payment is 50 and it is set to go up 0 dollars in November. Only serious advice please.
I don’t want the house anymore because I cannot pay for it by myself and I don’t want to rent out any rooms. I am trying to avoid the problems that come from living with other people. If i had problems with my own family I don’t want to know what type of problems I can have with strangers.
I am thinking a short sale will be best but I need at least 2 months to save to get an apartment?

I was wondering this because(no i am not going bankrupt) it seems that good credit is vital to obtain anything, even a place to live. i think it’s ridiculous. people who have gone bankrupt need a place to live to, and a car to drive. How do they get an apartment in thier circumstances? and how do people with poor credit get one? live on the streets? It seems very unfair.

Whats the process after you have been discharged are they suppose to view your bankruptcy and judge you on that stuff. Asking for a friend

My mother is currently renting a home, and has been renting this home for a long while (Upwards of 10 years). She recently got a letter from her landlord stating that he is quite sure he will lose the house to the bank in the bankruptcy he is going through. He is not sure if she will be evicted, if they will just sell it to someone else and still let her live there while selling it, or of any other details that would benefit my mother greatly. The bank is a subsidy of Wells Fargo. I would like to know that, if her landlord loses her house, will the bank evict her after this month is past (She has paid rent for this month, and it is due again on the 1st of May), or will they continue to let her live there? If they do evict her, how long of a warning would she get before she has to vacate? She is interested in moving to an apartment complex, because her rent is 0 a month, and she is living off of social security payments right now with my two sisters, who are 15. She wants a lower rent, and the house she lives in is quite old and very out of date (1970s style throughout the house). I am afraid if the home is sold her rent will go up because of a re-assessment of the property value. What should I know about this situation that I can use to make sure my mother does not get evicted with only 24 hours of a notice?

I file for Chapter 13 several weeks ago and now every account in my credit report is listed as part of the Chapter 13 plan and there is record of the Chapter 13 been filled with the court. They plan hasn’t been confirmed. What happens if I decide to withdraw the filling? can I do this? what happens to my credit? and how my possibilities to (ie. apply for an apartment) be affected?

I kind of know a couple things i would need to do like call and find out who they have sold my debt to, and find out how much I owe… But I just need instruction on what to say, what to agree or not agree to, and most importantly, how much can I settle a ,500 debt for if i do this right.I’m having a kid soon and I need to have the option of moving the heck out of L.A., but with crappy credit (this not being my only debt) I seriously wont be able to even rent an apartment. Please Please help me figure this out!!!
Well that’s great advice, and I will use it. But what about the calls that my ex girlfriends are getting? They have different phones, and providers, yet the collectors keep asking for me or where to find me. Calling numbers that EVEN I DON’T have. Will the calls stop? And is it a good idea to return calls to these people and negotiate? Or better to find a main number and call them that way? Seriously clueless to these matters, and thats how i got into this mess.
Thanks again for all your great input.

I am beginning to regret going to college, it seems the only thing I have attained from it, is debt. When I went to school I was allured to the dream of being an airline pilot. I finally got my pilot’s license, but it got to expensive, so I switched to Aviation Management. I am so depressed and mad at myself for letting this happen, and it seems like there is no way out. A few times I forgot to fill out the FAFSA so I had to take out loans to cover the expenses, or I was late getting it in and got no money.
Here’s where I am at:
1 Loan for ,000 (Monthly Payments of 476/mo); 1 Loan for 620 (Monthly Payments of 128); 1 Loan for 00 (Monthly Payments of 50), and Credit Card Debt of about 00. So I have loans totaling 420.
I also have a car payment, cell phone, however I pay no rent, but my grandparents will soon be asking for that.
I just got a new job that pays me 000 per year. So if I don’t put anything into savings I can pay off my loans in about 4 years, however when you begin to figure in my other expenses it’s more like 7 years.
Consolidation is not really an option, because the 000 is an “Education Alternative Loan”, it’s not a federal loan. The 00 loan is a no interest loan. And the 620 is a direct federal loan.
-My dilemma is that, I have a girlfriend that I want to begin a life with. I wish to get an apartment with her maybe in the next year or so. And I want to marry her.
Situation 1- Do I put no money into savings and just tackle the loans head on? I will have no money for retirement or a down payment on a house.
Situation 2- I put some money aside into savings, and it will take longer to pay off?
Situation 3- Declare bankruptcy if I can?
I apologize for this taking so long, but I don’t know what to do. Thank you for your help.

