I have a few qustions regarding chapter 7 bankruptcy – not sure if anyone would know the answers to any of them. I haven’t filed yet but it is a consideration.
1. I bought a new car last year – my father is the primary on the loan and i am the cosigner – how does this affect his credit? I am current on payments and will continue to be current.
2. My ex husband and I bought a house together when we were married. I am the primary on mortgage and he is second. In the divorce he got the house and modified the mortgage based on his income. If I file will that mess up anything with him?
3. I am an authorized user on my fathers credit card although I haven’t used it in years – will my filing affect this on his credit report?
4. I am in desperate need of a new bed – if I buy one before I file will this have any affect on the filing (not buying with credit – paying outright).
THanks for your help. I hate the idea of filing bankruptcy but Im now being sued because a creditor won’t work with me for a manageable payment plan (they want more than I make in a month). If anyone has any other alternatives I would appreciate that too.

My dad has no idea how to handle money. He has made our family go bankrupt. We got a lucky break inheriting money from his parents but instead of paying bills like on our house thats gone into foreclosure he bought an expensive new car that he didnt need. I cant even register for college classes because we owe ,000. How do I forgive him and help him spend more wisely? He wont listen to me.

Ihad a judegment on my report for the amount of 1766.00 when I called they told me the total amount was 4700.00 because of Intrest, but they would settle it and send me a paid in full letter. was this a bad idea, should have I arranged to pay it all. I also paid off some old collections ( 5-6 years old) a couple settled for less and a couple I paid full amount ( fees, orginal charges and intrest) how long will it take to clear up my credit and for my score to improve.
I have plenty of new good credit, I have had a new car payment for almost 2 years and never been late, I have a few credit cards that I pay off each month and so on….
So I have good credit I just had a few older collections that I have paid off, but I have not had any BAD debt new to my credit report in 5 years
I sould have letters from each of the creditors with in a couple weeks and at that point I will send them to all three buerues…

I’ve read a bit of things about chapter 7, but one thing isn’t clear. Under the new laws, I do qualify for it. I’m in Missouri. It says I can keep the car up to the value of 3k. My car is work 7k. I obviously cannot afford nor would I qualify to get a new car and I have no money (which is why the bankruptcy). I live alone and can’t go without a car. What will happen in this case? I have no other assets other than that.

I am 22 years old and have ,000 worth of credit card debt and ,000 in student loans that I have to start paying off in 2 months. I talked with a credit counselor and asked him his opinion whether or not I should do the program or declare bankruptcy. He could not give me a specific answer, but he was leaning towards bankruptcy.
I just graduated college and have a job making very little money and paying off the debt is going to take me over 10 years because my monthly payment (with the credit counselor) is very high. I know even if I continue with the credit counseling, it will still hurt my credit.
My parents declared bankruptcy 5 years ago and had no problems getting a new car and built a brand new house with an average interest rate. I know some employers look at credit reports, but credit counseling will affect that anyway. I just want to start over and need some advice. I appreciate it!!

1. I am like many in that my house is worth much less than my loan.
2. I have over 25,000 in credit card debt, and have stopped paying on most of it.
3. What I bring in per month is about 1000 less than what needs to go out (and that’s just at min. payments!)
4. I drive for a living and my car is to the point of either keep dumping money into it or buy a new one.
So what I need advice on is whether to just continue not paying on my credit cards and have to put up with calls, scraping to get by and paying an inflated house payment, driving my old car and spending extra money on it for maintenance. OR Do I go buy a new car (assuming I can) and file bankruptcy afterwards?

I had bought a car in 2005 and had it voluntarily repossessed in 2006 after a divorce and no job. I heard through the grape-vine that if i didn’t settle the old account that if i bought another vehicle it’s possible they can repossess my new car to settle the debt on my credit at any time. Is this true? Rhode Island, resident.
They as in Creditors! And the car i’m buying will be paid for no more loans. I will be paying taxes on it evey year but that’s it.

I am so overwhemled with monthly payments for my new car, car insurance, registration, 5 credit cards that are maxed out, now I am paying medical bills for a trip to the hospital without medical insurance. To top that off, I’m depressed about ending a long term relationship. I am just so sad, overwhelmed and no motivation to even go to work, which is my bread and butter. Everything all at once! I can’t even go anywhere cause I don’t have the money.
I called my cc companies and asked them to lower my monthly payments, but even that’s not helping…
I have no choice but to file Bankrupt, but have no idea as to go about it, can someone who has been there please help me….What do I do, where do I go, what will it cost? Your help would be greatly appreciated. Thank you in advance.

We are about to pay off the balance on our Chapter 13 bankruptcy plan. At some point after our discharge is granted we want to buy a new car. We are planning on putting like 40% down. We have a good credit history with past car loans and can now comfortably afford a large car payment if we were approved. Has anyone out there been through this and/or knows if it’s difficult to get approved for a car loan after a Chapter 13? What kind of interest rate can we expect if we are approved?

I’m in the process of trying to get several old debts paid off. I have to buy a new car next year and I really don’t want any of this hanging over my head. I have 2 collections from the Medical Business Bureau. One in 2008 and one in 2005. They’re not for a lot and I can pay them in full if I have to, but I’d rather try to save as much as possible to pay two other collections. Has anyone had any luck settling debts with the MBB? I’ve also got 2 large collections with AFNI and Credit Systems Int, if you know anything about those. I appreciate any help I can get!

