So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

I have a few qustions regarding chapter 7 bankruptcy – not sure if anyone would know the answers to any of them. I haven’t filed yet but it is a consideration.
1. I bought a new car last year – my father is the primary on the loan and i am the cosigner – how does this affect his credit? I am current on payments and will continue to be current.
2. My ex husband and I bought a house together when we were married. I am the primary on mortgage and he is second. In the divorce he got the house and modified the mortgage based on his income. If I file will that mess up anything with him?
3. I am an authorized user on my fathers credit card although I haven’t used it in years – will my filing affect this on his credit report?
4. I am in desperate need of a new bed – if I buy one before I file will this have any affect on the filing (not buying with credit – paying outright).
THanks for your help. I hate the idea of filing bankruptcy but Im now being sued because a creditor won’t work with me for a manageable payment plan (they want more than I make in a month). If anyone has any other alternatives I would appreciate that too.

I’m about to file bankruptcy, but I read that you need creditor statements to do so. All the accounts are long since charged off, and I have no creditor statements. Can I still file?
I already have a lawsuit and am being harassed. I am filing bankruptcy to get rid of the lawsuit, and also ensure no further lawsuits happen, since other creditors have another two years to sue me. I also just like knowing that it’s cleaned up and dealt with, not just hanging there like they would otherwise be.

Just finished school, and right now i cant pay all my bills, my credit sucks, and not sure what i should do. Is it better to do debt settlement, or bankruptcy, or just like the bills continue to go unpaid until i get a real job and just have the creditor calling me every day?

I have an old creditor trying to come after me for a debt on a car that I paid that was settled in bankruptcy. The reason I found out was that I was to to get my home refinanced and their was a lein against my home. Can I sue them for trying to collect twice. Can I report them to some agencies like better buisness bureau?

What happened to the remaining amt and how will this reflect on my credit report? Also. another creditor that I have, sold the acct to a collection agency and the amt that they are trying to collect is for a much higher amt, almost double. Can this happen? I will never be able to pay this off.

I have a credit card account that was turned over to a collection agency. The thing is, I continue to get statements from the original creditor requesting payment as well. I want to settle the debt, no doubt about that. Should I try and contact the original creditor first?

I recently recieved a notice of Ch. 7 bankruptcy case and meeting of creditors from a bankruptcy court. The property manangement company and owner of the house I rent is filing and I may be a creditor of the debtor. Do I continue to pay rent if they have filed bankruptcy? Will I get my sustantial deposit back? What do I need to do?

I settled debt in 2009 dec, but didnt receive 1099-C… what should i do?
can someone help me? should I send letter to the credit card company? or should I check with the irs? or will I just get it as 2009 income and file next year?
the debt is not showing on my report anymore. i didnt see any settlement info on the report either.
i did settle with the original creditor.

To make a long story short, I feel this amount is fair since I did not agree with the original amount. Anyway, I want to go ahead and settle. However, I want to protect myself. My goal is to get this wiped off my record. I want to pay with a one time debit card that only has a 00 balance. This is because I don’t want a card # falling into the wrong hands and this would make a more timely paymet. What should I get from the creditor to make sure they remove this from my credit record?

I bought my home in 2006 and put down $ 100k, yes its 20% down for a $ 500k house. I have put in another $ 50k in upgrades and remodel. Fast forward to 2009, laid off, no income I resort to using my credit card to pay my mortgage while my house was being listed by my realtor. 6 months went by, then a year, the house remained unsold. I’m up to my limit in credit card debt, thinking to sell the house for $ 350k, which will give me approx. $ 50k to pay my credit cards. Year and a half later, house is in foreclosure; credit card at max limit. No job, no car (sold it to pay credit card debt), ..and now living like a deadbeat.
Credit card companies still call and say "hello". Same story told to them over and over, no income, no job, no money etc. They "understand". Then they sell the debt to collection agency, same thing again. I told them my story..and they don’t care. "When are you gona pay?" I say with what? I can sell my t-shirt and underwear, but that might be worth 25 cents. What good will it do? So now, they are suing me in court. Went there and told the same story…judgment for the plaintiff. Okay, now they want to garnish my wage…but I don’t got no job. They want to freeze my bank acct…I have none. They want to..probably kick my ass..that they can definitely do..but that would hurt them, because if I get hurt and sue, they probably owe me money.
So here is my dilema, should I file Bankruptcy ..as there are other creditor waiting in line to sue me. Or should I go to court and and plea guilty but have no way to pay?
Yeah, I know..I’m a deadbeat, but I don’t blame my misfortune on no one except myself. Lost my life savings and people are laughing at me. What a cruel world this is. To file BK or not to file BK? If I do, I will have a fresh start says a friend. If I don’t, my friend says that the creditors will put my balance on my credit report, and renew it every 7 years…meaning that I can call the credit reporting agency to remove it, but they have a right and probably will repost my balance…as nothing had been collected. Is this true? I thought a negative item must be removed after 7 years, but it could be put back in and stay for another 7 years?? Please help. Thanks in advance.

