Hey Guys,
I have a few concerns and questions that I need answered. I have Googled the laws extensively but would like some human perspective.
I have a friend who downloaded software from Vuze.com. The software is a language software and the torrent he downloaded contained files from a bunch of different languages offered by the company. My friend can burn the files onto a DVD and the DVD can be used on any computer. There is no installation required or anything like that. He has posted the software for sale or trade in various cities on Craigslist.com. Originally he was posting the listings and including the name of the software. Soon after he received a cease and desist letter from company demanding that he remove the listings and stop. After that, my friend decided to post the listings but this time not include the actual name of the company. In the postings he does not write the actual name of the software, but rather posts listings such as "language learning software for sale or trade". Since then he hasn’t received anymore notices from the company. Once my friend receives emails from people who are interested he informs them of the name of the software and arranges to mail them the software. He later received payment via mail or PayPal. Like I said, I looked up all the technical legal punishments such as 0,000 fines, etc. I need your input on a few different questions.
1. Does the fact that the name of the software isn’t publicly advertised matter at all?
2. How exactly are people usually caught? I’ve read that the FBI investigates these matters, but is that typical? Are they doing it on their own or are they asked to by the companies?
3. If caught, what is a realistic punishment? I have seen people sent to prison, but in the story I read the defendant had made millions off of the pirated software and had cars, etc. seized. Could you really go to prison?
4. If you are found guilty in civil court and are demanded to pay an astronomical figure in the hundreds of thousands, what do you do? Would you be forced to claim bankruptcy? Are you allowed to claim bankruptcy since theres no practical means for obtaining that kind of money?
5. Would you have any further warnings or would your house just get raided in an attempt to look for evidence?
6. What kind of lawyer would you need to defend yourself and how much would it cost? What could they do to help you?
Obviously this is a serious matter and your advice is greatly appreciated. I am aware of the laws and have looked up as much as I can but I value your personal input and would like to hear opinions on what would happen realistically.

I have accumulated approximately ,000 in CC debt, and about ,000 in Medical bills. My credit score is around 525, and I have had most of these debts for 3-6 years. I’m 25 with no college degree, a job making ,000 Net year, and I live in an apartment. I own 2 cars, One with no engine in it valued at ,000 with an engine ,500 w/out an engine, and another valued at 0. I usually have about -100 left over every month for extra. 20-40% of that I try to put in a "cushion fund" for if I have a medical emergency.
I don’t plan on buying a new house for atleast 2-5 years, and my next car (If i get one) will be, at a max ,000.
My question is; Would filing for a Chapter 7 bankruptcy be an option for me, and If so what are the repercussions?

My wife and I have not been able to pay our credit cards since my layoff in March ‘09. Since then our income drastically changed and since we were unable to pay credit cards, we only encountered ONE reposesion on a vehicle, but continue to pay on two others, our individuals cars. We are just getting back to work, but don’t know if it’s best to file bankruptcy all-together or try to negotiate payoffs. We have heard both sides, pros and cons so we are unsure.

I am in over my head in debt. Every month I have to "borrow" at least 0 extra dollars just to pay my bills. My husband and I recently separated. He left me to take care of all the bills. Currently I am a 4th grade teacher and make about ,000 a year. That would be a great salary if I didn’t have to pay every cent to a bill collector.
Every debt is in my name (including a car that I got in my name for him, that he now refuses to pay for because someone else put another car in their name for him–his sister). I already had a car of my own. Now I have two. He didn’t have a job at the time, so most of the major stuff that we have gotten was in my name when we got married.
I am probably about ,000 in debt with credit cards; ,000 in student loans–I know you can’t put them on bankruptcy…I plan to pay them and go back to school next summer; 00 in personal loans; ,000 in car payments (2 cars–1 is almost paid for).
I have no extra income other than the child support (5 a month for 2 small babies that I raise alone). I use the child support on them instead of on me or bills because that is what it is for.
Am I an idiot for trying to pay all these bills off monthly and have no money extra to buy groceries and gas???Should I just file bankruptcy?

