My parents declared Chapter 13 bankruptcy. They had a business in land development and thanks to the housing bubble it collapsed. My dad unfortunately personally gauranteed some of the corporate paperwork.

Now the problem is they are starting to make more money, but the settlement keeps taking the money. Is there any way to try to make more money? Or are the doomed to their current lifestyle for the next 5 years? Any thoughts? Perhaps a bank in the Caymans?

I know they buy old debt at pennies on the dollar, and I have old cc debt, that WAS only about 6k, but with interest, and then being charged off and continuing to roll for years, is over 20k on paper, according to them. But I didn’t spend 20k, and I know the agencies will settle for much less than that.

I’m looking at ch. 7, but before I commit to it, I want to know what realistically I could pay the various collection agencies to settle it. I feel that a BK attorney will only encourage me to file, and if I call the agencies, they can legally start hounding me and my parents to get ahold of me (I’ve managed to keep my number etc private for years). Where can I turn? And what % do they usually settle for? Thanks so much.

-So, if paying them off won’t improve my credit score, what’s the fastest way that I can bring my score back up? I work in a profession that is greatly taken advantage of by illegals. I fear the fact that they may eventually cause my employer to go bankrupt. I personally see and experience the sense of entitlement that these people feel. Most are not appreciative…in fact they can be quite demanding and often become disrespectful when they’re told that you do not speak they’re native language.
I don’t agree because a child is born in the US, they are automatically given citizenship and rights to
benefits that others have worked hard to pay in to. I don’t believe that these Federal/ State funded programs were designed to support this. Two illegals don’t = one legal…just like two wrongs don’t
make a right.
I also fear for my children. Diseases that have previously been eradicated are resurfacing and our
children are being exposed to them. Our schools are eliminating programs such as PE, Art and Music due to lack of funds, however, there seems to be plenty of programs and funding available for
ESL texts and instruction. It feels as if the focus has gone from the children who deserve a proper education, to concentrating on making sure the Hispanic population is being brought up to speed and receiving the best education. It seems as if everything is geared towards the Hispanic population now. What about the rest of us and our children?
What is wrong with making someone verify that they are a legal resident prior to enrolling in a public
school which uses taxpayer funds? How can we honestly teach our children that to lie, cheat and
steal is wrong when our own government is supporting, and even encouraging, millions of people to
do just that?
A key argument regarding birthright citizenship and children who were brought here at a very young
age illegally is that "it’s not fair" to them to face the consequences of their parents mistakes; well it’s
not fair that my children and I have to pay the consequences instead. Besides, I was always told as
a child that sometimes life just isn’t fair.

My dad has no idea how to handle money. He has made our family go bankrupt. We got a lucky break inheriting money from his parents but instead of paying bills like on our house thats gone into foreclosure he bought an expensive new car that he didnt need. Long story short in order for my parents to obtain their home I co-signed. Then they obtained a modification for 50 thousand. Up until yesterday I didn’t know that my parents were told to stop paying for the second loan of 50 and now they owe that amount. The realtor suggested filing for bankruptcy. I was shocked I told him im 23 years old how the hell would filing for bankruptcy look on my credit. Mind you my credit looks awful due to my parents not being able to afford their home. However the realtor said that it wasn’t that bad that id be able to get my own home and obtain loans in 2 years. I was told that if my parents file bankruptcy and I don’t that the entire loan would fall on me and I would owe that entire amount. Im just soo pissed that my parents would allow this to fall on my shoulders. On one hand if I don’t include myself in the home modifications my parents will loose their home but if I do my credit and the ability for me to ever buy my own home is f—. Would bankruptcy really be the way out ?? please help any advice or input helps im in such a predicament that I feel any decision I make im screwed either way.

