What's the deal with BANKRUPTCY?

I am considering chapter 7 bankruptcy. I am 5 months behind on payments and been getting threatening calls from the bank, I only have a year and a half let on my note (started out as a 6 year contract). I have unpaid medical bills which is only about 00 along with a early termination fee from sprint and tmobile and I owe to GE money bank. Back last march I ended up homeless and worked any job I could but still wasnt able to get on my feet. So for those of you with comments like "poor money management" keep your comments to yourself. My bills were always paid on time until our economy went to shit. Now that I mentioned that I will get to my question. Is there a way to get around this to not file bankruptcy so my car wont get repossessed (something quick before they take further action) and all my debt paid? I don’t have much money to file bankruptcy. Is there a way to get help so I can pay it out?

Should I file bankruptcy, settle, or keep ignoring my creditors?

I have an old Citi card, Capital One card, Best Buy, Chase, and then a few smaller ones- Wal Mart, Express, and Lane Bryant. I haven’t made a payment on most of them in at least 2 years. I stopped paying them cold turkey because they jacked the interest way up and wouldn’t negotiate with me, and I couldn’t afford to pay them along with tuition, rent, etc. since I didn’t receive help from my family. I’m not even sure what I owe, but with all the fees I’d estimate I owe a total of ,000-,000 spread out on them all. Without the fees it would have been half of that. In addition, I have ,000 in student loans. I’m not making much money right now at all. For now I’ve just been focusing on paying my student loans in the hopes of rebuilding my credit. I don’t see how I could afford paying off my credit cards. What should I do about them? I’m not getting many calls anymore, but lately someone is calling threatening to sue me for 00 credit card. They have threatened to sue me before (Citi Bank) and even sent me a summons of court letter, but never followed through. What is my best option? For now I plan to keep ignoring them but I am sick of this problem. Help!
Thanks roscoedeadbeat. All my credit cards are already in collections, and they have been for about 2 1/2 years. I also had a 2nd Citi and 2nd Chase card but paid them off as a settlement years ago with some student loan money… Now, the problem is, I don’t feel like I really can afford to pay them. I’m already having a hard time paying my student loans- right now I have to pay 0/month and soon I will start paying my private loans which will be around 0/month for a total of 0. I feel so overwhelmed! :( Maybe I’ll talk to them and ask what is the lowest they can settle for, and then see if my family can help me at all, but I hate to ask them for help. Thank you for the answers Sgt Big Red and carl.bennet. I looked up the statute of limits in my state (MN) and it is 6 years… so I am about halfway through. I might end up making more money in the future, but I don’t see it happening for a while. I plan to go back to school within the next year (either part-time or full-time if I get a graduate assistantship), and that will take me at least 2 more years. So maybe I will continue to wait it out. I don’t want to deferr my student loans right now because I want to save deferrment for a later time in case I’m in a worse situation then- such as if I have a baby or get sick. And I can only defer my federal student loans, I can’t defer the state loans. It’s so hard- I wish I had been smarter about debt, but I guess you live and learn. I appreciate your answers.
Oh one more thing- this is a bit desparate, but if I moved out of state to where they have a lower statute of limits, would the new statute of limits apply to me? Or would it be the same statute of limits since it originated in MN? Thanks!

Bankruptcy…. Yay or nay?

So, the dreaded question… File bankruptcy or not?

I was kicked out of my house at a young age (16 to be exact), and the only thing that helped me not be homeless was the dreaded credit card, since there’s only so much money a 16 year old can make.

So now with the credit debt, the school loan debt, the car payments, etc etc, I am in over my head (over 15k). My question… Should I file bankruptcy or not? Also, should I file Chapter 7? Also, what would the best attorney for me be? (I was looking at Peter Francis Geraci, but I can’t find anyone that has filed with him). Also, what is the time frame i’m looking at till I CAN actually file bankruptcy (I heard it takes over 2 years?)