Wisconsin teachers are paid an average of ,000 in wages and benefits. And they don’t want to work. NFL players are multimillionaires and are demanding more. In both cases, the unions produce nothing.
We have free enterprise in the auto industry, world wide. Cars sell for a low of ,500 to a high of one million dollars. There are so many to pick from that I cannot keep track of them all. Because of unions, the government had to bail out US auto industries to keep them from going bankrupt.

We both have car loans, and we stay current on them. We are wanting to file bankruptcy from old bills before we were even married. We were trying to pay them, but it has become too much. Will we lose our cars if we file bankruptcy? Or will the fact that we have car loans hurt out chances? If so should we just give the cars back and try to buy something outright at tax time?

I’m 27 and want to buy a house but I can’t bc I’m about 10,000.00 in debt to about 15 credit agencies for random stuff and medical bills. I really can’t pay them off. I just started to pay one company off and they never report payments being made. I have 2 cars and pay well on them but always have a high interest rate. I’m not sure how to file of if will even help. Does anyone know about this or could give soem good advice. I’m kind of worried about getting scammed with those credit repair people. I’m in Illinois also…and if more info is needed just ask and I’ll add it on…thanks!
oh yeah and I have 2 cars bc my husband has one too….I’m working and so is he, but we have to live ya know….plus a second job is out bc I have a child…and I’d probably be working to pay for childcare..

I have a mortgage, 2 cars, and some credit card debt totaling around 0,000. Should I file bankruptcy on this debt, or is it feasible to do the Dave Ramsey plan to eliminate debt.

Red China and the Saudis?
How is this going to help our economy one bit? How can this do anything but further bankrupt the Federal treasury so we can’t even pay to protect our own soil?
Wouldn’t even welfare be a better way to stimulate our economy? At least most of that would be spent on good made in this country – like food, etc.
My point is most people are going to use that money to buy cheap foreign crap, made by Communist dictators! Or to put gas in enormous cars and that money gets to terrorists one way or another.

I’m not behind on payments yet, but my debt is just over K on 2 cars and CC’s. I don’t own much & just have an apartment. Life is secure, but I only make K per year & with cost of living plus current interest on debts; it will take me well over 10 yrs to pay off. I know that if I don’t do something in the next 2 months, I will have to begin falling behind on payments thus beginning to damage my credit. Should I just file bankruptcy?

all of these items are in my name but my wife drives one of the cars all the time. it’s basically hers. i only have 9 payments left on my motorcycle and don’t want to lose it for filing bankruptcy. is it possible to keep the house cars and motorcycle? Or am i better off selling my bike to avoid losing it and getting nothing in return.

I am a business owner and I am having an issue with getting paid for my services that have been completed. My husband was a business owner (both of us in construction) and recently had to shut his company down to to an issue with the IRS. I have done work for one of the same companies that he has in the past. His company was issued a levy and the levy was also send to the General Contractor that I am doing the work for. The General Contractor is now holding my funds and refusing to pay until they hear from the IRS. Meanwhile there is no paperwork filed against my company for a lien or a levy by the IRS. This GC is just not paying me. I have hired a CPA to help us and he flat out told us that what this General Contractor is doing to us is ILLEGAL!! Because of this we have gone bankrupt. We are losing our house, our cars and have had to seek counseling becuse of the amount of stress that this is putting on our family. We do have a 20month old daughter and in less than a month we will have no place to live, no vechicles and be completely broke. I am in a situation where the only thing I can do is hire legal counsil to get our money. We are owed over 0,000 and we don’t think we will see a dime unless we get legal counsil. Can I sue them for withholding funds? Can I sue them for emotion distress? How much can I sue them for? I need some advice!! Please help me!!!

Obama could swig a Coke and smoke a Marlboro before every press conference. The FBI jackets could sell advertising space to Smith & Wesson. And govt cars could sell space for advertisers just like NASCAR. The federal govt could raise billions of dollars by doing ads!
The national debt is almost trillion, Obama wants us to go another $trillion into debt and the recession is deepening. As Obama said, we must take action now.