My girlfriend and I have been dating for four years and we feel like it’s about time we moved out together as we have just finished college. For a variety of reasons, my parents really don’t like her. My view is (being the oldest) they view me as the ‘perfect child’ and that nobody is ever good enough for their precious son. They’re both lawyers and they rant and rave about how I could do ‘so much better’ because my GPA was ‘much higher’ than hers, that we have ‘nothing in common’, that her parents are ‘rednecks’, that she is ‘disrespectful’ and *gasp* she is older than me. I think my parents are stuck in a time warp: not dating someone because of their GPA is beyond pathetic (and my girlfriend is very smart too!). While my passion is politics and hers is music, we still have loads in common (eg movies, restaurants, good food, health & fitness, travelling, similar careers) – we’re crazy about each other and talk about each other constantly. Her parents are a bit weird, but my parents are just as weird in their own eccentric and old-fashioned ways. They’re also very culturally conservative, so they don’t understand practical jokes at all – we make practical jokes all the time on each other (eg she created a fake newspaper article that the company I’m working for has gone bankrupt and must sack all its employees), it’s just they see the ones she plays on me but I don’t tell them the ones I play on her because they’d berate me for it (eg pretending to be questioning my sexuality). And despite her being a whole 18 months older than me (shock horror! lol), my parents are absolutely adamant that men should only date women younger. I think my parents are just really old-fashioned and stuck in their ways, but I still feel the need to please them (as stupid as that sounds). I love my girlfriend and we’re definitely moving in together, no questions asked, but I wish my parents approved! How can I win over my parents’ approval? More to the point, how do I move on without their approval?

I need about ,500 in the next few weeks to pay for my summer classes and rent. I have already reached my limit for federal loans (FASFA). I can not get any more from the government in stafford loans subsidized or unsubsidized. I do not qualify for any grants ( Pell Grant, etc.)

My parents declared bankruptcy, so they cannot cosign for me. I have terrible credit myself, about a 530 credit score. I talked to the financial aid office at my school, and they told me my only option is an alternative private loan, i’ve applied for a few and was turned down by all of them. Are there any other options?

NOTE: I’ve already been turned down for the Parent PLUS loan, which raised my limits for stafford loans. I have already reached that raised limit.

I have debt that may total about 00 but i live pay check to pay check and just found out i am pregnant. i have not paid any of this for about a year or two. trying to get my life back in order before the baby is born but was hoping to settle my debt. I had 3 credit cards one for 300 and one for 700 one i only owed 80 dollars on but stopped receiving bills, i also owe a bank money to just not sure how much. i couldn’t make the minimum payments anymore. lost the place i was living at and everything. finally getting my life in order but at my whits end. and advice would be great

I have a Citi card with 3K debt. 2 years. For 1 year, payments were on time and above minimum. The account is now closed.
I have a Key card with 5K debt. 6 years. For 5 years, payments were on time and far above minimum. The account is open and on a payment plan.

I was out of work for over a year which is when almost all of this debt was accumulated. I eventually had to move across the country to move back with my parents. I now have a new job in a with an expensive (0/week) and long (4 hours/day) commute plus low pay. The job is in NYC and I can’t find a decent place. I’d like to settle with Citi.

Nothing is in collections though the Citi could be soon. I’m now looking for jobs abroad and want to sort out everything before leaving. If they were to attempt to garnish my wages, they would get a lower amount than I am willing to pay. 50% of my income (2K/month net) is going towards paying my debts (I have student loans as well). 30% of it is going towards getting to work. I hope it never comes to this.

I want to settle this by the end of April 09. How do I go about this and what impact will it have on my credit (I will probably return to the US at some point) and what else does it entail?

I am very nervous about what can happen to my home. I am waiting for a closing date as my parents gave me money to purchase a modest home. I am married and my husband and I need to file bankruptcy. We lost our home to forclosure a few years ago, lost our vehicles and had some credit cards. My parents want to see me enjoy part of my my inheritance now and I also have health issues that allow me to only work part time. My parents do not want the home in their name as they do not want to pay Insurance and taxes among other reasons. I have heard of many people owning homes and filing chapter 13. If this is the answer do you think we need to do it soon so the courts do see that we are trying to resolve the issue after recieving this gift? They will also see that our hardship and loss was due to my husband being in the mortgage industry and my health issues.

