I’m ready to file for bankruptcy as I’m unemployed & in two months I’ll be out of money if I don’t get a job. I’ve borrowed about k in a reserve line of credit at my bank. My bank deducts about 0/month for this from my checking account. If I file for bankruptcy will my reserve line of credit be taken care of in the bankruptcy or do I have to pay it back, IF I’m able to file bankruptcy? Thanks.

its from a credit card debt, which was turned over to Arrow Financial Services (a debt collector), they in turn had Mann Bracken LLP (a national collection attorney network firm) contact me to settle the debt. I made arrangements to pay the debt, and was making monthly payments, directly taken from my checking account. After paying 00.00 over several months time, I received an "Agreed Judgment" from Mann Bracken in which Arrow Financial Services is the plaintiff and is seeking a judgment against me. I was in communication with Mann Bracken and was told to sign the Agreed Judgment and they would agree to not execute, abstract, or otherwise seek to enforce the agreed judgment during the term of our temporary agreement, as long as I (the defendant) complies with the payment terms. I agreed to pay 0.00 monthly directly from my checking account for 9 months, then the parties agree to review the matter again and attempt to negotiate a final settlement agreement.
This was in Sept of ‘09, in which I was dealing with my daughter and my grandson who were in crisis and our family was occupied with their issues, so I had every intention of signing the agreed judgment, but I got distracted and didn’t sign it, so at the end of Oct ‘09, a "Final Default Judgment" was issued against me. I of course called Mann Bracken and was told that after our agreed 9 month period of consistent monthly payments, they would have the judgment taken care of.
So I made my monthly payments every month, but in Dec ‘09 the money was never taken out of my account, so I called Mann Bracken, but the phone # was no longer in service. I tried several different #’s and all were disconnected, then I read on line that Mann Bracken had been investigated/sued and went into bankruptcy! So I then contacted Arrow Financial Services, spoke to a representative, explained the situation, and was told that a new debt collector attorney will be contacting me, but that has been 6 months now, and no one has contacted me.
What do I do? How do I settle the debt, I am more than willilng to settle, and what do I do about the Final Judgment? I’ve pulled my credit report from all 3 credit bureau agencies, and there is no judgment listed. I contested the debt with Arrow Financial, but after the investigation, the debt still stands in effect on all 3 credit bureaus.
Do I need to hire a lawyer?

I was over my head in payday loans. I went with a payday loan debt settlement place who has settled my debts, but one of our payday loans claims they have recieved their payment AFTER I closed my checking account where they ACH the payments. My Bank has made it clear that not one person has access to our savings account. How the heck are these people able to get their money when the account is closed, and there is no funds there anyways

I can’t open bank account because I filed bankruptcy. The banks will not accept because of that. I have been looking for alternatives and while googling I found a thing known as "online account". They say that to open online checking account, i make opening deposit with credit card. Whatever I pay with credit card is my online bank balance. And that then they will mail me checkbook to my house. For depositing check, they said I should scan and email them the check I want to deposit. And that they will use those scans to process the deposit. They say they will also send visa check card through mail, and it can be used at any ATM. Is this scam or real? The online check account site says initial deposit must be 500 dollars using credit card or western union. Is this real or scam?
Also that I should scan and email copy of my social security and driver license for opening of account

I would like to hear from people who filed and experience chapter 7 bankruptcy. I want to know to if it actually stays on your credit report for 10 years. Is it also possible to get an apartment and a checking account from credit unions or banks?

If I file for either kind of bankruptcy, would I still be able to keep my checking account? I have excellent credit with my bank and I wouldn’t want to jeopardize that.

Is it a good or bad? I worked with Creditors directly, but no use.. They never come down on the APR.. still 29.99%. I never missed on payments.. Only bad thing I did for 2 cards are I forgot to remove the automatic payment option from my old checking account in May and Jun.. With that mistake, they gone up on my APR’s and missing payments. They will review my account only after 12 months of ontime payments… ? So, I started working with various debt consolidation companies, they offered for 0 / 36 months which includes(0 for the company).. But in their terms, they cannot guarantee any.. Can we trust such of these companies? When I calculate, I am not even paying all to the credit cards…Not sure if its a good practice? What happens to the credit score and profile if continue with Debt Mgt companies? Please share if any had any past experience or any suggestions .. Thanks in advance

I am in a pickle, got served summons for unsecured credit debt, 6700.00, i am seeing an attorney wed to file chapter 7, no other choice! After i file, can a judge then request my bank statements? Reason asking, is i am receiving ssi (for real disability) and my spouse did not have his own checking account and i have been depositing his unemployment checks in mine for like 3 YEARS!

I have a bank account that I had left go when I was 18, which is 5 years ago. I’ve received a letter from RJM and they have taken over the account, and are willing to let me settle for 40% off. I would like to settle, due to not being able to get a checking account, although I have a savings account with a credit union. How long will it take for me to be able to get a checking account after I settle the debt with RJM? Thanks
If I recall, the balance that RJM has is the balance that I have/had with the bank.