I’ve made a big mess out of my life by making mistakes I could actually afford at the time. I had a great job making enough money that I could afford my own apartment and a brand new car. Life was great for about 2 years, all my payments were on time, and I had a little extra cash so I could go out with friends on the weekends. I met a guy and he moved in, and everything went straight down the tubes. My boss fired me and didn’t give me an explanation ("something needs to change and we think it’s you" whatever that means), and I found another job immediately but only making about half of what I was making when I got fired. This whole time, I was still paying all the bills for the apartment and car, even when I had a full time roommate because he didn’t contribute a dime for the first 5 months he lived with me. I used up all savings and started to borrow money from family and friends until they all cut me off ( reasonably stating that because I had someone else living there, they shouldn’t have to rescue me and I’m inclined to agree ). so at this point, I’m about 2 months behind on my credit cards and car payments, and my brain snapped and I told my bf that he had to start helping with the bills. at which point, he started "helping" with about 1/4 of the bills for the apartment ( i never expected him to help with the car or credit cards, but I do feel he should have had to help with 1/2 the bills for the apartment, especially since his kids were there on the weekends as well ). I quite stupidly started just flat out ignoring the harassing calls from creditors and collection agencies (hey, I couldn’t pay my bills just to live, sleep and eat much less give anything to the creditors, and they refused to work with me the first couple of times they called). I surrended my 2 year old car that I adored because the creditors told me they had reported it stolen (i don’t even know if they can do that, I was 2 months behind on payments). also adding to the misery, I had co-signed a loan for my brother to get a truck, which he also defaulted on and surrended. So to date, I have ,000 in debt and have no way of paying it back (at least not for the foreseeable future). I do have a job, making less than 0 a week with no possibilty of any overtime and / or supplemental income. last october, I was severely depressed and got behind the wheel of a car drunk, got arrested and charged with a dwi. so now, I have to pay rent, fines and surcharges, my car insurance went through the roof, and my phone bill. at the end of the month, I’m left with about , 0 if I’m really lucky. I talked to a credit counselor to try to get the debts under control, and she informed me that my ONLY option is bankruptcy. I’ve come to terms with the whole bankruptcy thing ( and believe me, I’m not thrilled about it ) but the biggest problem I’m facing now is trying to come up with the money to file for bankruptcy. The creditors are getting more aggressive, I’ve been sued at least twice, and they are threatening bench warrants and garnishing my wages. I can’t afford what I’m living on now! If they garnish my wages, I will not be able to pay for something (most likely fines and/or surcharges) and all of this is going to turn into an even bigger mess.
I’m at the point now where I understand all of my mistakes, realize that I have to pay for them. But I’m also at the point where I am extremely close to suicidal. I can’t eat, I can’t sleep and I can’t concentrate on anything. I’m ill at the situation I’ve created for myself, but I don’t know how to fix it. I don’t even know where to start. I quit drinking nearly 6 months ago after realizing what it had cost me. Is it too late? Am I doomed to be a mess my whole life? It seems like this situation never gets any better, it’s gradually just getting worse, to the point of just giving up completely.
This situation feels completely hopeless. No one has any advice for me. every one just says "that sucks". well, no kidding! I hate to sound so shallow, like money is the only thing that matters to me. I don’t just care about money ( in fact, I HATE IT ). The fact of the matter is that my whole life feels wasted, like I’ll never recover from any of this. I hate no longer being self sufficient, and feel like I will never be able to take care of myself again.
Is there anyone out there that has any advice for me at all? Steps I can take to improve the situation? Or possible jobs I could take on to try to make some extra cash so I can take care of all this with a less than stellar record? I just need some help and this is my last resort. I really don’t know what else to do.
And for anyone who has snarky remarks, IE: you’re on the internet ( so I must have $ right? no, I use my computer at WORK), you made your bed blah blah blah, please keep the comments to yourself. the purpose of my post is a last ditch attempt at trying to get some help, not lose any more of my self esteem, if there is any left.
Thanks

My wife and I both lost our jobs a month ago and now we’ve decided to head to college together.
–> bad credit car loan about to be repoed, 2 credit cards (i already been sold to collections), apartment bill about to be sent to collections, and some medical bills
Can we get enough aid to pay for college and then for my dental school IF we decided to file bankruptcy?
Also, how much does bankruptcy cost?
Will bankruptcy cover all of the things I’ve listed before?
Thanks for your help everyone.