My wife is filing for bankruptcy and one of our creditor’s is Kay Jewelers. We bought our wedding rings through them back in 2008. We received a letter in the mail today saying that they may have a non-dischargeability cause of action against us if we don’t turn our rings over, which we really don’t want to have to do. I know that it seems like the sensible thing to do and we can’t really afford to pay off the debt. Is there any alternative to giving the rings back or paying the debt?
Thank you all for answering so quickly. First, I am not on any of her loans/ debts so it wasn’t really advisable that I file as well. The only thing I have in my name is my student loans and our car (which the person who helped us file our paperwork said we wouldn’t need to worry about since the title is in my name). With that said, while we were filling out our paperwork, there is a section that you get to put items that you would like to have exempt from the bankruptcy i.e. jewelry, clothes, electonics… and you’re allowed up to a certain value for each item. Our rings fell way below the limit so we were told that we could keep them. Lastly, and unfortunately, it was a secured loan so they are saying that the rings are collateral and they have the right to either take them back or have us pay it back.

Here’s an interesting situation. I was out of the country and thought I paid my balance in full, but money sat in my bank account for a few months not moving. I’ve never had a late fee in my life, but I am young and don’t really have much to have credit built on yet.
Anyway, I was out of the country like I said, and the account went 5 months past due with just very small payments automatically paid. However, they weren’t enough, and it now shows up as 4 months delinquent. The late fees made it where I don’t have quite the money to pay in full, but I can get help from relatives to pay in full now. However, my account was sent to collects, but it was not charged off. The collections company said they were only contracted to help the creditor. It was not charged off.
They offered a settlement to me that is about ,000 less than the full amount, and I really need money right now. Should I take the settlement or pay in full? I am worried about my credit being hurt more, but I also spent too much money on someone I thought I was going to marry. I certainly won’t make that mistake again because now I have trouble paying for gas and food.

I lost my job almost 2 years ago and even before I lost my job I was struggling to make the mini um monthly payment. After losing my job I can’t even make the minimum payment and 3 creditor had sue me. Is it too late to file for bankruptcy now?

If yes, do you recommend for others who are in similar debt situation? And if you have settled does this mean collection agencies won’t contact you for collection money again in the future? If they do what are some of the ways to hit back at them and not pay if you have settled the account with the original agency.
For example if an attorney for a collection agency or creditor contacts you after you have settled the debt, will they be able to take you court depite settling?
I want to get an idea because I want to settle my debt but I’m scared to do so since I heard that collection agencies will pass the right of the money owed to other agencies for collection after years have passed. If this happens what should I do? How should I go about dealing with this? I’m scared and confused and need help? Thanks!

Hi, I’m 24 years old and I graduated college in 2008. I have student loans totaling approximately ,000. On top of that, I made some bad judgments when it comes to credit and I have the following bills that are in the hands of debt collectors:
- 0 BofA credit card debt from 2005.
- 0 T-Mobile debt from early 2009 (I am disputing this amount – I received an early termination fee after I cancelled my phone contract 2 weeks early because I had absolutely no service in the county I was visiting for 2 months).
I am trying to build my credit score (it is 520 currently) and begin getting out of debt. I earn ,000 in one of the most expensive cities in the country. I have no savings and I currently own no credit cards at all. I’m not really sure how I should start building a healthy credit future.
Should I pay my BofA credit card debt in full? I was told that begining to make payments opens the debt again and it will be on my credit report for an additional 7 years as opposed to being wiped clean by 2012.
What are my best options for beginning to pay off my students loans (they are all government loans)? I am currently paying around /month, should I pay more and forget about my other debts?
What are my best options for beginning to save? Should I just open a traditional savings account or should I look into other options?
How I can I get negative things taken off my credit report? Can I get negative things taken off by the creditor once I settle the debt in full?

Creditor is faxing me a letter stating our settled debt agreement on letter head signed! is this oky?
Should i make the payment over the phone? they are not and will not willing to accept money orders!

I’ve been checking out different alternives on how to reduce my credit card debt. This company saids" with my ,000 accured that they could make a settlement with each creditor and reduce the total amount by 40%". Their fee is 15% of what the settlement is; totalling around ,000. I will have a reduced payment of around 0 a month which I put in a savings account. Of course they will start taking out their fees at some point. This company is affiliated with Belvedere mortgage. If they can settle with creditors; why can’t I.

When a creditor charges off a debt, and they tell you that they have no more dealings with it. Told me that they could not pull it out of collections and settle with me.
Can this debt go back to the creditor and they will sue?

if it’s asigned does that mean the offer to settle should go to the original creditor (ie Amex)? by the way debt is from business necessities, and business has been gotten out of–debt was unavoidable and not based on spending habits. trying to avoid bankruptcy and pay off. do they sometimes settle for payments or do they only want lump sum?
