So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

I lost my job just under two years ago & have been struggling to keep up with bills ever since. It’s actually somewhat amazing that I’ve lasted this long, but it’s coming to a point where there’s no way I’m going to be able to keep my creditors from filing for foreclosure and repossessing the vehicle.

I’m considering bankruptcy, it would probably be better for me to go ahead & do it now while I still have enough money to pay for the lawyer and filing fees, but I’m still worried that this isn’t the best way to go. I realize there are different types of bankruptcy, and that I may be able to keep the house & car if I have enough steady income & can work out some kind of deal with the creditors (I’m really vague about how this works, but that’s my basic understanding).

Is bankruptcy really the better alternative? Should I hold out until foreclosure begins to file for bankruptcy? What’s the best way to handle a situation like this?

First off, I’m Army. me and my wife of (sadly) 3 months have it it rough. She’s made things too difficult. but that is besides the point.

My wife is possibly threatening abortion. Assuming she is gonna go through with it, I want to know what I can do to stop it. I know the states favor heavily with women in abortion matters. Which, I think is wrong, and there is nothing you can say that will change that opinion. As the father (and still married) I should have just as much say in this decison. Its not even like we met and she got knocked up. Don’t feed me this "its her body", or "she’s the one that’s got to carry it"…. That’s the dumbest excuse. I will go bankrupt fighting this, but i would like to know some avenues of apporach to fight this, and possibly the best research material so i can study up on what I should and should not do.

also, if you have any recommendations on how to fight for primary custody as a father, that would be nice too, but the above is my main concern. I won’t even go after her for child support. All she needs to do is give the baby up to me. That’s all i want.

I was involved in an accident recently (a fender bender, really–no alcohol involved or anything), and the other party is trying to sue me for 0k (my lawyer informed me that they’ll probably seek about M with pain and suffering, etc.). I’m only covered for 0k, so the rest would be on me, which by no means am I able to pay.
My question is, would it be imprudent to file for bankruptcy now? I have other debts, and the prospect of getting rid of those as well is attractive, but I’d hate to file, then if this judgment comes up ruled against me, I still would have no way to pay it. So would I have to wait until a decision is reached before I were to file for Chapter 7?

As you can see, I’ve put myself in the worst of messes. I am either going to federal prison or at least several years probation for criminal charges (not related to anything financial). I have 20,000 in credit card debit, and my lawyer needs another 10,000 that has not been paid for yet. I still have a good job for the time being and I rent an apartment. Would I be able to put the next 10k for the lawyer on a credit card and then file bankruptcy? I have a few thousand saved up, however the account its in is in my name as well as a family member. Due to both our names being on that account, could that money be taken?

Im filing chaper 13, and i have to show 3 years of tax returns. 2 of them are back taxes that i am just now going to be dealing with and then my 2007 return.

my lawyer says he needs copies of all 3 of the returns which i have. does he notify the irs that i am filing bankruptcy and turn in my tax copies?

it seems redundent if im going to be mailing them in and paying them myself.

plus i dont want to go to kinkos and copy 10 million pages of tax stuff…..

In November, I made the decision to file bankruptcy and it was filed a week ago today. My problem is I recently purchased a car (4/4/11) and I have a car loan, but I want to surrender the car under the bankruptcy. The problem is the car is not in good shape as they told us it was (they said they replaced the transmission, but the transmission is stalling and jerking), and they are not willing to switch the car/trade it. I also called the bank and they are more concerned with getting their money than actually helping me (go figure). Will this look bad on my part or is it fine to do? I am wondering because I have to make another payment tomorrow and I would rather not if I can surrender the vehicle, and I don’t want to pay if it will jeopardize my bankruptcy. I emailed and called my lawyer, but he left early for the day :0) Please help!!!!

I am filing because I was sued twice and a lawyer told me to do nothing, so now I have a judgment. I am the only income in my home, and trying to get a reliable vehicle, I opted for a car loan thinking that was going to ensure I had a good vehicle.

I also make sure I work overtime so i can afford the car to be able to work. With a family I am trying to do what I can, but I can’t do that and pay back ,000 that was run up in my teens. I owe around ,000 in 3 student loans. I was paying on them each month until I filed for bankruptcy in 2009. My Lawyer said since they were private loans they would go in the bankruptcy. Here in California you have 5 days to file a response to an eviction notice. If I plan on fiing for bankruptcy should I still file a response? will it give me more time? I had filed a lawsuit against my mortgage company back in January because of FRAUD. They legally don’t own my home!! but because I couldn’t pay a lawyer, the case will probably be dismissed. We are going to file for Chapter 7 this December. I was curious how many months they usually want to see. Most places I read it is 3 months. I am hoping it is 3 months because we were not expecting to file until now and our statements might look bad any further that 6 months back.
The reason we have to wait till December is that my husband had a previous bankruptcy before I met him. The lawyer told us to wait. We are not paying our credit cards because we can’t afford it.