I heard there’s ways to pay off debt for like 10% – 20% of what you owe. I’m just wondering how this works and how I can do it. I need to get out of debt fast as I need to rent an apartment. I would also like to get a new car, but I am ,000 seriously past due.
Please help me. This is getting so out of hand. Everytime I turn around I have another bill. I know I need to stop spending. I plan on buying that Rich Dad, Poor Dad book soon, but I just want to get out of debt.
I will be working an awesome job this summer and it would be a shame if that money went to waste on something. Which is why I’m looking for advice now before it gets to be too late.
I am looking at about grand to credit card companies, grand to hospitals and grand to banks and old phone bills.

I’m 25.. I don’t own a house, but have about k unsecured debt I owe and want to file BK… Additionally, I have a 2 yr new car currently financed for an additional k I want to keep.. I know attorneys are expensive in my area Van Nuys/ West San Fernando Valley, so am finding myself at possibly going with a paralegal.. Please help, and advise if this is smart or not… I definately don’t want to lose my car… Thanks!

"Jeff", 21, is a full time college student and can no longer work because he doesn’t have the time. His dad lost his car for driving without any credentials, so Jeff now drives him to and from his low paying, thoughtless job every day. He drives him anywhere he needs to go – bank, store, church. It’s been going on several weeks, and the father has said nothing about getting a new car since he can’t afford the 00 ticket. The father spends most of his time partaking in church and football watching on tv. He has no aspiration to get a second job, because as long as he has his routine church, football, and weekly steak, he is happy. Honestly, he isn’t very bright, for he can’t even understand basic things that Jeff or I talk about – he isn’t bright at all. It seems hopeless.
The father has lied to the mother, who cares but is going bankrupt anyway, so it’s not like she can financially cover her son, Jeff. The father even lies that he is paying Jeff’s car insurance, when really he isn’t paying for his or his son’s.
The father does give weekly twenties to Jeff for gas, in addition to cash for any of his car repairs. It’s not enough though, so I give money to Jeff as well. Ever since the father’s dilemma occurred, Jeff has been far more anxious and tired than normal. He is so busy, he has little time to consider a plan. He also doesn’t have much time to complete the startup process of his online business. He is driving illegally (no insurance), so this must be corrected. What can he do, and does it benefit that I inform the mother of the truth?

and I owe around 66 on it. I am in the process of trying to buy another car. I understand I hv 2 find one under ,000 and the trustee has to approve it. My question is, does the new car go into the bankruptcy or will it be a totally different payment? Please answer only if you hv been in chapter 13 or are familiar with the legal issues. Thanks.

I had a small business and in 2005 it failed and i had to go bankrupt on it and my home..everything , i lost it all.. I have since gotten back on my feet (i thought) ..got a good job with the state and even bought a new car since i had to drive so much for my job…Aug 1st of this year the governor cut the budget to my program and i lost my job. now I can’t make it…there are no jobs around here, there’s nothing…when is the earliest I can file for some sort of bankruptcy? I took the total wipe out the last time..this time I’m hoping I can do the one where I can restructure and keep my home, car and possessions. The economy is killing people like me. Please I hope someone out there knows if I can file for restructure sooner than 7 years and keep what I finally got built back up. Thank you
i wanted to add that i am NOT an idiot and really hate to be talked to like i am one. I am getting unemployment for now. I live in a very small town in Southern Ill and there are NO jobs…thanks to our goverment all our jobs are going to china or somewhere bedsides here. I ask my question to get a helpful answer NOT to get told I am lazy and need to find work…hate to wish bad on anyone but I just hope those of you who think I am so lazy goes thru this someday themselves..maybe then you will all be more understanding. I didn’t need made fun of ..i just ask for help in finding the right answer…thanks for nothing.

Hi.
I have a very good credit score. I have never made a late payment on anything in my life. However, I am foreseeing disaster and see no way out of it. My debt is about 17K in credit cards and student loans of about 10K so a total of 27K. I am not worried about the student loans, since I am in school and so they are currently "on hold" till I finish and when I am expected to pay them its only like 0 per month for ten years. However my credit cards are getting worse and worse and the only way I can make myself stop relying on them is to wipe them out. Unfortunately I have practically zero income (about 0 per month) and I am in college and live with mom. I am 24 years old. This is pretty sad, I know, but I think I have to file soon. Its a shame because my credit score is about 720. I just leased a new car, which is under my name, but again, family is supporting me. So… I feel that I should just file bankruptcy (chapter 7 is what I am thinking) and just live off what I earn for thew next ten years. I own nothing of value, and am on my mom’s lease, and also want to know if they will take away my car when and if I file.
Please, I know everyone says its a "last resort". I am viewing it as such. So if it comes to this, what is the best way to go about filing and hoe much will it cost me financially and also how long does it take? Will my debts be wiped clean? I heard that student loans don’t go away, which is fine by me. Its the credit cards that are about to crush me. I need real advice, not just empty worthless criticism. So please ONLY ANSWER IF YOU HAVE RELIABLE EDUCATED ADVICE.

my friend filed for bankruptcy and she got out of debt and now she has a new car and a new house. How is this possible? Dont you have to pay some back?

We just filed chapter 7 bankruptcy and it will be discharged soon. We are in need of a new car, but when we stopped by to talk with the finance manager at a car lot he said we would have to wait 6 months before any of the banks would touch us. Is this true? Has anyone bought a car soon after they were discharged? Thanks for your answers!