I’m being sued. They’re about to Garnish my wages and take money from my checking account but how will I write checks for my current bills if they take money out from my checking than my checks will bounce. I have ,000 in debt they won’t even settle for half! Should I file?

I had my 341 meeting today and Im so glad that this is over with. My trustee was a local bankruptcy attorney that advertises WAY too much and my neighboorhood, and he kida looks like skeletor.
Anyways he was particullary found of me since I filed bankruptcy ProSe(By Myself) I had a few tiny problems and he wouldnt be specific on how to fix these problems and am hoping someone can help me and tell me what I have to do
#1 I had lost my wallet a few months ago it had my social security card and everything in it. I went to the SSA builing and filed a replacement card application. I had told the lady at the counter I have a meeting coming up where I need to show proof of my social. She told me " This reciept is all you need to show" I did and the trustee rejected it. I have to get him something with my social
#2 I was told before the 341 meeting that I needed to drop off paperwork to his office. I needed to drop off my bank statements, Paystubs, Income Tax Returns. (SEE MORE BELOW)
And a copy of my Petition. I had a copy of my petition saved on a CD and I had thought that the State Bankruptcy office would have given him a copy. But just to be safe I had printed out a copy of the original petition and handed to his office. He cocked an attitude on me again saying," How am I suppose to verify your signature" i had told all my signatures was on the original and this was a duplicate. I dont remeber him saying anything else needed on this end. But just to be safe
#3 On My list of assets he said I have to amend my return to say the details of my car which Im claiming an exemption on. I wrote "debtors Personal Vehicle" but he wqants I think the make year model etc. And also I claimed my checking account as an assett which only had a hundred and he says I need to put an exemption on that. He wants me to amend schedule C i think it was
He ended it by saying quote"DO NOT CALL MY OFFICE FOR ADVICE ON HOW TO FIX THIS" (SEE MORE)
I remember him saying I had till the 28th two weeks from now. Do I just have to get all my paperwork together and can I mail it to his office or something else? I’m really in the dark and wish I had hired an attorney. PLEASE no smart ass remarks about ohhh you should have gotten an attorney. If I could have afforded the fees I would have. Thanks

I have pretty good credit, my fiance has a credit card bill for about 00 that has been in collections for about a year. The amount on the card was just over 00, everything else is late fees & such.
What are the other risk factors involved? Am I going to start getting calls as his spouse wanting to settle the account? What are the other things that could happen because of this debt once we’re married?
I’m curious because the only things I can find online relates to debt & divorce, not marriage. Thanks in advance.
Also, I’ve been pre-approved for a home loan. Due to his credit, we applied in my name. I’ve already been quoted a 6.3% rate on the loan, but we are just now starting the process to work out a deal on a home we have found. Once we are married, will this rate change?
We’re in West Virginia.
We are also getting married in less than a week. He’s tried to settle a few times, but at this point the only option to settle they are giving is paying the entire debt in 2 payments. We aren’t in a situation where we can afford to pay off over 00 in 2 months or less.
Like I kinda mentioned, impossible to close on a house within the next week, so that option is out.
As far as keeping things seperate, the checking account is already shared. The address thing is impossible as for one he doesn’t want his family to be made aware of this, plus it’s impossible to use another address. When we moved in together, the company started sending letters & such to our new address before other mail was even sent to the new address.

I’m married but filing for Chapter 7 myself, not joint. My wife will be getting tuition reimbursement in a paycheck coming up. Can this income be deducted in the Means Test? Should we change her direct deposit so that it gets deposited into her personal checking account without my name on it? I don’t want this income to count against me as it will be used for her class tuition. Any help on this would be appreciated.

I had a checking account with chase a few years ago that ended up over drafting about 00.00. I never paid it i just let it close. If i include them on my bankruptcy will i be able to open another checking account after im discharged?

I forgot to mention that me and my fiance have a joint checking account. Is it important to remove her from the account if she’s filing chapter 7?

We have a Bank of America checking/saving account with some money in it (not a lot). We also have bank of america credit cards with thousands of dollars on them (we’ve used them to that point I mean). If we file for bankruptcy, can we keep the checking account we’ve had for 17 years?

We need to get my husbands credit score up 45 points before we can get our morgage loan. and we need to do it pretty fast (6-10 weeks) We dont have alot of money to pay things off but we’re planning on paying an old 0 verizon bill and then he had overdrawn a checking account by 0 but on the credit report its a charge-off and it has a zero balance. Its only like 6 months old. Can it still be paid off? and will they take it off his report? and will it improve his score by much? thanx

If I file for bankruptcy just for myself, all our (me and my wife) bank joint accounts will be affected?
Or she can keep her own accounts and half of the money in the joint account?
Can she keep the same joint checking account?

I have a checking account with Chase Bank and they withdrew all of my money out of my checking account. I called them and they said that I owe them money from a previous checking account that I had with another bank (First Bank of Chicago) that Chase purchased. They said I owe them 0 from the year 2005; and they will continue to withdraw money out of my account until it is paid in full. I asked them to prove this debt several times and they refused. Is this legal?
Can they withdraw money out of your savings account also?
