I settled a debt with a CC Company and a day later I was served papers on the same debt. They told me they would notify the court it was settled…………Do I need to hire a lawyer to respond to those papers? I hope not.

A Settled Debt through a lawyer being reopened by a different Debt collector?

This spring I had a credit card debt turned over to a lawyer. The lawyer contacted the CC company to make a lower settlement which I then completed. I have a letter from the lawyer’s office stating the debt is paid in full.
Today I get a notice from a new collection agency stating this debt is still active and according to them nothing was ever paid on it yet the lawyer’s office whom I spoke with today still says it’s paid as was agreed upon.
I faxed their paper to the agency. My question is, has this ever happened to anyone before and what can be done? I certainly can’t afford to pay this bill twice when I was assured it was paid.

Is settling a credit card debt good? what are the consequences?

CC company have offered to reduce the tot. amt. by 1/3 and settle or pay the total amount with very low interest rate. Which is better. According to them 2nd option is better( b/c of credit rating ). But 1st option look good to me.
So either i can pay .33 cents for each dollar owed and settle or pay plus 2% interest per dollar owed and pay in full.
1st option will show "settled" for 7-10 years, while with 2nd option my credit rating will not be effected.

I need to contact the attorney that is suing me over a CC debt, I want to settle, how should I word the letter?

I have an outstanding debt with a CC company. They have already filed suit against me. I cannot afford an attorney so I have tried to correspond as best as I am able, but I find myself hopelessly tardy in getting all the correct documents to the right people and to the right addresses.
So I figured I would send them a formal letter stating that I am willing to settle. I don’t know how to word this letter. I am unsure of the legal jargon needed to address the law firm. I also don’t know what amount to offer them. Does this letter have to be officially served?
The total amount of the debt is 42.90. This amount includes all the "FEES" assessed by the creditor. Obviously this is not the amount they will ask for once a judgment is issued against me for legal fees court etc…… I know that the original debtor was willing to negotiate with me, but I was in a near Fatal car crash and was unable to deal with any type of billing issues, much less
anything else.
Please help……. Thank you

I've stopped paying my CC, what can I expect, and should I just file Bankruptcy?

Someone PLEASE help me to figure this out. I have been unemployed for most of the past 2 years. I have recently begun a job and am making barely enough to live off of and have moved in with a friend to save expenses. I have had perfect credit up until now… just 2 months ago I missed my first payments on my 2 credit cards and haven’t made a payment since. At first I told the CC company that I wasn’t able to make a payment for a few months, but now I see that I don’t have enough money to make a payment at all and don’t see myself having that kind of money again in my current job. I see no higher paying prospect either, and trust me I have been applying for the past 2 years. My debt with the 2 cards is 20K each, with a total of 40K in cc debt. I also have 14K in student loans on top of that, which I just caught up payment on. These debts are all from school expenses, I thought I’d be able to pay them off shortly after school but but I was not able to complete the program. My question is this… if I just don’t pay my cc debt, have no house or property, and my car is a clunker, have no dependents, what will eventually happen? I already am being called 13 hours a day by collectors and it’s only been 2 months. Would I be better off just filing bankruptcy? My income 3 years ago was 43K, and now over the last 2 years it has been a total of 15 K (mostly earned the second half of 2008). If my credit is going to be ruined anyway, why not just file chapter 7 bankruptcy if I have no way of paying it off over the next decade? Bankruptcy seems my only option, but I know I feel desperate now and hate to do something so drastic if theres a better way… I just need to know what the better way is and what to expect. PLEASE someone enlighten me. Thank you!

I received an offer from the original creditor to settle my CC debt what now?

This debt is for a credit card that I have had for 22 years. Prior to now I have always paid off my balance each month in full.

Last September I was in a terrible car accident, I was in the hospital for over one month, and have since had 4 reconstruction surgeries on my legs. I lost my job, and my husband barely makes enough to pay our mortgage and keep the utilities paid each month. We had to use the card to pay for some of my doctor visits, medicine, groceries, etc now the card had about 00.00 on it. My doctor says that I will probably never be able to work again due to the extent of my injuries, and I should file for SSR. We have been unable to make any payments on this card.

Yesterday I received a notice from the CC company wanting to settle the debt. Has anyone ever settled a debt? How should I proceed? Will the CC company want a lump sum, or will they take a minimum payment each month. Honestly I do not want our credit ruined, as we had perfect credit, but I would only be able to make a very small monthly payment, does anyone know if they will accept the payment?