Please, ANY help will be beneficial. I wasn’t a "bad kid" that got kicked out into the streets… I built myself a life in a state by myself and tried making it, but unsuccessfully.

in lieu of Obama's attempts to raise the debt ceiling, why don't you darn conservatives just do what the res?

I mean seriously, I got a bachelor of science degree in 2008 and couldn’t even get any job at all until August of 2010. The job I do have is doing hard work (lifting, pulling, emptying trash) at a thrift store where I get paid .50 an hour, which is considered a low wage. But in my case I am simply not worried about material things and I dont usually spend money on anything other than rent or other bills that need to be paid. I live in a mobile home with my dad and it is far from a lavish lifestyle, but I don’t consider myself deprived because I don’t always go out to eat or spend tons of money on material things. The truth is I am just not worried about things like that in general, and I am also not terribly worried about what kind of job I have or how much I get paid (even if I did go to college), I might WANT a better job, but I am HAPPY just as long as I am making enough to live decently. That being said, I just could never understand why it seemed like other people were upset because they were "not making enough money", yet they go out to eat and want to buy expensive material things which cost tons of money. It dawned on me that there are people like athletes who make several millions a year, when the truth is NO ONE needs that much money to survive, not even if they have a family. Who needs several million a year, even if they "earn" it? Do you not think I "earn" more than .50 an hour with the intense physically demanding work I do?
I don’t know about you, but it seems to me that republicans are the ones who want it so that people will make so much money when they don’t need anywhere near that much, yet they want to place the blame elsewhere when we are in a situation like the current one involving the government going bankrupt. Why can’t we just return to a time where people accepted and were paid a decent wage relative to their employment and were not worried about lavish living, but were happy just as long as they could live decently? Because the truth is this government could really save a lot of money were it not for individuals getting paid rediculous amounts of money as they so often do these days. These cuts do not even have to be that drastic, for example if a group of athletes, singers, athletes, e.t.c. is currently making million a year each, that could be reduced to million a year for each of them, or perhaps not even reduced by that much either. Even million a year is a TON of money and more than any family will ever need, yet this type of reduction when multipled by several people would create untold amounts of additional revenue that does not currently exist to improve the economy among other things.
I just really think that we should at least consider something like this, because it pisses me off that we are in this situation with the government going bankrupt when there are people being paid rediculous amounts of money. Why not just reduce their pay by a small amount, which will add up significantly, in lieu of wanting to cut necessary spending elsewhere such as with entitlement programs?

How can I negotiate a settlement with a debt collection company?

I have a verbal agreement (which I know is worth the paper it’s written on) for half of the total balance. However, they want a lot of personal info relating to our hardship: bank statements, paycheck stubs, self-employment income, and list of expenses. I’m uncomfortable providing this information. They do have a judgment against me and I’m afraid to put much money into our personal account. What information should I definitely NOT give them?

Should I file bankruptcy?

I don’t have much money. I don’t have a job right now. I just wanted to know is it smart to file for bankruptcy if I am no more than 7000 dollars in debt? I called some debt collectors, and they are not willing to settle. What should I do??

Should Fundamentalist Churches and groups be heavily taxed?

Only the ones that adhere to these qualities
1. Are a nuissance to the community, such as open air preacher organizations, politically motivated groups, the WBC, Liberty University, CBN,
2. Dont provide any worthwhile services to the community, like helping those in need.

Benefits:
1. Tax breaks for the common man
2. More money for necessary services like universities, schools, healthcare and poverty rehab
3. Theres a greater chance their organization could go bankrupt, and they would lose their cult
4. They steal so much money by selling junk, collecting tithes and costly talks just to hear some lame sermon about how your garbage. So they dont deserve any of the money they get.

Should I file bankruptcy, consolidate, or do something else?

Good news is I make 60 grand a year. Up to 65 grand if I get a lot of overtime.

Bad news is I had to take out a lot of loans to get there.

140,000 dollars in private student loan debt.
70,000 dollars in federal student loan debt.
35,000 dollars in credit card debt.