We had put down a chunk of money for escrow. We were to close a few weeks ago until Fannie Mae said that they need go over the homes forclosure papers. Something was not done exact. I and Fannie Mae signed an extension. Can I back out of the deal and do the bankruptcy then look again for a home again? Or, will I lose the escrow money which my dad would kill me for that. That is my concern now?

I am 22 years old and have ,000 worth of credit card debt and ,000 in student loans that I have to start paying off in 2 months. I talked with a credit counselor and asked him his opinion whether or not I should do the program or declare bankruptcy. He could not give me a specific answer, but he was leaning towards bankruptcy.

I just graduated college and have a job making very little money and paying off the debt is going to take me over 10 years because my monthly payment (with the credit counselor) is very high. I know even if I continue with the credit counseling, it will still hurt my credit.

My parents declared bankruptcy 5 years ago and had no problems getting a new car and built a brand new house with an average interest rate. I know some employers look at credit reports, but credit counseling will affect that anyway. I just want to start over and need some advice. I appreciate it!!

What is the best way to settle on tax debt? As in settlements for paying less then what you owe.

My parents made bad decisions young in there life and had a HIGH credit debt, to get out of it my mother worked a full time job and a part time & my father for more than 8 years had two full time jobs just so they could clear all that debt. Within the past year they got it down tremendously and for the first time in years my parents oonly have to have one full time job. But now because they were making more money the IRS came in and wants 30k of it. They just got a letter saying th IRS is going to start taking money from there bank accounts.

If any one has any advice please let me know, it is greatly appreciated!

My mother and father agreed to let me move with my aunt and uncle BUT then I found out my aunt and uncle had money issues and can’t afford to keep their house due to the house they live in is owned by a bank which got bankrupt so now they’re struggling to live there and it happened before but I don’t know how they still lived there. I understand this entirely. I’m selfish but what would you do if your expectations didn’t reach up to it’s limit?

1: Considering the fact that I was suppose to move I had to QUIT FOOTBALL. This is BS. Now since I quit football there is NO WAY, NO WAY I’m going back there to show my face and there’s no positions left open aside from being back ups AND I missed too many drills. It’s too late now…forget it. I am not embarassing myself and going up there.

Due to my parents and my aunt and uncle bs’in me completely and making me lose football (due to their bs expectations telling me how i was going to move with ‘em and to quit football and pack my things) I now have nothing left. I filed personal chapter 7 bankruptcy in 2007.
I now own a business, a daycare, that is failing due to so many parents being out of work.
Is Chapter 11 the proper bankruptcy to file for this type of debt, and if so, am I eligible?

This girl and her family own a ranch that they do lessons with. But they are going bankrupt and they have to sell their three horses and their ranch. The first three books (I’m not sure how many there are now) are told by the girl and are about finding the perfect home for each horse. The cover is a picture of the horse that they are finding a home for in the book. The girl doesn’t want to sell her horses, of course, but in the third book, her parents and her move into a new house with the third horse as a surprise for the girl. Here is the situation, my wife and I are married and she is petitioning me to be a US citizen. We filed I-485 (Application to Register Permanent Residence or Adjust Status. USCIS send me a letter that requesting us to submit I-864 Affidavit of Support. I used my wife and one of my close friend to be my sponsor but their income does not meet 125% of poverty line (which is about K) since they are both students and do not make that much. We are really stressed out because it seems no one could help us. Is there any alternative way to find an sponsor? If I can provide a statement from my employer that showing that my estimate annual income is above the 125% of poverty line, will that help?

Also,my wife’s parents agreed to help us but they are also in the process of filing bankruptcy. Will that affect their process? From what I know, the I-864 is an agreement between the sponsor and the US government saying that if the immigrant (Me) can’t not support himself and need to take social welfare. The government may ask the sponsor to pay for it. So in theory, as long as I have a job that can support myself. it should not affect their bankruptcy process right?

Ok so me and my friend went to the same school. We both got the same loan. We both got it co signed by our parents.

