I’m ready to file for bankruptcy as I’m unemployed & in two months I’ll be out of money if I don’t get a job. I’ve borrowed about k in a reserve line of credit at my bank. My bank deducts about 0/month for this from my checking account. If I file for bankruptcy will my reserve line of credit be taken care of in the bankruptcy or do I have to pay it back, IF I’m able to file bankruptcy? Thanks.

My parents declared Chapter 13 bankruptcy. They had a business in land development and thanks to the housing bubble it collapsed. My dad unfortunately personally gauranteed some of the corporate paperwork.
Now the problem is they are starting to make more money, but the settlement keeps taking the money. Is there any way to try to make more money? Or are the doomed to their current lifestyle for the next 5 years? Any thoughts? Perhaps a bank in the Caymans?

So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

My GF has about 30k in debt…mostly credit cards Just found this out a few days ago and asked her to sit with me and tabulate everything. She has not defaulted on any part of it, but, I guess that could be a possibility down the road. Anyway, the only thing that I have my name on with her is the lease to our apartment (though the bill comes in my name and in the lease it specifically says that any money from the security deposit goes back to me and only me) Also, we have our names together on our internet/tv/phone bill.
I can cover these bills on my own if it becomes absolutely necessary. Obviously I don’t want to and don’t plan to…but I can if the only alternative is being evicted or having services cut off.
My concern stems from this. If a person declares ch 7, I understand that the creditors can basically take anything and everything you own. Would this have any impact on MY personal assets?

its from a credit card debt, which was turned over to Arrow Financial Services (a debt collector), they in turn had Mann Bracken LLP (a national collection attorney network firm) contact me to settle the debt. I made arrangements to pay the debt, and was making monthly payments, directly taken from my checking account. After paying 00.00 over several months time, I received an "Agreed Judgment" from Mann Bracken in which Arrow Financial Services is the plaintiff and is seeking a judgment against me. I was in communication with Mann Bracken and was told to sign the Agreed Judgment and they would agree to not execute, abstract, or otherwise seek to enforce the agreed judgment during the term of our temporary agreement, as long as I (the defendant) complies with the payment terms. I agreed to pay 0.00 monthly directly from my checking account for 9 months, then the parties agree to review the matter again and attempt to negotiate a final settlement agreement.
This was in Sept of ‘09, in which I was dealing with my daughter and my grandson who were in crisis and our family was occupied with their issues, so I had every intention of signing the agreed judgment, but I got distracted and didn’t sign it, so at the end of Oct ‘09, a "Final Default Judgment" was issued against me. I of course called Mann Bracken and was told that after our agreed 9 month period of consistent monthly payments, they would have the judgment taken care of.
So I made my monthly payments every month, but in Dec ‘09 the money was never taken out of my account, so I called Mann Bracken, but the phone # was no longer in service. I tried several different #’s and all were disconnected, then I read on line that Mann Bracken had been investigated/sued and went into bankruptcy! So I then contacted Arrow Financial Services, spoke to a representative, explained the situation, and was told that a new debt collector attorney will be contacting me, but that has been 6 months now, and no one has contacted me.
What do I do? How do I settle the debt, I am more than willilng to settle, and what do I do about the Final Judgment? I’ve pulled my credit report from all 3 credit bureau agencies, and there is no judgment listed. I contested the debt with Arrow Financial, but after the investigation, the debt still stands in effect on all 3 credit bureaus.
Do I need to hire a lawyer?

I settled charges last year for growing weed I have to pay 5k in restitution. I already also owe 50k in credit card debt, from a failed business. Will the 5k in restitution go into bankruptcy. Or does that have nothing to do with it? Im just thinking its a debt, Im not going to pay anyways. Its a really stupid debt too. I would had rather gone to jail and cost them more money than have them think i will pay them more money.

As you can see, I’ve put myself in the worst of messes. I am either going to federal prison or at least several years probation for criminal charges (not related to anything financial). I have 20,000 in credit card debit, and my lawyer needs another 10,000 that has not been paid for yet. I still have a good job for the time being and I rent an apartment. Would I be able to put the next 10k for the lawyer on a credit card and then file bankruptcy? I have a few thousand saved up, however the account its in is in my name as well as a family member. Due to both our names being on that account, could that money be taken?

I heard that there are number of downsides being small business owner. Besides having to work long hrs and be constantly worried about your business and the competitors nearby, there is a high risk of going bankrupt. I was told that 80% of small businesses go bankrupt within its first 2 years. Sure, you make a lot of money if your firm becomes successful, but it seems there are many hurdles before reaching that state.
Knowing that, is it worth the risk starting your own small business for people with not much entreprenurial experience? What are the characteristics of people who own successful small business?

