My husband and I have gotten so piled up in debt so quickly, especially with both of our father’s passing….. We just can’t make it anymore. We’ve managed to stay on top of it some how so far, but last week his car dealership closed and now he is unemployed. We want to file, but are unsure if you have to actually be behind in your bills for a certain length of time to be able to. This is our last option. Good bye good credit….
I was told by a car dealership salesman that the only way I could get into a car was through a lease, so I did. I have not had the vehicle for a year yet, but have put about 40K miles on it and am having a difficult time making the lease payment and paying the considerably higher insurance requried. I want to turn it back in, but am unsure about how much money they are going to try and bill me for for the mileage and wear and tear, and a host of other penalties etc. Will they put a lien against my home for this, garnish wages, etc.? Would filing bankruptcy before turning it back to them protect me from this? Would a bankruptcy be better than a repo on my credit history?

and no dealer would take it as a trade in.
If the auto finance place wants to do a writ of execution, can they do this after bankruptcy, and what exactly is involved in doing a bankruptcy yourself ?
Do you just file lawsuits for each debtor and see if they show up or what is the procedure?
The fact that the car did not run the whole time the person had it, and the person put so much $ into it to try to get it running in addition to the monthly payments for the car along with hospital bills has lead someone to want to declare bankruptcy,
