If I file bankruptcy do I have to pay back my reserve line of credit at my bank?

I’m ready to file for bankruptcy as I’m unemployed & in two months I’ll be out of money if I don’t get a job. I’ve borrowed about k in a reserve line of credit at my bank. My bank deducts about 0/month for this from my checking account. If I file for bankruptcy will my reserve line of credit be taken care of in the bankruptcy or do I have to pay it back, IF I’m able to file bankruptcy? Thanks.

Help! Do I get an attorney to file bankruptcy or do it myself?

So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

Need to Settle Debt!! Possibly file Bankruptcy… Questions!?

I have a lot of debt (all credit cards) and I need to find a way to settle all this debt! I would much rather settle my debts than file bankruptcy. Currently, I am approximately ,000 in debt between about 8 different credit cards.

Does anyone know a good person/company that can help me settle? My good friend said she hired an attorney who helped her & her husband settle their debts for less than 40% of what was owed. Is that possible & how can I settle for a similar percentage?

Thanks for your support. I take it as an act of encouragement. I thumbs up ideologies that are against my own, because I think it’s important to encourage the freedom of ideas. More important than dictating what others must believe, I think. I accept other ideas, because people who disagree help to make us sharper in these times when the Truth of God is hidden behind a veil for so many of us. When He returns, then I think that people will have that mystery less indiscernible.

Can you settle debt with a credit card company even in good standing?

Can you settle debt with a credit card company even in good standing?
I am making minimum payments with a few credit card companies but could have trouble paying these in the future. I don’t want to go through a debt consolidation company or a debt settlement company. Is it possible to call on my own and warn them I will file for bankruptcy and ask to settle before I stop paying for 30-90 days like most experts say? Can someone give me their advice or opinion on this? Thanks

When you file bankruptcy, I understand that is not the same as foreclosure, But……..?

I don’t really know what does happen. My friend is under water on her house in Las Vegas, can’t rent or sell it & has decided to file bankruptcy. So what happens to her house now?

I tried asking last night & did not get much help, all any one wanted to do was tell her to do something other than the bankruptcy – I don’t want any suggestions about short sale, or any other alternative options. She has decided on the bankruptcy & I am ONLY trying to figure out what this means for her house.

One person said that she could give the bank possession of the house during the bankruptcy & it would turn into a foreclosure? I’m not sure I understood that correctly or not. Is that right?
Yes. she has other debt. She has been living in Las Vegas for 10 yrs – of course she has other debt. She works 3 jobs & still cannot pay all her bills.
Ok so when she files bankruptcy, it does not automatically get foreclosed on…right? She has to contact the bank to start that process…. Right?
The kid – I know that. She is NOT trying to get away with anything.

Her current jobs don’t give her any time to research. I sit in front of a computer all day & sometimes I’m not busy. I’m just trying to figure out what all she has to do – like if there is another step – like what acermill said.

Debt Settlement program startting tomorrow…what should I expect?

To make a long story short, I have managed to bury myself with almost ,000 in credit card debt I did not want to file bankruptcy. I have been able to pay around ,500 a month towards credit cards consistently which usually cover a little more than the minimum payment. I was doing the math and even with getting interest lower this is going to take me anywhere around 8-10 years. So I decided to join a debt settlement program that allows me to pay 75 a month for 36 months and it will get me out of debt by settlement. I have never been late on anything before but this month I have been advised by the company I decided to work with to stop paying the creditors. Does anyone know if the debt settlement companies send pfd’s or are they just trying to settle and get their share? What are somethings that I should expect to happen to my credit in the next 3-5 years? Does anyone have any success stories about settling their debt? I am just trying to sleep good at night with this decison.TY

I filed bankruptcy in 2000 but still getting denied….?

I was able to get one credit card a while back soon thereafter filing and kept paying off the balance each month. Recently put on permanent disability so my income is set and very limited so I can only pay X amount each month and now have found myself at the cards limit beacause the interest rate is so astronomical that any payments I make only about goes to prinicipal. I’ve applied for other cards that offer 0% for a year hoping to be able to transfer my balance so the payments might actually make a dent. Unfortunately every application has come back denied due to (1) insufficient income and (2) filed bankruptcy in 2000. This sucks and I feel totally screwed and stuck, any feasible ideas would be much appreciated.

I think I read somewhere that if the loan is a federal loan then you can’t. Also if someone co-signed for me do both of us have to file for bankruptcy.
Tried contacting them…they stated that it went into default a week ago and they can’t do anything about it.