I am in the process of considering filing bankruptcy and I have 2 cars that I have and they are both on loans….one is for 6900 and the other one is for 3000 I have both of them because one is for me and the other one is for my boyfriend he pays his and I pay mine and I have never had a problem with him paying his car payment.. (just in case some of you want to say that I shouldn’t have a car in my name for someone else I already know this) Thank you!

What will be the effects on USA when are auto company(s) go bankrupt or are bought by outsiders? How will this effect security? How will it effect our country when all cars are made else where.

i am 22 and my husband is 24 and we have horrible credit and lots of debt. We’ve had 2 cars repossessed in 3 years and a few credit cards we cant pay. we also have loans and blah blah. i know we’ve made bad choices but how do we manage now? we have 3 kids and we are ALWAYS broke trying to just keep up and our family is suffereing. should we file? will we lose the car we have financed right now? will it really be 7 years before we can buy a house? HELP!
OK FOR THE RECORD i have my tubes tied now, and also we are military and get paid shitty. we HAVE made mistakes but all the credit cards and loans were in emergency situations.

i can afford my house and vehicles and motorcycle loans. its the credit cards that i want to wipe clean. i only have 12 payments left on my motorcycle and i want to keep it. i don’t want to include my cars or motorcycles or mortgage in the bankruptcy, just credit cards. I am going to file a chapter 7 bankruptcy, and I will surrender my cars. I am up to date with both payments, but will not make March 1st payments on them. When should I expect to surrender them to the banks?

I’ve been looking at an informational site and couldn’t find anything that would answer this question plain and simple. For Chapter 7 it said you could keep clothes and furnishings and something else but it wasn’t house. It said everything of value had to be liquidated to pay the debts. For Chapter 13 it said something about mortgage, but it made it sound like it had to be paid off in 5 years, which I know for what my sister owes on her house, she’d only come close if they weren’t charging any interest during that time. If worse comes to worse for my sister and she ends up with her cars going into repossession and house into foreclosure, and she files bankruptcy, can she keep her house and one car, or would she have to sell them and start from rock bottom all over again?

Thinking of filing bankruptcy but not sure how to determine Chapt 7 vs Chapt 13. Most importantly we want to keep our home and cars. We have credit card debt that we cannot keep up with anymore. Talked to a credit agency and they suggested contacting a lawyer to explore this as an option. We are in Jefferson County Missouri. I need to find a lawyer to answer some questions. Any suggestions?

With a bankruptcy they could get rid of all pension plans and health benefits to retirees, and pay current employees a much more reasonable wage. They could then produce cars that people want and can afford.

Like all the extra homes they have? All their other assets, boats, cars, vacation homes, stocks, bonds, IRAs, and any other source of income? Will they lose their pride? Be ashamed? Have no future?
Will be they be treated like the ordinary guy who lost his job, lost his home , and his credit? Will they be treated like the bums they are? Or will they get richer because of who they are, and who they know? Republican Thieves. They are supposed to be educated, why did they act like morons? They do not deserve to be bailed out. Thrown out is what they should get. Penniless!

Thanks to idenity theift i pulled my credit, i found alot more than i expected but as it turns out they do all pan out. I am thinking about filing chapter 7 bankruptcy but since my wife’s credit is good we dont want it to show on her file, heres the thing. We are young we have nothing in our name our house is owned by her parents our cars are paid off we have no loans or anything of that nature with both of our names on it I would be filing by myself with out her. All my bad credit is old starting when i was 18 and I want to get a fresh start and with all the old medical bills and things bankruptcy seems the best for our family. I’ve read alot on these sites saying your credit is there credit and when you are married there debt becomes yours, this isnt true my wife’s credit score is over 700 while mine is in the 500’s this is why i am asking i dont want it showing up on her file…. does anyone get what im trying to say???

I was told by a lawyer that I am judgment proof. I am ,000 in credit card debt. One of my cars is owned by my boyfriend who makes the payment but it is in my name. What will happen to his car if I file for bankruptcy?
