My ex-husband is preparing to file chapter 7. In our divorce settlement he is to pay me ,000.00 over a period of 5 years. This amount is to repay me for money I used to help him pay his bills off that he had before we met and to help him open a business. The amount and terms of repayment were all his idea and now he does not want to repay me. I have taken him back to court twice, with no good results and now I am afraid he will file against me. Can he legally do this ?

I am in debt from helping my son when he was off work. Helping my elderly father. Also, my ex-husband was fired from his job and now we are divorcing. I am in so much debt that I am far behind on payments and I make too much money to file a chapter 7. I would have to file a chapter 13 and pay back a portion anyway. Would a debt settlement company be a better option?

I am going to continue making payments with the state but can they still put a tax lien on you after you have filed chapter 7? Also, who determines the payments after filing bankruptcy?

Facing a lay-off, we may have no other option but to file for Chapter 7. We have a mortgage and second mortgage. When you file chapter 7, does this discharge mortgage debts as well? Then do you give up your home, or keep it, or what?

I filed for bankruptcy about a month ago, and paid him in full last week for chapter 7. Well my bills for my loans and credit cards are due again and I’m wondering do I still have to pay them since i already paid my lawyer and filled out all the paperwork for the chapter 7. Or do I just let it ride until he does whatever it is he does?

I have loans and I wanted to know does the bankruptcy eliminate a portion of the loans? How does Chapter 7 work? How long will this remain on my credit?
I want to pay off my debt, but I have had a hard time finding work that pays well.
I owe about 35,000 in debt and I only make 18,000. I have not been able to find a job that pays more and I have been searching for a year.

I’ve recently been contemplating filing for Bankruptcy (Ch. 7) because I am in so much debt it hurts my brain to even think about it!! I am currently over k in debt. Most of the accumulated debt I owe is from past bills I ran behind on due to some unnecessary circumstances. Right now I am attending school full time and working part time making a measly 20/month as my take home pay. With my salary I pay for all the usual bills: rent, utilities, wsg, car insurance, car note, and use whatever I have left over to pay down my debt. For the past year and a half I haven’t opened any new credit accounts and I’ve been on a tight budget. I take full responsibility for all of the finanical debt I put myself into but am stressed and afraid that some of the creditors I owe will soon take legal action (as some have stated in their threatning letters). I’ve attempted to set up payment plans and have tried to negotiate a reasonable payment plan with my creditors but even with some agreeing to this others are not as willing. I am just seeking some advice because my credit is already horrible and even if I decide to paydown my debt it will take well over 5 years relinquish. I figured if I file for Chapter 7 it will stay on my credit just as long as if I tried to paydown all my debt on my own.
Big T: THank you very much for the advice and the many suggestions. I have been trying to stay optimistic about the whole ordeal and I have to give it up to you because I understand first hand how hard juggling work and going to school full time can be. I understand my debt is nothing compared to others but it is still a debt I have to take care of. I appreciate the encouragement and will look into other wage earning opportunities and try other ways to cut back!
Barnaby J: Thank you, I didn’t really factor in my wage earnings after college because they are still unbeknowest to me. (maybe if I looked into a crystal ball I’d know for sure..lol) But, since you have mentioned it I am predicting my salary wages will increase quite significantly after college which will help me drastically in cutting my debt!! However, I am not trying to rely entirely on those predictions! Thank you!!

I filed for Chapter 7 in april ‘09 and had all my debts discharged. I recently applied for a FAFSA loan. At the end of the filing, the file said I might be eligible for a certain amount of pell grant money.
Will the bankruptcy have any bearing on whether or not I will get approved for either a loan or grant?

I filed for Chapter 7 in Oct 07, and got the discharge in Jan 08. In the chapter 7 I chose to just turn the house over to the bank. Now, the bank is going thru foreclosure. Am I obligated to pay the property tax? How do I respond to the foreclosure to avoid paying, since I already moved out and decided to give up the house?