My husband (47) seems to continually repeat the same things over and over again: it sounds daft, but it’s got worse over time (the last 10 years.)
He tells the same ‘jokes’ over and over which are very old jokes that he has told many times and laughs out loud at them, so much so that he has to pull off his glasses to wipe the tears from his cheeks at things that are not funny (and things he has said 100 times…) In addition, he repeats stories and tales from 10 to 20 years ago, (and beyond,) some which are wildly exaggerated, (especially when telling others… as if to impress or shock…)
And he tells me something that has happened, (at work or whatever,) some 5 or 6 times, until i say I KNOW this, you told me already… like 5 times! He must have told me his first single he bought and first album and how he and his dad went to the plough pub to pick up his mom every week and she was always late, 100,000 times….This is just a few of dozens and dozens of things he continually REPEATS over and over!
He only ever sings any one of 3 songs, and keeps continually putting Red dwarf and the i.t. crowd and the inbetweeners on dvd every day over and over….it’s like he has an obsession with the same 3 songs and the same 3 comedy series….there’s millions of other songs, and 1000s of other tv programmes and yet he is obsessed with the same 3 of each. I have started to leave the room when he puts this stuff on; I like them all, but it’s a pee take now.
He tells constant lies too..and he exaggerates hugely, and I think he believes the stories himself! He told people at work the other week that I had been severely ill and hospitalised, when I had had a 3 day cold! One of his colleagues saw me in town and said ‘I hear you were in intensive care…’ I just said meekly, er I am better now…knowing he had probably lied.
And he has had several occasions where he has made out he has gone and demanded money back on something and screamed and stamped his feet til he got his own way, and I found out later that he just bought another item and didnt kick off at all…He yelled at 3 kids for smoking in the street the other week, but when we saw 3 huge beefy black men smoking 10 minutes later, he said nothing. I said, ’say to them put yer effing fag out then!’ and he ignored me. Its like he could only shout at 5 ft tall 13 year olds, and not real men.
He also talks down to me sometimes as if I am thick and don’t know the simplest most obvious things…He acts like he SOOOO much more intelligent. He tries to give me instructions on things I have done 100 times… I just say ‘i don’t know WHAT I would do if I didn’t have you to guide me through life..and God knows how I got through the first 23 years of life before I met you.’
He makes out that he is the king at his workplace and the place wouldn’t run without him, yet he has been there 7 years and is still a crew member on 22.5 hours a week on minimum wage while people half his age have made manager after 2 years. He thinks my family are nasty common chavs and his were middle class and special, when his dad was sacked for the RAF for stealing and is brother has a criminal record for fraud!
He seems to have a massive superiority complex, but has nothing to back it up, no decent job, no qualifications, and his massive spending on materials items in the 1990s and early 2000s, (running up £50K debt) resulted in us going bankrupt because he couldnt keep up the payments…) Also, his family were really nothing….certainly no better than mine…. And his wage is so lame that we live partly on tax credits (we have 2 kids And I work 16 hours a week and I do EVERYTHING in the house including most of the childcare…)
He makes so much sh1t up…and believes it himself… I have caught him out in so many lies and wild exaggerations over the years, from saying he used to be a milkman, and a policeman and he used to own his own business, to lying about how women always used to chat him up when he was with his friends at the pub… it would take too long to explain, but I have found him out over the 25 years we have been together..
Even our 2 daughters think its odd how he always repeats everything over and over and sings the same 3 songs and tells the same stories and ‘jokes.’ And sometimes he just has a go at them for next-to-nothing; no reason at all, and talks down to them, like he is intelligent and superior..he doesnt have a gcse to his name and has spent his life working factories and at mcdonalds..
our younger daughter even asked me why dad doesnt work full time like their friends dads. He said he will get a better paid job, but within a week its as if he forgot the conversation!
Is there some personality disorder here?

I am 26,000 in credit card debt. My life turned around completely last year and I lost many things in my life, family, job, etc. I am not making enough on my job to pay the basics and have been using up all may savings. Now I have no savings left and am short 600 month just for basics and providing for my daughter although she doesn’t live with me. She lives with my mom who is living on ss. I need to file chapter 7 but can’t afford the fees and am not smart enough with paper work to do it myself (I’m terrible with directions). I can scrape together money for the useless credit counseling stuff (so they can figure out how I can pay 1800 bills on 700 income, lol) if I don’t buy groceries for a couple weeks but I have no way of getting 500 dollars. My employer cuts hours every week and it’s that way on all retail jobs. I can’t just get a better job and even with that, i would only have the money I need for the basics. My small tax refund will only be 30 dollars.
If I was able to get a second job (not easy with no transportation and if I work after dark, I have to take a taxi (I spend 20 dollars a week now on taxi rides when I get off at night as my neighborhood is very dangerous and I can’t move). If I can find extra work hours, it will just keep me from being homeless a couple months longer, it will not cover bankruptcy costs. I have no resources, family and friends have no money to help. Is there anywhere in Houston where I can find free legal help (not just a consultation but actual filing assistance without cost?) If I have to pay the fees, I will not be able to pay rent. At the rate I am going, I will be homeless as of July 1st providing I don’t lose my job or have any more hours cut.
They are only a week late but I am already getting calls all day during the week. No one leaves a message on my machine so I presume it’s one of my creditors. I need to file bankruptcy because if I don’t they will sue me and freeze my bank account which only contains my pay deposits which are only 700 but if they take that, I can’t pay my rent. I have nothing to sell as I lost everything I owned last year when my family through me out. They gave away and sold all my stuff. I have a 50 tv and a40 boombox that doesn’t work and a 2year old computer that runs slow.

