I just got my discharge notice from the courts. I’m kind of happy about, mostly not if you know what I mean. Problem is that I don’t know where to go from here. I’m in a bind and need some really good advice. Bit of a long story but please read.
I’m 33 years old, living with mom and dad since sept 2007 and have been working at a part-time minimum wage job since nov 2007. I filed chapter 7 in july 08 and just got my discharge notice saying I’m cleared. My truck was repo’d in august 08 and now I drive a 49cc scooter. I closed my checking and savings accounts in oct 07 and recently opened up new ones.
Obviously, not my finest hour here. I’m lost and depressed and pissed off in general, and don’t know what to do or where to go from here. My only real skills and experience job-wise are customer service and supervising, and I hate supervising. My one supervising job lasted 3-1/2 years and I quit because I hated it and management. First job that I’ve ever left on really bad terms.
Quiting is how I got into this mess unfortunately, I had a new vehicle that cost a lot but was affordable with the job. I moved in with my brother (a financial risk in itself) when he came back to town to help him. The next job in sales (third big mistake), didn’t cover me financially. I got a second job, but that still didn’t make ends meet. Finally I gave up at everyone’s insistence and quit both jobs, moved home to mom and dad, then searched for a new job (4th mistake, quitting before finding new job). After that, it was all downhill, the folks pushed me to file bankruptcy and even made the appointment for me, which I went to and then filed for (mistake? I’m not sure YET).
Here’s the toppings, I have mild spastic cerebral palsy which is screwing me up physically and the part-time job is pushing that along. I need a sit-down job like with the supervising job but without the supervising part of it. The economy is crap to boot and I’ve never been good at getting jobs to begin with before this economy mess (12% unemployment rate right now in my town). To say the least I feel like I’m in hell right now. I’m not seeing any real options to get my life back.
I thought about college but now my folks are definitely moving in 2 years (but no destination yet) and I’m stuck putting college on hold until we do move or at least know where we’re moving too so that I can contact a nearby college for potential credit transfers.
Anyhow, I just don’t know where to go from here. I seem to be questioning every choice I want to make to the point that I can’t make any decisions any more. I just cannot seem to get my head back on right after this major mess I got myself into.
So here’s the multimillion dollar question: What do I do now to get my life back on track financially?

I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.

I would have addressed this issue personally, except the offender does not allow email.
So I will address it in public. I am not happy that there is a "pseudo" Marxist revolutionary in Office who wants to "completely transform America", but personally I don’t care about race or where someone was born. What I care about is the content of their character and what they are trying to accomplish.
But calling POTUS "Buckwheat"?? I am old enough to have seen (on black&white TV, back in the day) the Our Gang TV show, so I know who Buckwheat was. And calling POTUS Buckwheat is just stupid. Why do people do that? Doing so completely invalidates whatever otherwise valid points they were trying to make.
If we "cons" are to stop the Zombie Apocalypse of (the 51% of Americans who don’t pay taxes) mongrel Hoards from overrunning what’s left of what we thought was America, we really need to get over all this race crap and focus on more important things like "money" and how the heck we are going to prevent America from going bankrupt. Seems to me that’s a lot more important than school prayer or the status of gays.
OK, I ranted, sorry. Just answer the headline, please and thanks.
@Just Thinking: Exactly. Well said!
@Poolplay… You said "irrational exuberance". Are you Alan Greenspan? No, probably not, because you make too much good sense.
@Warrior: All this week I’ve been thinking (Bin Laden) that we live in an Orwellian 1984 Matrix, in that we are lied to about everything. But now you say Buckwheat was really a girl. If so, the rabbit hole is deeper than even I thought. Thanks Hollywood!

