I’ve just got a summon yesterday by one of my credit card I have and I was wondering if I can still file Chapter 7? I do have other credit cards and medical bills that need to by paid as well that I haven’t been paying due to not having enough income to make the payment. Any opinions would be greatly appreciated!!

We are in the process of closing on our first house and don’t want to mess this up. My husband is being forced to file bankruptcy soon on ONLY medical bills. I don’t know if the bankruptcy should be filed just after closing to prevent a lawsuit from one of the creditors or if we should just go to court and settle the bankruptcy after a judgment has been passed. If we filed chapter 13 bankruptcy, what kind of percentage of the total bills do you usually have to pay on medical bills; or does it depend on your income and expenses? Help please! Also, will our credit cards (which we do NOT have a problem with) be taken away from us?

like its because i defaulted on a car loan that i can only make minimum payments for so they were suggesting i should file bankruptcy. Will i be able to lease another apartment? I have good rental history its just the car loan and some medical bills, will that change anything?

I am thinking of filing for Chapter 13 bankruptcy. I already have one judgment against me and I am worried another collection agency will be taking further action. How do they calculate the amount that the Trustee will accept for repayment? I am already paying close to 00 for my unsecured debtors. I am concerned because I am going to have some large medical bills in the near future. Any help would be appreciated. Thanks.

I sent letters to the debt collection agencies that I owe money for medical bills (2600 across 6 accounts) to settle the debts at 25% and to remove entirely from my record. Two have responded asking for full payment, one will remove entirely, other said it would report as "paid in full". What should I do? Should I be renegotiating with them for less than the full amounts? The remove in full is tempting as is, but I feel the "paid in full" definitely has to be renegotiated. Thoughts?

After trying to find ways to be able to take care of our responsibilities we have come to the last resort and that is to file bankruptcy. We don’t own any homes or any real property. what I am curious about is which is better chapter 7 or chapter 13. We want to be able to start saving a soon as it done and when feesible start rebuilding credit. Our credit card debt is only 00 which is a lot, but it could be worse. We just had two bad years with this one being the worse. I am looking for advice on the best way to go between the two. Chapter 7 or Chapter 13 and why.
We are not happy about doing this as we have tried everything. We don’t have anything of value and we have tried to pawn stuff but couldn’t get .00 for most. We live very modestly. So please do not answer this question if you are going to be negative.

As I stated it has been a bad 2 years, actually almost 3 years. I got real sick and had to leave my job and am now on disability. My husband took on a second job a year ago. He pays child support. Between the two of us we have 5 kids between the ages of 9-16. We have two vehicles, which one is in the shop. We also are surrendering this vehicle.
We have an attorney and he is recommending chapter 13. I (we) have a lot of medical bills. After I had to leave my job I couldn’t afford the cobra payments for continued health insurance. To maintain health insurance with my husbands employment (state worker) would have cost more than the cobra payments.
My ex- husband filed bankruptcy and I did not know that anything he had when we were together, came back to me.
I never thought I would get sick and have to quit work. I was not prepared.

I filed Chapter 13 in 2004 while I was in the military. Now I’m out and am about 0,000 in debt for medical bills. Will I be able to file for a Chapter 7 since I’ve already filed once before?
The lawyers that helped me file the first time never said anything about a Chapter 7. They told me that Chapter 13 was the only option available for filing bankruptcy.

Seeing as to how Obamacare is heavily debated and let’s be honest the GOP haven’t put a viable alternative so what are your thoughts on some reform
What should be the main goal of health reform in the US, should it Decrease the cost of health care, Improve the quality of health care, Improve the access to health care or make most Americans receive at least basic free public care. What would it be like for the US if an Australian system like the Medicare service is implemented where all taxpayers pay a 1.5% income tax levy (with exceptions for low-income earners), an additional levy of 1% is imposed on high-income earners without private health insurance. There is also a private health system where people pay for health insurance to go to a private hospital if they wish for quicker service. Bankruptcies from lack of funds to pay for medical bills is the largest reason for personal bankruptcies in the US accounting for over 60 % of all bankruptcies, while in Australia it is almost negligible.

Our house fell into forclosure and our medical bills were outrageous even with insurence. We had file bankruptcy. Our home was up for sale for over a year. Our autistic child cost alot for special schools and what not. I find it a bad move to take our stimulus package when it comes as the government is sending it to help people. Then the bankruptcy court takes it away and puts it where? We were going to use it to pay for our childs dental work. I just think its unfair.

My wife and I both lost our jobs a month ago and now we’ve decided to head to college together.
–> bad credit car loan about to be repoed, 2 credit cards (i already been sold to collections), apartment bill about to be sent to collections, and some medical bills
Can we get enough aid to pay for college and then for my dental school IF we decided to file bankruptcy?
Also, how much does bankruptcy cost?
Will bankruptcy cover all of the things I’ve listed before?

Thanks to idenity theift i pulled my credit, i found alot more than i expected but as it turns out they do all pan out. I am thinking about filing chapter 7 bankruptcy but since my wife’s credit is good we dont want it to show on her file, heres the thing. We are young we have nothing in our name our house is owned by her parents our cars are paid off we have no loans or anything of that nature with both of our names on it I would be filing by myself with out her. All my bad credit is old starting when i was 18 and I want to get a fresh start and with all the old medical bills and things bankruptcy seems the best for our family. I’ve read alot on these sites saying your credit is there credit and when you are married there debt becomes yours, this isnt true my wife’s credit score is over 700 while mine is in the 500’s this is why i am asking i dont want it showing up on her file…. does anyone get what im trying to say???

I have a lot of cc debt and medical bills so I started a 2nd job. But the anxiety is so overwhelming that I cry a lot and feel depressed 24/7. I just want 1 job but neither is truly enough hours or pay alone. I’m at a loss over what to do. Advice?

