A member of my family has been careless and wasteful with his finances and is now, for the second time, finding himself in over 100,000$ worth of debt, unable to find a job, and has ruined his reputation in his field all over the city/state.
Can he file for bankruptcy again, or can you only do that once?
Will he end up in prison if he can’t pay his debt?

recently a client of LAWL, the company went bnkrupt, leaving me penniless from what I invested into the program. A class action suit has been filed in my state, I want to pursue, but Im not sure if you can sue after I did a bankruptcy myself. (SERIOUS ANSWERS PLEASE) at the time when I filed I didn’t have this problem, its after the bankruptcy. What will happen?

I financed my cdl schooling through a loan. they are willing to take me to court over being 1 ayment behind. I can’t make that payment I don’t have the money. they would rather see me file bankruptcy than wait to get their money. however, they mentioned I could lose my cdl. is this possible or are they pulling my leg to get me to pay?

I hate my mortgage lender (Litton) they added an escrow to my monthly payments due to back taxes, but here’s the deal…my city tax never sent me a property tax bill and when I went to inquire my mortgage company had paid it off. How the city inform my mortgage company and not me? Anyway, now my mortgage company does not want to remove the escrow even if I pay the back taxes. This is "Cow Dung" believe me I’d like to say something else. What are my options? I’m frankly sick of this company and I’m sick of the house anyway. I have it for sale, but should I get a lawyer or file bankruptcy on the mortgage. That’s something I really don’t want to do. I already have one bankruptcy in the past, but I’m really sick of Litton and their high handed tactics. I pray to God they go bankrupt and get absorbed by another Company, they are really unreasonable. I have faithfully paid my mortgage, but I should not be screwed into paying more for an escrow I don’t need and I will be darned if I’m going to stay in a house I no longer want due to real estate decline in this bad economy.
I love how people like to add their 2 cents beyond the question being asked. Was I irresponsible in my youth? Yes and apparently half of america is financially irresponsible. I learned my lesson and I pay everything with cash. Unfortunately my taxes were a little behind but not delinquent, but I always pay my property taxes. However, my Mortgage may intervene. Whatever, happened recently I was left out of the loop and the city contacted my mortgage company instead of me, even though I was paying on my taxes. And furthermore I do not like my house or the environment so why should I remain in it? Things change. At one time I would have probably stayed or stayed longer. The house has been on the market for about a year and a half. I want nothing else to do with it and I don’t want to really rent it either. Though I’d choose that over foreclosure or bankruptcy.
Thanks lake lover. Although I don’t think its fair for the tax collector not to forward a tax notice. I have always got one in the past. This year I didn’t get a tax notice and when I went to inquire and pay on my bill, it seems like I got screwed.

I was a passenger in the car that got hit i fractured 2 bones in my spine, now the lawyer is telling me that in order to pay all of my hospitial bills that i may have to file for bankruptcy as one of 4 ridiculous options, why is it that i got hurt and it wasnt my falut at all, do i have to file for bankruptcy or pay for anything other than lawyers fees help me understand this please!!!!

OK, few questions. If someone has say, 25k in debt – credit cards, the like – is it really possible to call the companies and negotiate a settlement for less than owed? And #2, how does this reflect on the credit report?
My brother in law is telling me that he is inheriting about 30 thousand bucks soon, and will be calling his creditors (credit card debt only) and negotiating with them, telling them that he has to file for bankruptcy and offer them less than owed. He SAYS he can negotiate and get them to about .30 cent on the dollar.
Is this correct? And how does it appear on the credit report? I don’t believe him. He says that he wants to keep as much cash as possible to open a business in a year or so. I say he will regret it because of the marks on his report. Who is right?

I had a checking account with chase a few years ago that ended up over drafting about 00.00. I never paid it i just let it close. If i include them on my bankruptcy will i be able to open another checking account after im discharged?

