We had filed chapter 13 last October. The payments were so high we just couldn’t make the payments. The bankruptcy courts dismissed our case for non-payments. Are we eligible to file for chapter 7? Will we lose our home? We live in Ohio if that makes any difference at all. What should we expect to happen?
Well I know I can, i have a bunch of credit card debt and medical bills no property or judgments. can i file myself? i talked to two attorneys and they both stated i am a good candidate for chapter 7. i basically can not afford an attorney so i want to try to file myself.
i need to hand in a chapter summary tomorrow on chapter 7 in if i should die before i wake. please help, i don’t have time to read it.

I think I read somewhere that if the loan is a federal loan then you can’t. Also if someone co-signed for me do both of us have to file for bankruptcy.
Tried contacting them…they stated that it went into default a week ago and they can’t do anything about it.

I just got my discharge notice from the courts. I’m kind of happy about, mostly not if you know what I mean. Problem is that I don’t know where to go from here. I’m in a bind and need some really good advice. Bit of a long story but please read.
I’m 33 years old, living with mom and dad since sept 2007 and have been working at a part-time minimum wage job since nov 2007. I filed chapter 7 in july 08 and just got my discharge notice saying I’m cleared. My truck was repo’d in august 08 and now I drive a 49cc scooter. I closed my checking and savings accounts in oct 07 and recently opened up new ones.
Obviously, not my finest hour here. I’m lost and depressed and pissed off in general, and don’t know what to do or where to go from here. My only real skills and experience job-wise are customer service and supervising, and I hate supervising. My one supervising job lasted 3-1/2 years and I quit because I hated it and management. First job that I’ve ever left on really bad terms.
Quiting is how I got into this mess unfortunately, I had a new vehicle that cost a lot but was affordable with the job. I moved in with my brother (a financial risk in itself) when he came back to town to help him. The next job in sales (third big mistake), didn’t cover me financially. I got a second job, but that still didn’t make ends meet. Finally I gave up at everyone’s insistence and quit both jobs, moved home to mom and dad, then searched for a new job (4th mistake, quitting before finding new job). After that, it was all downhill, the folks pushed me to file bankruptcy and even made the appointment for me, which I went to and then filed for (mistake? I’m not sure YET).
Here’s the toppings, I have mild spastic cerebral palsy which is screwing me up physically and the part-time job is pushing that along. I need a sit-down job like with the supervising job but without the supervising part of it. The economy is crap to boot and I’ve never been good at getting jobs to begin with before this economy mess (12% unemployment rate right now in my town). To say the least I feel like I’m in hell right now. I’m not seeing any real options to get my life back.
I thought about college but now my folks are definitely moving in 2 years (but no destination yet) and I’m stuck putting college on hold until we do move or at least know where we’re moving too so that I can contact a nearby college for potential credit transfers.
Anyhow, I just don’t know where to go from here. I seem to be questioning every choice I want to make to the point that I can’t make any decisions any more. I just cannot seem to get my head back on right after this major mess I got myself into.
So here’s the multimillion dollar question: What do I do now to get my life back on track financially?
I have a large amount of credit card debt and want to file chapter 7 but I don’t have an income now and have not had enough income for 3 years to even file taxes. Will I be able to qualify for bankruptcy?
I was involved in an accident recently (a fender bender, really–no alcohol involved or anything), and the other party is trying to sue me for 0k (my lawyer informed me that they’ll probably seek about M with pain and suffering, etc.). I’m only covered for 0k, so the rest would be on me, which by no means am I able to pay.
My question is, would it be imprudent to file for bankruptcy now? I have other debts, and the prospect of getting rid of those as well is attractive, but I’d hate to file, then if this judgment comes up ruled against me, I still would have no way to pay it. So would I have to wait until a decision is reached before I were to file for Chapter 7?
Because bankruptcy stays on your credit report for ten years and most people
cannot qualify for Chapter 7 and end up getting a 13, which is just a repayment

Here’s my situation. I was on the top of the world before I even turned 21. I worked so hard to accomplish my financial goals of basically owning my own house and own vehicle before my 21st birthday. Some where down the road I got lost… The great job I had to get the house, I had to eventually step back from to take a slightly lower paying job that offered insurance. To make a very long, struggle-filled story short. I lost everything. And when I say everything, I mean everything. My then fiance` and I split, needing to find our selves again. My new job wasn’t what I thought it was going to be. I inevitabley lost my house, my car, and had to stop making payments on all my credits cards because I quit my job to move across country (with my now husband) who is an Active Duty Marine (now deployed 
). I know this is all over the charts, but since my husband is now gone, this is giving me a lot of time to fix/figure out our financial situation. Since my credit score is basically at the lowest point possible now, which bankruptcy should I file for? How does Chapter 7, 11, 13 etc work? My husband does make a decent amount of money, specially being deployed now. But really only enough to pay the bills and pay down his credit. Any and all information on this would be great.