I have so much debt, from when i was 18 and stupid. And i have current debt. My husband and I want to file bankruptcy bc he has 30, 000 dollars in medical bills. plus i have people suing me for old bills all the time. Can i file bankruptcy on things that currently i have a court date set on and will that cancel out court? If you need any more info let me know.
i appreciate the answers i have recieved, but i am filing bankruptcy, if my husband and I have over 60,000 dollars in debt between the 2 of us, it will be impossible to pay it back.

I have been in Chapter 13 Bankruptcy for 2 years and it will be discharged in 1 more year. Is it possible to get a ,000 – ,000 home loan? If so how and with which lenders?
Actually the court can approve that you can get a loan. The only reason it was filed is bc we had an enormous amount of medical bills. That was it.

I know all the experts say bankruptcy is not an option, but we can’t do this anymore! We have about 20 collection accounts on our credit. One repo, the rest are medical bills, payday advances, student loans, back taxes, etc. We’re tired of all of the calls and we can’t pay rent and maintain our current expenses like daycare, food, transportation, etc and pay off these bills. Should we file? Our credit scores are between 510 and 520 how much worse can it get?

About 3 years ago my life turned upside down, I had clinical depresion, lost my job and quit school. I did not care about the world, about six months ago I had major surgery and now I owe about ,000 in medical bills, I have a ,000 credit card judgment on my credit. I need a fresh start. I had to file bankruptcy a couple years earlier due to medical bills that were related to this incident. Now I am worried that my settlement will be seized if I report it as earned income by the court. Is there any legal way for me to keep this money with or without having to report it as income? Are there any consequences for not reporting it as earned income? Is it true that the income isn’t really earned unless you cash it yourself in your name only? What should I do?

I want to file Chapter 7 to totally get rid of my debt. The only problem is my spouse doesn’t agree with this, so I would have to file by myself. I have 5 credit cards in my maiden name and 1 credit card in my married name. My medical bills are in my married name. As far as my assets, my name is on the house but not on the mortgage. My name is also on the two cars that we own.
Can I file Chapter 7 bankruptcy without the cars and the house being affected? If I can’t file by myself then what else can I do?

I had some medical mishaps about a year ago. One surgery that cost over 7000 and a bunch of other medical bills. I also had a car that I cosigned with my dad for. He ended up losing the car and now they are holding me resonsible for 8000 on it. I normally make around 000 a year. I am actually on unemployment right now. I am in school and in a few years hope to start a good career. I am really scared bc I know that I can not afford to pay these bills. I know that they can later garnish my checks or sue me for the remaining money. Is it possible for me to file a chapter 7 bankruptcy and also would it be the better decision right now? Also, about how much would it cost me if i did do so. Thank you for taking the time to read this. God Bless.

I see here a lot of criticism of Obama’s approach, but no alternatives. We have 40 million Americans with no access to health care. We have one of the highest rates of infant mortality outside of the third world. Medical bills are the number one reason for bankruptcies. What do you think we should do?

Since Republicans are so against universal health care, what would you propose to fix our health care system. Please do not argue that our health care system is adequate because it is obvious that the costs are too high and too many people are uninsured. Furthermore, do not argue that only people who are "bums" don’t have healthcare because many hard-working people can’t afford it.
The article cited below discusses a recent study that concluded that 60% of bankruptcies were filed due to excessive medical bills. In fact, many of these same people had health care, which was inadequate for their bills. Do Republicans have any proposals in how to lower health care costs?

My sister became seriously ill and had to have emergency surgery. We did not know it but she was grossly underinsured and is now looking at ,000.00 in outstanding medical bills. The debt has been given to a collection agency has refused to agree to a payment plan with her saying that she needs to borrow from her bank. My sister makes about ,000 a year and does not qualify for a loan that large. I told her to just start sending them payments and keeping receipts or her cancelled checks and calling monthly to make sure they received the payments and noting who she is speaking with, that way if they take her to court she can produce something showing that she is making an effort Is there anything else she can do? We definatley don’t want to stiff the hospital but we were shocked when we found out the type of policy her employer had provided only covered room and board and not the actual care.

My fiance recently got his credit report and has about ,000 in debt that he was unaware of. He’s been drawing disability for several years and has medicaid and medicare. The majority of his debt is medical bills that he thought the insurance paid for, but obviously it didn’t. About ,000 of it is basically identity theft. His former roommate opened up two accounts in his name and ran the bills up. We know he did it, but we have no way to contact that person. Well, my fiance decided his only way out of this is to file bankruptcy. However, he doesn’t have enough money to get a lawyer. Would he just totally be screwed if he filed himself? He doesn’t have any assets. No car. He rents his house. So, I’m assuming it wouldn’t be as complicated as it would be for someone with assets. However, I’m sure it’s no easy task either. Yes, I’ve heard the saying that if you represent yourself, you have a fool for a lawyer or whatever.. but we just don’t know what else to do. We have to get this taken care of before they start getting his pay check. He just started working again and isn’t drawing disability anymore so we’re really tight on money. Is there any way a lawyer could help him file bankruptcy and then we just pay the lawyer payments? I’m sure that seems pretty contradicting, but we could afford payments for the lawyer if we didn’t have all this other crap that we’re paying on.

My parents are losing their house because of these bills, they can barely afford to buy food. I suggested bankruptcy but my dad doesn’t think he’ll be able to file on the medical bills because money is taken out of his check for them.

I lost a house that has yet to be foreclosed and I want to file bankruptcy on the5,000 owed along with all the other collection agency debts, medical bills, catalog companies, credit cards, etc. I have no money to pay anyone.