This is quite a story !!
Back in July 2007 I was working for a small heating business. The owner at that time also had a large profitable business and I had been led to believe that he purposefully made it look like the smaller business hadnt made a profit – for tax reasons I believe.
Now this chap had become a friend after working for him for a few years and he asked i I would like to take the business on so that he could follow other avenues. He showed my figures and made be believe that the company was profitable (I was young and naive) so I took on a £25000 loan.
To cut a long story short he said to me that I did not need to pay him until the company made a profit and to keep the £25,000 as working capital. The trouble is the overheads were so high that it never made a profit. I tried moving premises to work from home and also made the office girl (his daughter) redundant but copped for paying her redundancy (3/4 yrs worth) even though I’d only ran the company for around 8 months. Also to give you an idea she was on £16,500 for part time hours (one of the many overheads !)
Any way after just over a year the business had swallowed my £25,000 and I’d spent my savings (circa £7,000) on wages for myself, so I shut it down and sold the assets (4 vehicles, computor, small amount of stock)
I’m still paying the original loan as I refused to go bankrupt (like an idiot !) and still have 5 years left.
I recieved communication last year from the bloke in question saying that the time to pay had arrived and that I owed him £20,000. I emailed him about the trouble I’d had, the verbal agreement about paying him when the company made a profit and the fact that we had no written contract. He never replied.
He has now contacted me again, apologising for the 14 month delay in coming back to me and stated that I owe him £18,000 unless I want to settle the debt privately, in which case it would be £16,000.
The thought of taking another huge loan scares the crap out of me ! I’m now 29 and only just getting myself straight. I have no mortgage and a car on HP.
Do you think I’d have a case if this went to court ? I’m going to see the Citizens advice bureau as soon as I can as I dont know where to turn or what to do next ?
It has crossed my mind that he’s waited this long so that some of the records are now no longer ‘available’ although I dont know the ins and outs. How long can he chase me for ? I fear that I could be taken for theft as I sold the assets (although the vehicles were transferred to me) ?
I guess I may just have to take the loan ?
Any advice appreciated as always

I’m 27 and in 5 yrs my credit went from 750 to 612:
I bought a condo in Arlington, TX when I was 22. I had no debt and was doing really well for myself. FFWD a few years and I ended up dating this guy – who used me and now I have maxed out ccards etc.
I have not had a delinquency ever although my payments are a few days late. Problem is I also had a tenant who skipped town on me so that tripled my issues. I have not been able to afford my HOA dues for a year or more. They charge me everytime i’m late and so far 0 in legal fees have been added to my bill,
I already did a debt consolodation just before my tenant skipped town so yay…i ended up using my credit cards again to survive so my debt doubled. I owe my HOA ,000. My mortgage (5.25%) and CC debt is probably about ,000. combined.
I’m depressed – i called out of work today because i can’t stop crying I don’t know who to call. Or who to talk too. I also had to take a pay cut so now I make about g’s a year and just paid off an apt lease I had to break – so I just started paying my HOA but its not like they care.
I was told a few weeks ago there was a fire at the condo – so my new tenant has to move out…which means AGAIN I have to pay my mortgage and my own rent…GREAT! I also have to replace and AC unit which will cost ,500.
So its one crap after the next. I wish selling the condo would help but it won’t – i’ve come too far to lose everything
.
Sorry about the length. But any advice is appreciated.
I get paid if I call out of work. I have the time to use.

Red China and the Saudis?
How is this going to help our economy one bit? How can this do anything but further bankrupt the Federal treasury so we can’t even pay to protect our own soil?
Wouldn’t even welfare be a better way to stimulate our economy? At least most of that would be spent on good made in this country – like food, etc.
My point is most people are going to use that money to buy cheap foreign crap, made by Communist dictators! Or to put gas in enormous cars and that money gets to terrorists one way or another.

I am thinking to ask Cap one a settlement . I tried a PFD and they wont take . The damage is already done to my credit . The debt was orignially 315 , but now the bal is 2. Should i settle or pay in full ? Which is best for me . I know paying in full looks better than settling but heck it is still a negative mark right ? What should i do ?
I tried that and they wont take it . I am dealing with Crap one .

