I am very nervous about what can happen to my home. I am waiting for a closing date as my parents gave me money to purchase a modest home. I am married and my husband and I need to file bankruptcy. We lost our home to forclosure a few years ago, lost our vehicles and had some credit cards. My parents want to see me enjoy part of my my inheritance now and I also have health issues that allow me to only work part time. I know I need to contact an attourney but I dont have the money for that yet. We are still renting but will be closing within the next 2 weeks. What should we do when we file? Again, the home will be only in my name which I am not sure if this will help or not. My husband has some personal credit issues and I as well. But, most of our issues are together. We believe we should file a chapter 13. He is a school teacher and I am a part time self employed music teacher. He also owes a lot of money on student loans from getting his Bachelors degree. I am 51 years old, am very grateful to my parents yet very nervous about losing my home. Thank you !
My parents do not want the home in their name as they do not want to pay Insurance and taxes among other reasons. I have heard of many people owning homes and filing chapter 13. If this is the answer do you think we need to do it soon so the courts do see that we are trying to resolve the issue after recieving this gift? They will also see that our hardship and loss was due to my husband being in the mortgage industry and my health issues.

We had put down a chunk of money for escrow. We were to close a few weeks ago until Fannie Mae said that they need go over the homes forclosure papers. Something was not done exact. I and Fannie Mae signed an extension. Can I back out of the deal and do the bankruptcy then look again for a home again? Or, will I lose the escrow money which my dad would kill me for that. That is my concern now?
Omg… yes they paid cash…. And, yes it is in my name only.

I am talking to someone that says they can help me be out of debt in three years they want me to quit making my payments and put that money in escrow and they will negotiate on my behalf or would it be better to just file bankruptcy?

I was a sole proprietor with commissioned agents under my license. The gross income was nearly a million but I only made 0 an escrow myself. I did not file. All my records are screwed up and I filed bankruptcy in the year 2001. In the year 2005 I became disabled. What should I do?

I hate my mortgage lender (Litton) they added an escrow to my monthly payments due to back taxes, but here’s the deal…my city tax never sent me a property tax bill and when I went to inquire my mortgage company had paid it off. How the city inform my mortgage company and not me? Anyway, now my mortgage company does not want to remove the escrow even if I pay the back taxes. This is "Cow Dung" believe me I’d like to say something else. What are my options? I’m frankly sick of this company and I’m sick of the house anyway. I have it for sale, but should I get a lawyer or file bankruptcy on the mortgage. That’s something I really don’t want to do. I already have one bankruptcy in the past, but I’m really sick of Litton and their high handed tactics. I pray to God they go bankrupt and get absorbed by another Company, they are really unreasonable. I have faithfully paid my mortgage, but I should not be screwed into paying more for an escrow I don’t need and I will be darned if I’m going to stay in a house I no longer want due to real estate decline in this bad economy.
I love how people like to add their 2 cents beyond the question being asked. Was I irresponsible in my youth? Yes and apparently half of america is financially irresponsible. I learned my lesson and I pay everything with cash. Unfortunately my taxes were a little behind but not delinquent, but I always pay my property taxes. However, my Mortgage may intervene. Whatever, happened recently I was left out of the loop and the city contacted my mortgage company instead of me, even though I was paying on my taxes. And furthermore I do not like my house or the environment so why should I remain in it? Things change. At one time I would have probably stayed or stayed longer. The house has been on the market for about a year and a half. I want nothing else to do with it and I don’t want to really rent it either. Though I’d choose that over foreclosure or bankruptcy.
Thanks lake lover. Although I don’t think its fair for the tax collector not to forward a tax notice. I have always got one in the past. This year I didn’t get a tax notice and when I went to inquire and pay on my bill, it seems like I got screwed.

A house I am buying in Las Vegas, Nevada is still in escrow and I am just waiting for order from the court for release property from the bankrupty court which would happen when all the payments to the trustee are fully paid. Unfortunately, the case was closed for non compliance of payment. Since the Bankruptcy case is now closed, and the debtor( seller of the property I am buying) is no longer protected by Chapter 13 from all her debts which went back to ,000. What happens to the house I am buying now that the bankruptcy case is closed? Can the debtors run after the property which is now in escrow?

I have done a lot of research on debt settlement vs trying to settle debts on my own. Understanding my own strengths and weaknesses, I think I would benefit using a professional company. Now, I just have to figure out which one to go with. I’m interested in Halo, as you get to keep your money in your own savings account, rather than an escrow, and you pay the creditor directly when a settlement is reached. I’d just like to feel better assured that they won’t rip me off! Does anyone have experience with them?

My wife has a Vehicle that she wrecked over 6 years ago, and she didn’t have insurance (before we met). Now we are in escrow for a new home. The underwriter wants us to settle this debt. It’s a debt passed the statute of limitations in my state, and has been charged off years ago from the original creditor, but active with a junk debt buyer. I need to get this settled ASAP because we are in danger of loosing the house we want. Should I use a lawyer to negotiate this debt? Or should I go it alone?

I filed Chapter 7 and before we had the chance to remove the recorded Judgements, the court discharged the case and closed it. I wonder how to remove the judgements without re-opening the case. We know that the judgements were wiped out in the bankruptcy, but not sure how the recording can be voided and removed?
So if I attempt to purchase real estate in a couple of years, the escrow and title companies wouldn’t bother asking me to deal with those judgements???