My wife went to law school, and took out a ton of debt. some public (perhaps K), some private (about K — which is the reason for the suit). Well, she became unemployed in March 2009. Stupid move. We wanted to relocate to a better economy. Well, we came back to former city in late 2009 and have been shacking up w/ her folks ever since. We’ve had our first child. I am in the middle of trying to start a business and literally just paying for the business right now. She’s hoping to get back to full time work here pretty quickly. She’s got a couple of possibilities on the table. Well, we’re in TN and her law school was in Calif. A law office in Nashville is operating as a collection agent for this private debt. The original loan company wouldn’t hardly work with my wife through the unemployment, and for the past two years, the only employment she’s had is seasonal tax assistance work. Less than K per year. Our annual income is ridiculously low.

This lawyer has filed suit against my wife and now we don’t know what the hell to do… (IF SOME OF YOU THINK THAT JUST BECAUSE MY WIFE IS A LAWYER SHE SHOULD BE ABLE TO HANDLE THIS… , PLEASE TAKE NOTE, MY WIFE HAS NO EXPERIENCE IN BANKRUPTCY AND DEBT COLLECTION SUITS… SO IT’S NO DIFFERENT THAN A FAMILY PRACTICE PHYSICIAN PERFORMING A BRAIN SURGERY OR HEART TRANSPLANT. THERE’S NO CONNECTION THERE.).

She’s being sued, and it’s not like we’re sitting on any cash. What little cash she has (less than K, she’s trying to get back in good standing with the bar association since she’s been absent for a couple years… and now… this bullcrap hits. I didn’t make the economy go south, and neither did any of you folks… so be kind in your response. I don’t need a lesson on ethics… the world literally fell out from beneath a lot of people and if you’re one of the lucky folks not to get situationally screwed, consider yourself fortunate and try not to be judgmental. We didn’t plan for this to happen. And we feel awful about it.

My question I guess is, for any of you lawyers that know bankruptcy… I’m well aware that student debt cannot be discharged by standard bankruptcy proceedings, although there is possible statutory law that was introduced in April 2010 (don’t know if it passed) which can, in certain circumstances – as I understand it – make it easier to discharge private student debt, but I’m uncertain how to go about finding out what part of that legislation might apply to my wife.

Anyway, what is the likely outcome of this? Would a collection attorney really put up money to sue us for essentially nothing? You know the old adage "You can’t squeeze blood out of a turnip." ?? Or do they just want to solicit personal information from us so that they can verify that my wife hasn’t actually been intentionally stiffing anyone… she’s just been legitimately underemployed and unemployed?

I got a letter in the mail from the healht care provider saying that they’re going to get a judgement from me and garnish my wages. I owe them 5,000 dollars for past medical bills. Also, I owe about 2,000 past debt for various things (this is not including student loans). A lawyer I talked to said that I qualify for chapter 7 bankruptcy. I don’t own a home and I have a car that I’m making payments on. (they said that Icould keep my car if I keep making payments on time). In Virginia, what is good advice filing Ch. 7 bankruptcy? We will need to do a quick file to try to beat a foreclosure coming up soon. What are the steps? We consulted with a lawyer but read his disclosures and found that we don’t have to be represented but wondering if that is a good idea or not. We have counted up all assets and written down every liability we can think of, and gathered 3 months worth of bank statements for both myself and my husband (both of us need to file). We have titles to vehicles and gotten Kelly (NADA) blue book values on them. I guess we need to get credit reports?? not sure. Also have gathered 2008 and 2009 IRS tax returns. We have already taken the first debt counseling session and received certification for each of us. We have the deed to our home. Are there any more docs to be gathered and what would be the papers to file with which court? Please be as detailed in your answer that you can. This is greatly appreciated.
I have gone onto the official federal website to get forms, fee info, and general instructions about the steps to take to file a petition with the court. so far, this has been the most helpful. But I did consult with an attorney one time to decide which chapter would be recommended and to answer some specific questions for our particular situation.

Where I live, it’s so expensive that many people work two jobs. Myself included. My co-worker is seriously considering filing bankruptcy due to serious credit card debt, school loans and other difficulties. But isn’t it worse to have bankruptcy on your record for 7 yrs? Especially if you still have to pay off some items? Also, isn’t it expensive to hire a lawyer to process the claim? It may be best for her to get a 2nd job like so many of us. Am I completely wrong?

I am thinking of filing for chapter 13 bankruptcy. I don’t qualify for chapter 7. There is a few things I don’t understand, if I owe a total of 30,000 with creditors, some of which had interest and late fees accumulate. im 22 years old and have made a few mistakes in the past with my credit. ive never really had any guidance in financial decision making. seems like as soon as i turned 18 i was able to have what ever i wanted. i intended to pay everything i got but didnt take in to consideration that the jobs i was working wouldnt be there for very long. so ive decided to get myself back on the right track and file for chapter 7 bankrupcy and wipe my credit clean. i know it will take a while to rebuild it but at least im still young. i now have the intelligence to determine whether or not i can afford something in the long run. so i need to know how i would go about finding out every single thing that i owe so i can get rid of it all at once and not have something lingering over me after ive filed. i would also like to know how much it will cost me for a lawyer to file bankruptcy? any info would be greatly appreciated