Is there any way I can file bankruptcy without paying an all the attorney fees maybe just filing fees. Am I still able to file chapter 7? My bankruptcy was discharged and closed in March of 2008. A couple months ago I found out I had a creditor still requesting money that I didn’t know about, and was not present on my credit report when I first filed. I was wondering if I could reopen my chapter 7 that was discharged and closed (in Illinois)and put this creditor in it. I filed myself without an attorney, so I didn’t know if this was possible.

Here is my current situation, I have the trustee meeting coming up very soon and I need to talk to a financial expert to go over my finances and to finally decide on what to do.

I am looking to file Chapter 7 under myself in the state of Nevada. I have only been to one attorney thus far and was told if I was married and both of us combined make more than k/year then I have to file Chapter 13? Anyone have more input on this?

I learned today that my flight academy has closed operations and filed for protection under Chapter 7. I must find out from my lender how much they paid and if they paid the full loan to the school. In the event my lender has paid out more than I have used to date, what recourse do I have against the school since it has filed for court protection?

married couple. both are 38. we have a child due in June.
We live in Vegas and want to move and get an affordable home. We do not own real estate. She has k and I have k in debt, both accounts are in collections. The only asset we have is 55,000 in a retirement account.
I filed Chapter 7 in 99. My current income as insurance and financial advisor is too high for 7 here in Vegas. Right now it is around k but can get much higher.
A chapter 13 concerns me because of the 3 years of payments, its effect on my credit and potential to get another good job should we move, and we may not be able to get a house should we move.
I could liquidate the retirement and pay off the debt and have about k left after taxes and early withdrawl penalties. This would also include the tax liability for the k I took from my account last year.
As a financial advisor, I know that the withdrawl we took last year was stupid.
MOM is giving me 50K for home purchase.
BK or pay?

The beginning of chapter 7 is no problem for me.I can take out the infantry easy-peasy, and i can toast the first two radiators like bagels.I sometimes have a k.o. or 2 at first but i get the medic out there no problem,anyways.Does anyone have or know where i can find an easy strategy for wasting that tank after Selvaria arrives?

I know this may be rather irresponsible of me but I have backed myself into a corner and I see no escapes other than declaring chapter 7. If I never would have financed my car (at age 19 now 22), then I would not be here asking about it. I still have 3 years left of payments on my car and insurance on top of that plus living expenses. I DO NOT wish to work full-time like I have been for the past 3 years because I want to just focus on school and not worry about bills. I only work part-time now and my income does not meet my needs. I figured why not since I won’t be buying a house anytime soon. I plan on saving up for a cheap car (about 2 grand) to have until way after graduate school and an established career. I was very naive and ill-advised a few years back and would rather suffer with a bad credit report now than deal with the bills and be forced into full-time work again. Please, I need some honest, sensible opinions. Thanks!

I’m in California, I bought the house in July 2005, REFINANCED in July 2006 then stop paying in February 2007 because my mom passed away and I couldn’t afford the payment, insurance and taxes all by myself. My house is now foreclosed. The bank took possession on October 2006. Countrywide continues to send me statement on the HELOC. Does this means that I still have to pay for the HELOC?? I didn’t even take any money from it. It was used to pay for the rest of my original loan when I refinanced. Can I file bankruptcy particulary chapter 7 for the HELOC??
NO! My mother is not on the mortgage. She helped me with it because I bought it for her… she couldn’t qualify.

I had filed bankruptcy 4 1/2 yrs ago and was approved. The I got back into debt because of unforseen occurance befell me. I have medical bills that need to be paid, I have students loans I need to pay off, but are on deferment or forberance, and interested has accumlated, I got laid off my day job, working part-time evenings (14 to 15 hrs a wk, 7.50hrly) been looking for fulltime work for 2 mths, tried filing unemployment, owe the bank 0.00 because my accnt is a negative, I am behind on my gas utility bill, my car is in the shop for the 3rd time in 4 mths. Spent already 790.00 total in last month on car. Yes, I live by myself and have been looking for a roomate, because I can’t afford to renew my apartment lease when I’m not making enough money to pay all my expenses. Would I still be able to file bankruptcy with out any hassles? I want to file Chapter 7, I just don’t see any other way out right now. Please give me your answer…….