We also both have been paying the minimum payment cause neither of us makes enough to pay the whole thing off. Her debt was up to 8k from 6k. Same with me. But her dad just paid off her debt for 3 thousand…..

how does that happen? I have money in the bank i have been saving for a car. If i used that money could I do the same thing she did? Where does that missing money go? I"m confused. How do loan companies stay in business if people can settle their debt for like less than half? Her parents are rich too it’s not like they couldn’t pay it off. I thought that loan companies only settled debt when someone was delinquent.

My husband fell 6 months behind on a credet card bill. The account was turned over to a collection agency in Texas.After repeated phone calls to both my husband and his employer. My husband called the CA and asked them to stop contacting third parties. He tried to make arrangements to pay the debt. He was not able to come up with the sum that they wanted so the calls continued. They called us numerous times. Sometimes 10 or more times in one hour. They continued to call his employer even when the employer asked them to stop calling. They called our neighbor, parents, and siblings. I contacted them and made arrangements to pay the bill in monthly enstallments. Two payments have been made as agreed. We have not missed a payment. Yesterday I was contacted by them stating that if I couldn’t settle the debt that day they would send a 1099C form to the IRS. Claiming that my unpaid debt was considered nonwage income even though I was paying on it. they also called a third party this same da
We still are not sure how they got our neighbors address. We hardly ever even talk to him. I don’t even know his last name. All that we can figure is that they looked up our address and then did a search on our neighbors address to get his contact information.

What really gets me is that they are continuing the harrassment even though we are paying on the debt. I could see if we had missed payments or something but we haven’t.
The 1099 C form doesn’t even apply to my debt. They were not offering to eliminate the debt. The lady who I spoke to on the phone tried telling me that if I didn’t pay the debt that day she would file the form. When I spoke to the manager and asked him about the form he told me that it was used if part of the debt was written off and did not apply to a debt that I was paying. He is looking into the matter to find out why she would tell me this. It felt to me that she was just trying to bully me into paying it that day.
We have the payment details in writting and have made payments as agreed. We are sending a certified letter tommorow to stop contacting third parties as they are not doing so with any intentions of finding out contact information about us. They already have our information.

I owe about 15k of debt I am slowly paying off. I have NEVER been late on my bills but I have been receiving offers and solicitations from these debt settlement agencies. I never called any debt settlement agencies before. How are they getting my information? Is there a way I can opt out ? I don’t want my parents do freak out when they find out I owe that much on my credit cards.

So this guy wants to sue me for defamation. But i havent received his lawyer’s letter. Once i received any letters asking me to appear in court, can i immediately empty my bank account and keep the cash at home. so in the case i go to court and lose , i will just have to declare bankrupt but he cant take my money.

seeing how the courts nowadays tend to award sky high amounts of money for defamation, i definately would lose all my money if he wins

or will the courts check my bank account and question be why i took the money out etc. This is if i empty my bank account BEFORE filing bankruptcy or even appearing in court to face trial for defamation.

will this work to save my money?
i got not much other assets he can take them if he wants to , its not worth much

if i withdraw my bank savings and keep it at my parents, its their property. so even i am bankrupt they cant touch the money as its my parents, am i right?

or will they check my account and find that i withdrew money and force me to pay up. this is if i withdrew the money at the first lawyer’s letter i get, once i get a hint there is some legal action being done the savings are going to be all WITHDRAWN and kept under mom’s pillow

well if i am bankrupt, then i wont have to pay a single cent to no one thats the law isnt it? i dont care about being bankrupt, i just want ot keep my hard earned savings, which happens to be quite alot

I currently owe 00 in hospital bills. But have no way to pay them off. No one in my family has much to give, even if they were willing to help out.
I am currently 24 years old, with just a part time job, making very little money. I was thinking of moving back to the philippines where tuition for school woud be cheaper, and i can get a degree in nursing.
I’m trying to think of what the best thing for me to do is.
What are the disadvantages of filing for bankruptcy?

I need to do more research on bankruptcy, how much would it cost me to file, for 00 medical bill?

I really want to buy a house in the future, hopefully before age 32, but how hard would that be if i’m in bankruptcy?