I know Im a jerk i dont even know what to feel. how bad did i break this girls heart?
this girl is beautiful inside out, trusting, kind to everybody and alot of people take advantage of that including me. prior to meeting me, she was raped by 3 guys.
we are highschool sweethearts. im a player ignored her, treated her like crap, used her for sex and money while having other chicks on the side. she was always kind to me, by my side when i went bankrupt, bailed me out of jail and always, always there for me. one day I realized i loved her and asked her for marriage over and over, she turned me down every time.
Finally she broke up with me, cut contact for nearly 1 year. I missed her but then i fell in love with another woman K. However, 6 months ago i found her on facebook. she sent me a message to "let it go" but i insisted to talk, lost in the moment i confessed my undying love to her. Bam then i was on two boats, i kept her on the side as a "bootycall" but led her on with forever promises.
During this time, my businesses went into debt. this girl took out 00 student loans without asking for it back to help me. gave me her paycheck when my family was in trouble. so i kept leading her on with sweet words till one day she discovered about my cheating. then i disappeared with the other woman K without an explanation.
she was outrageous and sent me many mean messages, then yesterday I got this,
"I sent you many hurtful messages because I was in pain. I never blamed you for loving someone else, we don’t choose who we love. But I can never forgive you for leading me on for sex and money. I truly loved you even when you were broke, sick, selfish and manipulative. You were my first love, I loved you with pure, pure feelings for who you are. When you don’t feel the same, you should have just walked away. When people use me for a few days, a few months, I can just say fuk them. But you, a man who "loves" me, who knows the person I am, the kind of love I had for you, played me for years and years, is unforgivable. I will never forgive you in this life, and life after life. You have hurt and scarred me for life. If everything is a game for you, then you won".
she kept on sending those sentimental messages i had enough
i said " fuk off. i feel sorry for u im gonna change a number"

If we did not land a man on the moon would the country have gone bankrupt? If we put all our chips on energy technology that may never work it will destroy this country economically. How can we start to move away from oil when there is nothing to replace it?
Jesse – Velcro? You are a dope.
The money we spend on oil gets us oil – which fuels everything we do. We are not throwing the money in the toilet like we possibly could with this replace oil with solar power crap..
Go back to your Ivy League classroom – continue to be brainwashed by your lib professor..

Over the last couple of years I’ve put myself in debt by about ,000. My credit status is still good as of right now, but I’m only making minimum payments on 3 credit cards and paying off my monthly mortgage. I have ,000 in my 401 K, but would be facing an early withdrawal penalty as I am only 45 years old.
My question is… I know that my credit status will go to crap if I file bankruptcy, but then I would at least have my 401K to use without having to pay the credit cards in full. Where as if I take my 401K out before I file, then I will have to use them to pay off the credit cards and have no retirement money to look forward to.
What should I do? Please no foolish answers… I really need help on this. Thanks!

America is a country based on debt, your debt the national debt its all the same! You cant control your own silly spending but when politicians do it you feign surprise? You were not surprised when the new highway was paved or when supplies came in after the disaster. You were not surprised when the local bums collected their food stamps and WIC, or even when the SSI wagon came around for all of the illegitimate kids "payments". But now, after all these years, because we’re at the edge of financial collapse you act like the last guy with the pocketbook caused the problem.
Hilarious, mixed with a crap ton of irony I think.
Also, how can someone honestly look you in the eyes and with a straight face tell you health care needs to be passed and needs to be passed now? We pass it, we go bankrupt and guess what? No health care for anyone at all.
Anyone with a rational, logical mind would focus on the economy, get people working again. Then focus on such things such as health care.
If you disagree, please tell me why!
Your health insurance industry adds about .500 dollars to the price of every car made in USA over the cost of a car made in a country with socialized health insurance.
That’s the unions, maybe the 28 dollar an hour auto worker needs a pay cut. Ever think about that O_o

Someone told me that even if you file bankruptcy, all of your past bad credit history would still be listed on your credit report to be viewed by anyone who requests it along with the fact that you have filed bankruptcy. Is this true?
What you’re saying is not true SmartA$$…people can get loans pretty quickly even after filing bankruptcy and I know quite a few that have done so. For myself, that was not my intent anyway…I just thought that the fact that it says "bankruptcy filed" was damage enough without having to list all the crap you are no longer responsible for.