Altogether they want about 2800 a month, which is about 70 percent of my take home pay. I convinced my student loan company to let me pay back the loans over a longer period on a graduated scale and got the payments reduced a little so now I’m only paying 2100 dollars a month on all of my debt. But that’s still over half of what I make and I can barely live a normal life.

What should I do? No one will refinance me at a lower rate because I’m such a high risk option with all of this debt. But I’ve heard that a bankruptcy court will crucify me because I make too much money, even though I’m barely scraping by because of all the payments. Help!

Should I attempt to pay my credit card in full or settle the debt?

Here’s an interesting situation. I was out of the country and thought I paid my balance in full, but money sat in my bank account for a few months not moving. I’ve never had a late fee in my life, but I am young and don’t really have much to have credit built on yet.

Anyway, I was out of the country like I said, and the account went 5 months past due with just very small payments automatically paid. However, they weren’t enough, and it now shows up as 4 months delinquent. The late fees made it where I don’t have quite the money to pay in full, but I can get help from relatives to pay in full now. However, my account was sent to collects, but it was not charged off. The collections company said they were only contracted to help the creditor. It was not charged off.

They offered a settlement to me that is about ,000 less than the full amount, and I really need money right now. Should I take the settlement or pay in full? I am worried about my credit being hurt more, but I also spent too much money on someone I thought I was going to marry. I certainly won’t make that mistake again because now I have trouble paying for gas and food.

Credit card && co signing question! Please!?

I am 20 years old I live in a house with my boyfriend it is in his name but I paid for this house also, I was just wondering if anyone had ways to get a credit card? I went to my bank and asked and they want me to put my own money on a card for like almost 2 years and keep paying it back. I do not have that much money to pay on the card and then pay back constantly. I work in fast food but I do keep my bills paid, was just wondering if theres any good cards out there to apply for like a 300$ credit limit I want to start building my credit. Also My dad filed bankruptcy a year ago and he is starting to re build his credit can he cosign for me still? its so difficult doing it by yourself because my mother has bad credit so I cant have her cosign anything so I’m kind of stuck. And yes I’ve applied and kohls, fingerhut all these small places and got denied. Please any advice would be great! It would help out alot! I dont want a credit card to be immature, I want it for emergencies such as my car breaking down or for gas or bills.

ow do I find out what is being paid through the garnishment of wages in a chapter 13?

I have been in chapter 13 for about a year now. and was recently sent another adjusted fee for this. I make excellent money as a property services professional, but they are taking so much money out of me now, that I am only bringing home a little over a 100.00 a week.

So, when they attached the new fee, which was an additional 245.00, I wondered how I can find out what they are using my money to pay for.

How do I find this out?

Don’t worry about me, I am not discouraged…… I am curious to know…..

Can I file or bankruptcy if I make over $70K & will I lose my house?

I hear the laws for filing are much tougher. Does anyone qualify or do I make too much money? I owe K on my credit card & I’m only six years into my mortgage. No, I don’t have a sub-prime loan. Will I have to pay back some of the money if I file bankruptcy or will all of my debt be gone? I’m not late on my mortgage or my credit card, fyi. However, I can barely pay them. Thanks.

Can I file for bankruptcy, should I?

I had very good credit. Two years ago, however, I was forced to lose my home to foreclosure. Actually, it was two houses. After that, my big credit cards were cut or reduced, however, I never stopped giving payments. I’ve always been in good standing. I always give more than the minimum payment. Things were okay after the foreclosures, I could still afford to pay my balances, and it was all just alright.