My brother is currently under an installments plan with the IRS to pay about 4,000 dollars of money due from 2004 because he took a second job and his employer was not withholding enough from his earnings. This year he may receive a refund of about 5,000 but he’s afraid the IRS will keep this money to settle the debt even though he is already on a payment plan. He is thinking of using this money to do repairs on his home.

I have filed for bankruptcy, and the trustee says they see "fraud". I had a student loan wich I used to pay for aviation classes. Now the judge wants to take back my money from the university, and make me continue to pay the debt!!! (,000)!!!!!!!!!!!! Is this possible?

After having been wrongfully terminated August of last year, and being out of work for nearly 4 months with no income, my car was repossessed. On top of owing close to ,000 for that, I owe for a cell phone bill, as well as 4 credit cards, one of which I got to help out while I was out of work. Are there any other options to get myself out of debt without spending years and more money than actually owed to avoid filing bankruptcy? Some of these credit cards have gone up 4 times the amount that was initially owed. One of my major concerns is that I was paying the payment protection plan and none of the companies honored it. I would have easily been able to pay my debt had they honored the payment protection plan. I could dispute that and get the amount owed down to the actual amount, but where does that leave me with paying off a car I don’t have? Please, any advice would be greatly appreciated. I’m only 26 and the last thing I want to do is file bankruptcy.
I’m furthering my education and do not wish to have such poor credit for the next 7 years. How will I be able to afford rent, a car, and paying this debt off while going to school?

I’m unfamiliar with bankruptcy laws so I’m wondering if a contractor owes me money and plan to file bankruptcy, if I don’t sue before they file, will I still be able to sue later on. I don’t want to precipitate any action but I also know that they are trying to do the right thing. Unfortunately, there’s a lot of money at stake and I don’t want to lose out more than what I have to. Any advice? This is for an unfinished/late contract.

Okay, this is extremely frustrating. I’m a 19 year old student, who works part time. I have all-state insurance full coverage, and I drive a 2001 toyota tacoma, which is paid off. And guess how much Allstate charges me every 6 months? 0!!!!!!!!!!!! That is absolutely ridiculous. These son of a bitches are totally ridiculous charging me that. I’ve never had a ticket, never been in an accident. And I don’t care if i’m 19 that price is absolutely absurd for that car. I’m almost at the point where I just wanna go illegal and drive without insurance. I’m looking sleep every night over this I mean seriously do they think a 19 year old college student is made of money. And the funny thing is it’s under my parents policy and its this much!!!

This is more for my friend… She is in the middle of filing for bankruptcy, has horrible credit, and no money… She is also on psychotropic medication that she has to take, and I’m worried about her if she can’t pay for her medication.. What do you do in this situation?

Doctor sent me to hospital for out patient blood test. They tried to put of all things a catather in my kidneys!!! I would not let them. The hospital has charged me for this test and another one which I did not have done and would not allow them to do! Tried to settle this for 3 1/2 Yrs.
Now I have a collection agency calling me at least 8 times a month. Have caller ID but is still annoying. I have an excellent credit rating, never late on a bill and the hospital treats me like a criminal. I am sending a certified letter to the hospital and the collection company. I have blown air horns in the phone and called them back at least 20 times and the supervisors don’t like to be harrassed but yet they think they can harrass me. They do not take into consideration that I have excellent credit. Dr. sent me for blood test as out patient, hospital charged me for emergency room fees. I will not give them anymore money I do not owe. It is just the principal. Anyone had this?

So we don’t raise the debt ceiling and we can’t spend more money? We should still be able to make the minimum month payments for our debt yes? It’s like a credit card limit, you reach the limit and apply for a limit increase. Just because the bank denies that increase does not mean you can’t make the minimum payments. If anything, it should help make the minimum payments since you aren’t adding more debt on.

In November, I made the decision to file bankruptcy and it was filed a week ago today. My problem is I recently purchased a car (4/4/11) and I have a car loan, but I want to surrender the car under the bankruptcy. The problem is the car is not in good shape as they told us it was (they said they replaced the transmission, but the transmission is stalling and jerking), and they are not willing to switch the car/trade it. I also called the bank and they are more concerned with getting their money than actually helping me (go figure). Will this look bad on my part or is it fine to do? I am wondering because I have to make another payment tomorrow and I would rather not if I can surrender the vehicle, and I don’t want to pay if it will jeopardize my bankruptcy. I emailed and called my lawyer, but he left early for the day :0) Please help!!!!
I am filing because I was sued twice and a lawyer told me to do nothing, so now I have a judgment. I am the only income in my home, and trying to get a reliable vehicle, I opted for a car loan thinking that was going to ensure I had a good vehicle.
I also make sure I work overtime so i can afford the car to be able to work. With a family I am trying to do what I can, but I can’t do that and pay back ,000 that was run up in my teens. I was pregnant with no job so I maxed out credit cards to buy food and clothing etc…. I regret it, and wished I never done it. Now I want to be able to start fresh with the new life I am making for myself.
