We had filed chapter 13 last October. The payments were so high we just couldn’t make the payments. The bankruptcy courts dismissed our case for non-payments. Are we eligible to file for chapter 7? Will we lose our home? We live in Ohio if that makes any difference at all. What should we expect to happen?
Not ask for it during chapter 13 process(not listed as part of debts) then sue for it later?

I filed chapter 13 in Ohio to save my home. Three years in, Charter One sent me a letter stating they charged off my mortgage and elected not to foreclose. When I contacted them, they gave me the run around for twenty five minutes. Finally someone told me that they didn’t understand why they did it because my chapter 13 payments and mortgage was current. I checked my deed and title and no liens are on either. It show a satisfaction of mortgage. What is going on?

Hello I have recently filled for chapter 13 Bankrupcy, and pulled up my credit report the 4 account that i included in bankrupcy are being reported as "bankrupcy petition" in my experian report. "wage earner plan in transunion and equifax just need to make sure if they should be reporting like that, Thank you
We are considering chapter 13 as we are deep in debt with interest rates so high we can barely afford the minimum payments. We are not behind on our mortgage. Do we have to include our 1st and 2nd mortgage in the reorganization? Or do we keep those separate? Is it all debt? Or just unsecured debt?

There is a utility trailer and some lawn equipment that is needed to keep the business going, would that be liquidated in chapter 7 or is work equipment safe? IF someone were to get a settlement on a personal injury, but not enough to pay off all debt, and they still need to file a Chapter 13, how long can they have had that money in their posession and NOT have to report it to the bankruptcy court?

I would think Chapter 7 where all of your debts are essentially wiped clear.
Chapter 13, is more expensive and you still have to pay back your creditors what you can afford to pay in a 3 to 5 year period.
Clearly, Chapter 7 has to be the more common one.

Again, the home will be only in my name which I am not sure if this will help or not. My husband has some personal credit issues and I as well. But, most of our issues are together. We believe we should file a chapter 13. He is a school teacher and I am a part time self employed music teacher. He also owes a lot of money on student loans from getting his Bachelors degree. I am 51 years old, am very grateful to my parents yet very nervous about losing my home. Thank you !
My parents do not want the home in their name as they do not want to pay Insurance and taxes among other reasons. I have heard of many people owning homes and filing chapter 13. If this is the answer do you think we need to do it soon so the courts do see that we are trying to resolve the issue after recieving this gift? They will also see that our hardship and loss was due to my husband being in the mortgage industry and my health issues.

We had put down a chunk of money for escrow. We were to close a few weeks ago until Fannie Mae said that they need go over the homes forclosure papers. Something was not done exact. I and Fannie Mae signed an extension. Can I back out of the deal and do the bankruptcy then look again for a home again? Or, will I lose the escrow money which my dad would kill me for that. That is my concern now?

I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.

I lived in PA my whole life, own a home there. I lost my job 1.5 years ago, and I had to file bankruptcy in april of 2007. For the past 8 months I have been staying with a friend and working in Missouri. But my home is in PA, but been using my friends address for local employment.
My question is:
Do I file my federal and state taxes for Pennsylvania like I always have? If I do that, and on my PA forms, put down taxes that were paid to MO, or do I have to file MO only, and if I do that, PA will be looking for me for taxes? Or if I do the PA income tax, will MO be after me for a tax return?
Also, does my bankruptcy and chapter 13 payment plan affect my tax return at all?
I am in need of help. I always do my taxes myself cause I cannot afford to pay an accountant right now.

my landlord says he can’t pay me my deposit because he has no money and has completed his filing for chapter 13. A legal advisor said I could sue in small claims but said whats the point, I may get a judgement but the person has no money. Could I put a lein on his property?
if a chapter 13 bankrupcy is dimissed by a judge is there a 7 or 10 day waiting period before the lender can have their foreclosure sale.
The chapter 13 takes alot of my paycheck and I want to go back to normal bills. My percentage rate on my home is 13.50%. That is crazy. I know there is enough equity, so that is why I want to get the "13" off me and reduce my percentage rate. Hopefully there is a financial institution that can help me. Any suggestions???
I filed chapter 13 and now my car is on it’s last leg. I wanted to get another car under chapter 13 but was advised that it would be better to just convert to chapter 7 and wait a few months rather than pay wagearner payments and a car note plus insurance.What do you think? What am I suppose to do about transportation for these months?
