I’ve just got a summon yesterday by one of my credit card I have and I was wondering if I can still file Chapter 7? I do have other credit cards and medical bills that need to by paid as well that I haven’t been paying due to not having enough income to make the payment. Any opinions would be greatly appreciated!!
This summon was served in person and the real deal.

I’ve been looking at an informational site and couldn’t find anything that would answer this question plain and simple. For Chapter 7 it said you could keep clothes and furnishings and something else but it wasn’t house. It said everything of value had to be liquidated to pay the debts. For Chapter 13 it said something about mortgage, but it made it sound like it had to be paid off in 5 years, which I know for what my sister owes on her house, she’d only come close if they weren’t charging any interest during that time. If worse comes to worse for my sister and she ends up with her cars going into repossession and house into foreclosure, and she files bankruptcy, can she keep her house and one car, or would she have to sell them and start from rock bottom all over again?

I received a discharged from a chapter 7 bankrutcy, less than a month later i get served. I am being sued for a civil matter.

I had my hearing for chapter 7 my atty told me that up to something like 80% of my tax refund but atty won’t tell me if I’ll get it all back if no one files a claim or explain any further just says almost always a creditor files a claim.

Had filed for chapter 7 and kept the car. The credit card debt was consolidated into the car loan therefore the amount owed on the car is more than the car is worth. Due to unemployment, am not able to make payments and want to surrender the car back to the lender. Can I do this and what are my options?

I just turned my papers to the court and was wondering if anyone had filed chapter 7 without a lawyer and what the results were. I dont know if or what kind of trouble can happen if you make a little mistake?

After trying to find ways to be able to take care of our responsibilities we have come to the last resort and that is to file bankruptcy. We don’t own any homes or any real property. what I am curious about is which is better chapter 7 or chapter 13. We want to be able to start saving a soon as it done and when feesible start rebuilding credit. Our credit card debt is only 00 which is a lot, but it could be worse. We just had two bad years with this one being the worse. I am looking for advice on the best way to go between the two. Chapter 7 or Chapter 13 and why.
We are not happy about doing this as we have tried everything. We don’t have anything of value and we have tried to pawn stuff but couldn’t get .00 for most. We live very modestly. So please do not answer this question if you are going to be negative.

As I stated it has been a bad 2 years, actually almost 3 years. I got real sick and had to leave my job and am now on disability. My husband took on a second job a year ago. He pays child support. Between the two of us we have 5 kids between the ages of 9-16. We have two vehicles, which one is in the shop. We also are surrendering this vehicle.
We have an attorney and he is recommending chapter 13. I (we) have a lot of medical bills. After I had to leave my job I couldn’t afford the cobra payments for continued health insurance. To maintain health insurance with my husbands employment (state worker) would have cost more than the cobra payments.
My ex- husband filed bankruptcy and I did not know that anything he had when we were together, came back to me.
I never thought I would get sick and have to quit work. I was not prepared.

I had some properties foreclosed. Now, the bank wants me to pay a very big difference on each properties. Is bankruptcy the only option? Lawyers said we’re making too much for Chapter 7. Any alternatives?

I filed Chapter 13 in 2004 while I was in the military. Now I’m out and am about 0,000 in debt for medical bills. Will I be able to file for a Chapter 7 since I’ve already filed once before?
The lawyers that helped me file the first time never said anything about a Chapter 7. They told me that Chapter 13 was the only option available for filing bankruptcy.

If a person has a lot of unsecured debt that has been charged off by the lenders and the person is not eligible for Chapter 7, should they file Chapter 13? What are the benefits of filing Chapter 13 in this situation? Thanks!

I have a past repossession due to job loss for over 34k and they are charging me interest a day. I have 6 credit cards with chase, capital one, and a home depot card, these will not be included in the chapter 7 because I don’t own any on these cards. Thanks for you help.

I am contemplating a Chapter 7. I thought if your income was less than the median income for your region, you qualify without having to divulge monthly expenses to see if you have any money leftover for creditors. So, is this true?

I have listed all of my outstanding debts on my bankruptcy (including the 2 mortgages on my home), although I had planned on keeping our home and continuing to keep up the payments. My atty told me that if I needed to walk away from the home at any point after the discharge, that the bankruptcy would help me to avoid any judgements as long as I didn’t refinance the loans. But even without paying the debts that I am filing on, we are still finding that our monthly expenses are far outstrapping our income, so we are thinking about short selling and getting a smaller rental home for a while until we get back on our feet. My domestic partner is on SSI, and is "judgement proof" from what my atty says, so between that and my chapter 7 simply walking away is an alternative to short selling. My question is: what is the best thing to do for the long term?? At this point, both my partner and my credit scores are in the toilet anyway. I’m just worried about never having credit again.

I filed Chapter 7 and before we had the chance to remove the recorded Judgements, the court discharged the case and closed it. I wonder how to remove the judgements without re-opening the case. We know that the judgements were wiped out in the bankruptcy, but not sure how the recording can be voided and removed?
So if I attempt to purchase real estate in a couple of years, the escrow and title companies wouldn’t bother asking me to deal with those judgements???

We have completed our first of five years of a chapter 13. Unfortunately, our marriage is not doing well and we are separating. I am hoping things can work out, but if not, is it possible for us to switch to a chapter 7 and get a complete fresh start so we can both be able to walk away from everything and start over? It is in the State of Ohio.

I have been unemployed for 9 months with bad credit as a resultof late payment. Should i file chapter 7 b/c I currently have no assets or dispute with my creditors to have some things removed from my credit report to improve my score? Ok so, I have no money, which is why I’m filing for bankruptcy, yet it costs money to file bankruptcy. Make sense?
