should I contact the creditor or collection agency?

I have a credit card account that was turned over to a collection agency. The thing is, I continue to get statements from the original creditor requesting payment as well. I want to settle the debt, no doubt about that. Should I try and contact the original creditor first?

Can my new husband's assets be taken to settle my and my ex-husband's debt ?

My former husband and I had a joint credit card account ( we both signed ). When we divorced, the outstanding balance on the card was about 9,000 dollars. We did not specify in the divorce documents who was going to pay this debt off, since we had a verbal agreement ( I know, stupid me ). In between my divorce and myself getting married to my new husband, my ex filed for bankruptcy. Recently I have been getting calls and letters from collector who is threatening to seize assets of myself, my new husband, and anything our jointly owned. Can they actually take my husband’s own assets, like things he had before getting married? He understandably is worried. Oh, we are in FL.

How do I fix credit report when the credit card company is no longer in business?

I am in the process of trying to buy a home and recently reviewed my credit report. I noticed that one account was still reported as opened with a balance.

About 4 years ago, I had a credit card account with Conseco Greentree Financial services. The balance was sold off to another company when Conseco went bankrupt. I’ve since paid off the balance. I called the company that serviced the loan and they said there’s nothing they can do since they don’t appear anywhere on my credit report.

How cn I get this fixed? I can get Conseco to fix this since they are no longer in existence! HELP!!

Disability and Filing Bankruptcy- should I file or not?

Can the credit card companies get my disability money like they garnish wages?
Will my credit clear-up in 6 year if I don’t file bankruptcy?
It has been 15 months since I have charged anything on any credit card account.It has been 12 months since I have paid on any of my credit card debt. It is well over 10 times the reported national average. My life situation changed dramatically. My old job was great money and I would be back in it in a heart-beat , if I could. Income from disability doesn’t cover the unsecured debt I have.
I hope to heal and someday go back to work; however, what looks worse a bankruptcy or bad credit? I need advice that will help pull my life together in a way that I can return to the mainstream without some creditor popping up to sabotage my attempts to become productive again. (next time without credit cards- I have made it a year and I am determined to go longer even though the idiots keep sending cards(with hugh credit lines) in the mail.

Two years ago I took a debt settle with a credit card company. Can they still send me the settlement letter?

The credit card account was closed and the collection agency offered me a debt settlement for 1500 dollars less. I took the option and paid off the account. They sent me a letter saying account was satisfied. However I lost that letter. Now I need it for employment purpose because they want to make sure I don’t owe money. Will the credit card company still be able to fax me a letter saying account was settled?
It’s not showing that I owe money. I had to mention to my employer if I "made negotiation with creditor". I answered yes and in details provided that I paid off the debt settlement. Now my employer just need proof of that payment.

How to settle debt with Attorney Office?

My credit card account is in debt collection and be passed to a attorney to sue me. I have contacted the attorney – he started threatening me that he has my account only to sue me – and that any arrangement with go through the court. I had asked how to avoid that, then he suggests that I settle with him and then will not be sued and avoid judgment – He is willing to settle but I am not sure if this is trap. The reason is that in NH where the account is, if a creditor cashes a full payment check and explicitly retains his right to sue you by writing "under protest or without prejudice" with his endorsement, then he can come after you for the balance. But those exact words must be used. If he writes "without recourse," communicates with you separately, notifies you verbally or writes on the check that it is partial payment, it is not enough.
Please advise how I could make sure he is not going to trap me and come back for the unpaid part later.

What are the rules about filing bankruptcy with co-signers or being the secondary cardholder on a credit card account? Also, would it be better to file an auto loan under bankruptcy or to have it voluntary reposessed?

What's the best way to settle a debt?

If a deliquent credit card account was charged off by the original lender, can you still offer to pay the account in full even if a debt collector has aquired it and has served you with a summons to appear? I’d could probably get the money to pay it in full, or at least enough to make a good lump sum offer, but I’d rather settle it with the original lender if possible?