However, about maybe 3 months ago, I started thinking about filing for bankruptcy. My cards weren’t maxed out, but I was still finding it a little bit harder to make payments. Then, business started thriving again, and that’s where I started spending more. I’d never maxed out my cards. Now, they are full. So, basically, three months later, I find myself in the same situation. Business has gone down once again (even worst than the first time) and now it’s getting tougher and tougher to make payments. Up until this month I still made some big purchases. A dslr camera, and somethings because I could still afford it. 2 months ago I bought me a fridge (2,000) dollars. Business is completely dying, but I’m afraid of filing from bankruptcy and having my things taken away… How long should I wait before I file for bankruptcy? I’m also afraid of being charged for something I honestly had no thought of doing (stealing the banks so much money) I would say I’m about 10,000 dollars in debt (i know it’s not a lot, but for me at the moment it is…)

What should I do? How long would it be reasonable to wait so the court doesn’t think I went and maxed out my cards before i filed for bankruptcy? (seriously, that was not my intention) A couple of months would be good? With my small savings I think I could still afford to make the minimum payments… HELP
I don’t know what I was thinking when I said I’m 10,000 (I was thinking just about a few cards) dollars in debt. I am about 50,000 dollars in debt. If not, more. Like I said, I had great income, and very big cards.
Spalmer: I’ve always known how to manage my credit. I’ve never been a big spender. My business was a thriving one for 14 years. I’m a wedding planner, and believe it or not, I made the big bucks there. Somehow, things are not the same. I also had another business, a small landscape designs. Things happen. At the end, yes, I might have spent much more than I should have, but i DID have the money to do so. Its just that you never think something bad is ever going to happen to you.
I’m sorry not saying what my income was. It’s about 100,000 but, like I said, I’m nowhere near making that. I do not own expensive car. The home I recently (2 yrs ago) purchased I bought cash.

can i settle my debt with the collection agancy?

also if i settle with all of the collection agency’s and have no more debt to my name will that raise my credit score or at least help a little? All my past bills have been medical and have gone into collection, do the collection agency’s report to credit bureau?
My credit is already bad my score is 525 now. Im just trying to pay off my debt and start rebuilding my credit. I dont really owe that much only about 0 total but i dont make that much money and i have a child that i need to care for.

How many think we should let The auto makers go bankrupt? Please explain how you feel.?

My thinking is . That the people make too much money. Average 75 dollars an hour. They have the unions to fight for them.That cost a lot.They have big payout to their retirees. Why can’t they take a cut in pay? Get rid of the unions. have all the upper management take no bonuses. There is so much they could do to cut cost. My brother worked there for 3 years and was given 100 thousand dollars and a free car. This was fine and dandy till they couldn’t afford it anymore.

All the money they could have saved ,could be used to making fuel friendly cars at lower prices. Why by a ford,gm or chrysler, when it cost you more and the product is worse than the foreign cars?. You are paying 30 more per hour to get your domestic car. This is one side and I realize there are some benefits to helping them.I will write that latter. Plz don’t get offended I just want to hear all sides to this story.
Carguy I thought it was lower also. Today it was reported on cnn that the average was 75 per hour while `Japanese cars were 45.per hour. Like I said I know there is another side to this story. My family worked for GM and I am just saying what it feels like for people who do not have such cushy benefits. You know you would rather got down to 50 dollars and hour than not have a job at all.

Is it worth paying a bad debt if it has already gone to the collection agency?

My husband has 2 debts that have gone to the collection agency. One is the result of a credit card bill from his ex wife for ,500.00. The ex is suppose to pay this when the community property is settled. The other debt was incurred by himself for a cell phone for 0.00. He does not know if he should pay the bill for 0.00 now, or just wait till the larger bill is paid when the community property is settled. We hate to put out that much money for 1 bill, while his credit is still messed up from the much larger bill. Will it benefit him in the long run to pay the bill for 0.00 now? Help, we are confused. My (his wife) credit is excellent, so I have never had any experience with this before.

I have a credit score of 504 and i have a lot of old hospital against my credit. I don’t have much money. I want to sell my house and buy another one. Do I try to repair my credit myself or just file bankruptcy? Before or after buying and selling?

If I am 80,000$ in debt, should I consider a debt settlement company instead of bankruptcy?

I am in debt from helping my son when he was off work. Helping my elderly father. Also, my ex-husband was fired from his job and now we are divorcing. I am in so much debt that I am far behind on payments and I make too much money to file a chapter 7. I would have to file a chapter 13 and pay back a portion anyway. Would a debt settlement company be a better option?