We have a long time customer (who has always paid slow 60-75 day) but now owes us money over 100 days. We have kept shipping to them all along, but now have stopped. Is there any thing we can do to protect ourselves from bankruptcy. Is there anything we can do to keep from being considered a preferred vendor. What can we do now to give us a better position in bankruptucy court? Is there anything we should NOT do?

My friend is moving to Australia from the USA. He is ,000 in debt to 4 companies. He is planning on living in there for as long as he can. He does not want to file bankruptcy, he just wants to skip town. I told him that he will eventually have to pay up. I told him if he can save up for a plane ticket then he can pay off the debt then move but he is planning on moving in 6 months. Should he file or just skip town? If he plans on moving back won’t he be in more trouble financially?

If so would this protect you from being held in contempt? I filed bankruptcy because I lost my job when my ex wife cheated with my boss. She keeps saying she is going to hold me in contempt for not paying our mortgage that I could not afford since I lost my job.

My wife and I make about gross about 00/month and our monthly rent is 00.
Most of our debt is from expenses for pregnancy, income taxes, credit cards, etc.
I don’t think our rent may cause our bankruptcy. Do you think I should fear having to lose my rehome?

We have 3 children, ( 2 minor, 11 and 17), our home is our biggest asset. We have a lot of debt with judgments against us. He has hidden other property and other assets, ( motorcycles, vehicles), and other items of value by them getting them out of his name so I and the courts can t touch them. I must seek legal aid from our local county, as I have no money to defend myself. My husband is trying to make sure I get nothing, when I am the one initiating the divorce, because of his excessive alcoholism, physical and verbal abuse towards the children and me. There is a documented case with DCF against him, for abuse and drug use that my son’s school reported . The case was closed with no further action. We need to file for bankruptcy and I desperately need guidance in the right direction awaiting legal aid to assist me. Someone please show me the light…
He seems anxious to get me to sign his do it yourself divorce, yet he refuses to leave the house, and wants to stay while all this escalates.

I have had my home since 2003 and have a 6.5% interest rate. I have a VA Loan. I would like to free up money if possible to pay for student loans. I have been in Bankruptcy for about 5 years. My chapter 13 just closed.
Should I even try to refi, or would my horrible credit not get me a better rate?

I am making minimum payments with a few credit card companies but could have trouble paying these in the future. I don’t want to go through a debt consolidation company or a debt settlement company. Is it possible to call on my own and warn them I will file for bankruptcy and ask to settle before I stop paying for 30-90 days like most experts say? My house is 5 years old and I have a 10 year structural warranty. My home builder filed for bankruptcy 2 years ago. I have to have a beam in my basement, across my foundation that needs to be re-adjusted/re-set. How can I go after my old bankrupt builder to use my 10 year structural warranty, so I don’t have to pay for this work myself?

I filled bankruptcy last week with plans to reaffirm the auto loan and keep the car. Mostly because my dad is the co-signer.
Today I tried to make a payment only to find the loan has been sold to some other company, and now I fear they will change the interest rates and add fees. Is this what will happen? What would happen to the co-signer if I decide to return the car and discharge the loan?

We are a small business and the landlord has raised our cam fees 400% in the last 3 years with no justification. They are virtually putting us out of business, so with 24 months left, we want to break our lease and move. Is it better to file for bankruptcy and reopen in our new location with a new name. We are going to make an offer, but I am sure they will not accept it and try to sue us and get a judgement. Out of the 2 worse case scenarios, which is worse?

I am a 64 year old widowed man ,who is in need of a major back operation to be able work,walk,stand etc.for the past six years .Ive seen many doctors and the operations they say I need I dont have the co-pay money even with insurance throw the state I have throw my deceased school teacher wife.(Ive been self emp for years ,and cant keep up,IVE SPENT THE EQ LOAN ON MY house just to stay going ,credit cards are max out and have no way to pay all this,im screwed! anyway I go ,so should file bankruptcy or just let thing go ????? into forclosers and charge offs,my previous good credit will be ruined either way but whats the better way for my further if there is any hope after this ???
