My parents declared Chapter 13 bankruptcy. They had a business in land development and thanks to the housing bubble it collapsed. My dad unfortunately personally gauranteed some of the corporate paperwork.

Now the problem is they are starting to make more money, but the settlement keeps taking the money. Is there any way to try to make more money? Or are the doomed to their current lifestyle for the next 5 years? Any thoughts? Perhaps a bank in the Caymans?

My husband and I went thru a chapter 13 bankruptcy 2 1/2 yrs ago. We were able to keep our van as long as we continue making the payments. We no longer recieve statements just have to mail in our payment to bankruptcy department of the bank. The van recently quit running and we want a new vehicle but still owe 00 on the van. I’m trying to file for bankruptcy..and trying to get married at the same time!

If I file bankruptcy after I get married will this effect my husband’s credit? I know there is Chapter 7 and Chapter 13 bankruptcy, and I cannot afford to pay back my debt so I think I fall under Chapter 7.

I filed Chapter 13 bankruptcy approx 2-1/2 years ago and have fallen behind on my payments. I have been with the same mortgage company for almost four years. I started with an adjustable mortgage. After two years the rates and payments shot up. I modified with them to a two year fixed. This expires in August. Last November, I filed a Chapter 13 bankruptcy, which includes the mortgage. My attorney says to either work on another modification with the company I have, or to seek out a refinance somewhere else. Has anyone out there been in similar situations? What did you do? I am thinking of filing for chapter 13 bankruptcy. I don’t qualify for chapter 7. There is a few things I don’t understand, if I owe a total of 30,000 with creditors, some of which had interest and late fees accumulate. Will I be able to have the court take of the interest that accumulated. For instance I have a credit card with 00 balance and due to late payments & interests its 00. Will I be able to remove the extra 00 that was incurred.

We are about to pay off the balance on our Chapter 13 bankruptcy plan. At some point after our discharge is granted we want to buy a new car. We are planning on putting like 40% down.