I have around k in debt. The debt is all personal debt and there are no co-signers nor assets in question. As for my personal assets, I don’t believe I really have any. My car is eight years old and I live in an apartment. I was considering filing bankruptcy before I begin a new job and get better pay (therefore, they do not see a bigger paycheck and feel I can pay back my loans).
So, the question is, what bankruptcy should I do if there are no assets which can be liquidated to pay back my debtors?
Funny how many people jump down someone’s neck when they talk about bankruptcy. I guess Enron, K-Mart and others are fine, but regular humans are not? Get a life, people…

I have been in my home for a year and a half. I purchased it through owner financing. I lost my job two months ago and they are telling me they are going to forclose on my starting next week. My option at this time might be bankruptcy, but only a ch.13 would help me. I then, am leary, because I don’t want to put myself in more debt just to save my house when I am not that far behind. They will not work with me. The ch.7 alternative I have been told, will not help me save my home, so I am beyond upset and really don’t know the best thing for me to do, but I really don’t want to end up homeless. I rented at one time in my life and the only time, and was evicted from the rental because the landlord wanted me to sleep with him. No lawyer would help me because they all represented him at one point, so now… I can’t even get into an apartment. If someone could please offer some advice, it would be greatly appreciated. I am a young widow with two boys at home.

We are filing bankruptcy due to high debt. We own our home which we are going to try to sell…if not, then we are going to do a short sale. We’ve NEVER been late on any payment (both mortgage or bills) but are struggling each month and it’s ruining our lives. My question is, every one requires a credit check these days (to rent). How do we find a place to live? I want to keep my children enrolled in the school but the other alternative would be to separate living arrangements and move to our parents homes (I wont live with my in laws & my husband wont live with mine. We can rent a house for what an apartment goes for in another city. How do we get a landlord to look past the bankruptcy and see that before it, we made every payment on time (while struggling to do so). We could easily make the rent (minus all the extra debt we had).

I am a single dad with 3 kids. I filed Ch. 13 bankruptcy about three months ago, so it is far from discharged. I got a note on my apt. door from mgmnt saying they would NOT be renewing my lease 4/30/06. So I have to find a new place to live. With my being in bankruptcy, my credit could not be worse. So I will have to come up with a 1st, last, & security payment to move in. I want a 3br (the kids) but the move in costs for a 3br are astronomical. I was thinking about NOT paying March and April rent to the place I have to move out of, to use the money to be able to find a new place. I know thats not the standup thing to do, but I dont want me and the kids to be homeless, either. Anyone know how long it takes after you get a 3day notice demanding rent payment before you ACTUALLY have to remove yourself and your property from an apartment? Im in Florida, btw. Any serious input is appreciated.

I own a business and am incorporated. I am considering filing bankruptcy but don’t want to include my personal debts (car payments) because I will pay those without disruption simply by getting a job. I want to find out about my business debts and if I can file bankruptcy on those and not involve my personal finances. I rent an apartment and pay car payments and do not outright own anything.

I had a roommate in college who really screwed me over by bouncing her half of the first month rent with a check. The leasing office slapped a bunch penalties on her and even took her the court but she didn’t show up. We got an eviction notice after only being in the apartment for 3 weeks. The check she bounced was in the amount 7. After all the NSF fees she owed 0 plus everyday she didn’t pay it. She skipped town on me and never paid her debt. Since we both signed the lease it ended up on my credit report. The amount was 00. I been paying on it for a year and half now the balance is 00. How can get the collection to settle for 50% or 75%. I have paid already 00.
Also, we signed the lease agreement when it was under a differenct management company. Now they sold the company to another company. Why should I have to pay the new company?