How do people accumulate so much in credit card debt?

I only have 1 credit card and it has a 00 limit only. I hear online about people saying they racked up ,000 or ,000 in credit card debt and can’t pay the creditors. My first question is how in the world did a credit company let this happen? And don’t most of these people have credit card limits?

I know for credit cards, you suppose to pay within 30 days or so and if you don’t pay, interest is piled on. But wouldn’t after say 6 months where a person can’t pay off their credit card bills, then the credit card company would shut down their account? I hear people talk about maxing out their credit cards but what in the world are they buying where they rack up credit card debt that is ,000? I mean, you can’t buy a car with that since i don’t think you can buy a car with a credit card right? And don’t most people have limits? I would think most credit card limits are max ,000 a month unless they have a very decent job.

Can someone explain how people rack up so much in credit card debt? Do they get 10 credit cards with 00/month max and then max it every single month for 5-6 months? I understand when people rack up debt in medical bills, student loans, taxes and those things but i just don’t get how can people rack up so much in credit card bills. I mean after a person owes ,000 to the credit card company and can’t pay it back, why would they continue using it? I understand if you use it to buy food and support yourself and your family but do people rack up credit card bills b/c of food? I don’t think so right?

And if a person cannot pay it back, i assume they can file bankruptcy right in the united states? And i hear people talk about fleeing the country because of credit card debt. Do they do so successfully? And usually what countries do they flee to? I’m sure canada isn’t one of them right since you can only say 6 months max? What countries do people flee to? Do they ever get caught? So if they stay there after a certain amount of time, wouldn’t they be there illegally? And since they have to support themselves and make money, wouldn’t the us government know that they are making income and thus could garnish their wages even if they live in the other country? Or do these people just try to make money off the table and just live and hide? I mean, are there people that have huge debt , leave the us and then become successful later on in the country they flee to and then become rich? Because if they do become wealthy, wouldn’t they be caught eventually for fleeing the country? If they then decide to pay back their debt after they made money, would everything be fine or would they face huge penalties for fleeing the country? Or do they just have to stay below the radar and can’t live in a nice place because of it?

I’m very curious about this because i read so much about credit card debt and people leaving the country. I just can’t believe a person could have credit card debt this high because i assume the CC company would freeze their cards after they don’t pay after a few months if the balance is high.

how do i resolve a debt with a debt collector who will not talk to me?

its from a credit card debt, which was turned over to Arrow Financial Services (a debt collector), they in turn had Mann Bracken LLP (a national collection attorney network firm) contact me to settle the debt. I made arrangements to pay the debt, and was making monthly payments, directly taken from my checking account. After paying 00.00 over several months time, I received an "Agreed Judgment" from Mann Bracken in which Arrow Financial Services is the plaintiff and is seeking a judgment against me. I was in communication with Mann Bracken and was told to sign the Agreed Judgment and they would agree to not execute, abstract, or otherwise seek to enforce the agreed judgment during the term of our temporary agreement, as long as I (the defendant) complies with the payment terms. I agreed to pay 0.00 monthly directly from my checking account for 9 months, then the parties agree to review the matter again and attempt to negotiate a final settlement agreement.
This was in Sept of ‘09, in which I was dealing with my daughter and my grandson who were in crisis and our family was occupied with their issues, so I had every intention of signing the agreed judgment, but I got distracted and didn’t sign it, so at the end of Oct ‘09, a "Final Default Judgment" was issued against me. I of course called Mann Bracken and was told that after our agreed 9 month period of consistent monthly payments, they would have the judgment taken care of.
So I made my monthly payments every month, but in Dec ‘09 the money was never taken out of my account, so I called Mann Bracken, but the phone # was no longer in service. I tried several different #’s and all were disconnected, then I read on line that Mann Bracken had been investigated/sued and went into bankruptcy! So I then contacted Arrow Financial Services, spoke to a representative, explained the situation, and was told that a new debt collector attorney will be contacting me, but that has been 6 months now, and no one has contacted me.
What do I do? How do I settle the debt, I am more than willilng to settle, and what do I do about the Final Judgment? I’ve pulled my credit report from all 3 credit bureau agencies, and there is no judgment listed. I contested the debt with Arrow Financial, but after the investigation, the debt still stands in effect on all 3 credit bureaus.
Do I need to hire a lawyer?

Bankruptcy – Should I file now?