I was having over 70000 dollar credit card debt and about 32000 dollars in bank loans. i filed chapter 7 protection and my 102,000 dollar debt was eliminated. What other benefits exist beside elimination of debt?
I have no property other than a vehicle and I live with a relative. Can they take that under Chapter 7?
I am 26,000 in credit card debt. My life turned around completely last year and I lost many things in my life, family, job, etc. I am not making enough on my job to pay the basics and have been using up all may savings. Now I have no savings left and am short 600 month just for basics and providing for my daughter although she doesn’t live with me. She lives with my mom who is living on ss. I need to file chapter 7 but can’t afford the fees and am not smart enough with paper work to do it myself (I’m terrible with directions). I can scrape together money for the useless credit counseling stuff (so they can figure out how I can pay 1800 bills on 700 income, lol) if I don’t buy groceries for a couple weeks but I have no way of getting 500 dollars. My employer cuts hours every week and it’s that way on all retail jobs. I can’t just get a better job and even with that, i would only have the money I need for the basics. My small tax refund will only be 30 dollars.
If I was able to get a second job (not easy with no transportation and if I work after dark, I have to take a taxi (I spend 20 dollars a week now on taxi rides when I get off at night as my neighborhood is very dangerous and I can’t move). If I can find extra work hours, it will just keep me from being homeless a couple months longer, it will not cover bankruptcy costs. I have no resources, family and friends have no money to help. Is there anywhere in Houston where I can find free legal help (not just a consultation but actual filing assistance without cost?) If I have to pay the fees, I will not be able to pay rent. At the rate I am going, I will be homeless as of July 1st providing I don’t lose my job or have any more hours cut.
They are only a week late but I am already getting calls all day during the week. No one leaves a message on my machine so I presume it’s one of my creditors. I need to file bankruptcy because if I don’t they will sue me and freeze my bank account which only contains my pay deposits which are only 700 but if they take that, I can’t pay my rent. I have nothing to sell as I lost everything I owned last year when my family through me out. They gave away and sold all my stuff. I have a 50 tv and a40 boombox that doesn’t work and a 2year old computer that runs slow.
There is a utility trailer and some lawn equipment that is needed to keep the business going, would that be liquidated in chapter 7 or is work equipment safe? Chapter 13 plan is no longer feasible and there is consideration to convert to 7 but the work equipment must be preserved. Please let me know specific to New York State, because NY is always "different".
I have two accounts that are still being reported negative as of 5/31/2011. They do say Chapter 7 at the bottom of the list but it also says derogatory and has a recent date listed all of the other accounts say paid. My bankruptcy was discharged in April of 2010 and these accounts were listed on the bankruptcy. Also a judgment was filed on one of these accounts against me after i filed bankruptcy. My debts have been discharged in Chapter 7. However, a major electronics store has contacted me indicating they have a lien against a laptop computer purchased from their store (on a store credit card) and they want the property returned. Can this property be seized?

I was kicked out of my house at a young age (16 to be exact), and the only thing that helped me not be homeless was the dreaded credit card, since there’s only so much money a 16 year old can make.
So now with the credit debt, the school loan debt, the car payments, etc etc, I am in over my head (over 15k). My question… Should I file bankruptcy or not? Also, should I file Chapter 7? Also, what would the best attorney for me be? (I was looking at Peter Francis Geraci, but I can’t find anyone that has filed with him). Also, what is the time frame i’m looking at till I CAN actually file bankruptcy (I heard it takes over 2 years?)
Please, ANY help will be beneficial. I wasn’t a "bad kid" that got kicked out into the streets… I built myself a life in a state by myself and tried making it, but unsuccessfully.

I didn’t think there was a time limit going from 7 to 13, just if you wanted to do another chapter 7.
I received a chapter 7 discharge which included my previous residence in another state. I continue to receive fines from the HOA on this property. I have not lived at this property for almost a year and the house is vacant. How long am i responsible for the upkeep on this property and responsible for paying the fines they continue to levy against me as I said I have already receved a discharge from the Bankruptcy Court. I’m trying to file for bankruptcy..and trying to get married at the same time!
If I file bankruptcy after I get married will this effect my husband’s credit? I know there is Chapter 7 and Chapter 13 bankruptcy, and I cannot afford to pay back my debt so I think I fall under Chapter 7.
I just don’t want to get married if I can’t figure this out beforehand.
I would think Chapter 7 where all of your debts are essentially wiped clear.
Chapter 13, is more expensive and you still have to pay back your creditors what you can afford to pay in a 3 to 5 year period.
Clearly, Chapter 7 has to be the more common one.
I know someone who states that he is home on a Chapter 7 from the Army and does not want to return. He says he is home on a Chapter 7 leave that he was given to come home and take care of personal business, now he doesnt want to return. We advised him to finish out his tour.

I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.
I’ve read a bit of things about chapter 7, but one thing isn’t clear. Under the new laws, I do qualify for it. I’m in Missouri. It says I can keep the car up to the value of 3k. My car is work 7k. I obviously cannot afford nor would I qualify to get a new car and I have no money (which is why the bankruptcy). I live alone and can’t go without a car. What will happen in this case? I have no other assets other than that.
I filed for Chapter 7 in 2007, I think, but it was just myself that filed. I was wondering when I would be able file again if I were to file individually again? Would I be able to file again if my wife also filed for Chapter 7?