Creditor threatens to send my account to an Attorney to pay off debt?

I got a letter today from Midland Credit Management, asking for a debt in the amount of ,181.56. The Debt is from Aspire Visa, a card I used to have .. I could not pay it all off since I lost my job and i’m having trouble finding a new one. I can’t pay off this debt in this amount .. it originally was NOT over ,000, it was 0. They added on all these late fees / interest when I could not pay over a amount of time. I tried to make small payments, but obviously they didn’t help, it just got larger and larger. The account has been in collections for a while and so, it doesn’t matter how much I pay, it’s still not enough.

They sent me a letter saying:

"This letter is to inform you that Midland Credit Mangement, Inc. Is Considering forwarding this account to an attorney with the intent to initate legal action to settle the debt.

Please call our office immediately at 800-939-2353 to make arrangements to pay this debt and prevent any legal action on your account"

What do I do?? I cannot afford this .. I have absolutely no funds, and there no point in calling telling them that because well, what are they gonna do?

I’ve told them that I can pay it when I get a job, which I am currently looking for, but if the case goes to an attorney, what are they gonna do? even if I will have to go to court, that’s still not going to get them money .. because I don’t have it. I also have no assets, no car, no house, or anything. So what can they do?

I’m really worried. I am still trying to find any job I can, but even if I do, it will take me a while to save up that much money.

How to get a loan for school?

Okay. I am 20 years old and single and I am trying to get a loan through a bank for beauty school. I don’t qualify for financial aid because my parents made to much money and I CANT get a loan because my parents have screwed me over by going bankrupt.

Why does it cost so much money to file bankruptcy ?

It doesn’t make sense that they charge you so much money…
Most people that really need to file bankruptcy can’t afford it …
HOW STUPID IS THAT ???
If I had $ 1500. to $ 3500. I wouldn’t be trying to file bankruptcy …
AND
Legal services don’t handle bankruptcy unless you own a house and your in default …

Debt Settlement?

I spoke to a collection agent today about an old debt that I am trying to pay off. They offered a settlement for about 20% less than the total. They informed me that if I took the settlement it would look bad on my credit report. Any truth to this or is this slimeball agent just trying to get as much money out of me as possible?
I was under the impression that even if I pay the settlement offer from the collection agency that it will still show as being paid on my credit report and the account being closed.
How can it ding your credit. If it is an old account that is in collection. Won’t my score go up when it’s paid? Do you mean it won’t go up as much?

Is hiring a lawyer absolutely necessary to file a bankruptcy?

Most attorneys want 00 or more for a bankruptcy. If I had that much money around I probably wouldn’t need to file bankruptcy. Is hiring an attorney absolutely necessary? Or, can I use a paralegal or document preparer to do the forms? What suggestion might you have?

I have until April 28, 2008 to file bankruptcy. Is it too late to file and to avoid foreclosure on my house?

My house was schedule for foreclosure sell on April 18, 2008. I had 10 days (28 April) to file bankruptcy if I wanted to keep my house. The attorney I talked to wanted too much money to help me. What can I do? I am considering "Pro Bono" Services for assistance. I only receive military retirement pay as income.

Making too much to file Bankruptcy under Chapter 7?

I attempted to file Chapter 7 today but because of the new bankruptcy laws it seems that I make too much money to file. I was offered Chapter 13 but really despite the law that says I make too much…I really don’t have any extra funds to pay. I am married but filing bankruptcy by myself however the courts look at both incomes. What are my alternatives?

I am looking to file bankruptcy as affordably and effectively as possible? Any ideas?

I live in New York City and like most people looking to file bankruptcy its because I don’t have much money and certainly not enough to pay all my debt! I’ve looked into filing and it looks like from what I can tell to file a Chapter 7 will be around 00-2000 in fees, court fee and lawyer fees. Is there a more affordable way to do it without sacrificing on the quality of the filing?