I was involved in an accident recently (a fender bender, really–no alcohol involved or anything), and the other party is trying to sue me for 0k (my lawyer informed me that they’ll probably seek about M with pain and suffering, etc.). I’m only covered for 0k, so the rest would be on me, which by no means am I able to pay.
My question is, would it be imprudent to file for bankruptcy now? I have other debts, and the prospect of getting rid of those as well is attractive, but I’d hate to file, then if this judgment comes up ruled against me, I still would have no way to pay it. So would I have to wait until a decision is reached before I were to file for Chapter 7?

In illinois if a house is foreclosed on, and after the sale there is a balance due, can you file bankruptcy?

House was purchased at 187,000 only owned 3 yrs and is basically at 184,000 on the loan. If it only sells at auction for 170,000 because of the turn in the housing market can bankruptcy be filed to erase that amount owed to the bank. No back taxes are due

how is the economy today?

2/24/2010 the economy is as worse as it was when the economy went down/meltdown. Nothing has changed but thousands of people are still being laid off work each months and thousands of jobs/positions are begining cut/terminated. There are no job new jobs created or positions a reason people are still unemployed. The stimulus money only helped business out of bankruptcy which had become bankrupt because they were mismanaged/corrupt. The leftoiver money from the stimulus were and are given as promotions, wage increase to managers, CEO’s though they did nothing to prevent the company from going bankrupt or help it out of bankruptcy but only the stimilus money did and some people find still the audacity to praise these people though have done nothing. Most data reportng that the govt receives from business/companies are covered up/falsified so False record of money spending and company info occurs,. Stastics are falsified in money spending, hiring practices, employee wages, promotions, embezzelment. As it was when the economy went down, there are only a few jobs available in the job market or the same ones that have existed but for some reason companies have never filled those positions or they just don’t want to fill those postions since mabye they want to make the govt. believe they have new positions available or that they have created jobs. There a thousands of people available who applied for those positons who suprass the requirements for those positions by the way. With companies/jobs they have ways of falsfiying reports at the expense of the community.and half of the info they give to the govt is covered up.Now some jobs have popped up sometimes here and there but might have temporitly come up to fool the govt into believing jobs were created by businesses/companies who received the stimulus money but make no mistake the leftover money are either given as promotions or taken by corrupt CEO’s, manangers, headchiefs, presidents as you may recall the economy went down because of such people and what makes you believe they have changed since most weren’t penalized. In business its take as much as you can take. So in short there are no jobs that have been created with the stimulus money at all though it was the responsiblitiy of those businesses who brought down the economy and later received the stimulus money. Thousands of people have been hired as spammers for websites or businesses which isn’t a job but are recorded as a job in govt reporting. From personnel experience when a job now in the present is offered or available there a thousands waiting in line for it as thousands of people are unemployed. If you don’t believe go to one of these job interviews. I don’t care what you’re parent./relative working in wallstreet or some economical reporting agency says as most stastitics and reporting are incorrect, onesided and inaccurate as most business stasticsis is covered up and falsified. Its the reason the economy went down and should indicate that people aren’t there to look out for the community but themselves to reap millions or dollars or even billions for themselves at the expense of others. Congress isn’t concerned as long as they get money from those business into there pockets. To the disagreeing comments below its from people who haven’t been laidoff yet. They or their parents probably beneifit from these businessess/congress or are related to those people in businesses who received the stimulus money so they don’t care but oppose just to oppose because they have nothing good to do. Most of these people who disagree,commenting below don’t know whats going on in the world but live in there own isolated world.5/24/10. What makes the matter worse is the govt is saying that more jobs are availiable and employment is up so real problems are ignored. The jobs that used before the economy meltdown/downfall to exist seems won’t come back again.

Don’t think political parties businessmen are out there to help out people. Most humans are greedy, ambitious carless. Only a few humble modest people exist. Whereas you might be okay with a million some people want to make billions or a much as possible at the expense of others. People don’t get into politics to help out others but help out themselves and relatives.

When i say there are no jobs i mean no jobs and yes i’m excluding those few jobs that have popped out sometimes from those stimulus helped companies that have created those few jobst to let the govt. believe they are creating jobs or those few jobs that some companies have barely been able to make available which are rarely available but pop up sometimes when its available.

I don’t care if you disagree but i know you’re incorrect and wrong and know nothing about the economy.5/24/2010.

Should I file bankruptcy??? Is it smart to file bankruptcy?

I am unsure if this would be a smart move for myself. I am a single mom and most of my accrued debt is medical bills. I owe about 29,000 in medical and about 3,000 in miscellaneous things such as credit cards and etc. My family is encouraging me to do this but I don’t know much about bankruptcy… HELP!
