So, I recently (a couple days ago) was served with court papers, I am being sued by a hospital for ,000. I have about k-100k in medical bills alone, so to avoid paying the ,000 I know I should just file bankruptcy. Today I had a consultation with an attorney, and I am SO confused still. It was a free 30 minute one, so maybe that’s why I felt really rushed and lost…but anyway. It’s going to cost about ,500 to file. I am a 25 year old BROKE college student who works part time at a retail store, this is a lot of money =/ ….I know it’d be easier and for sure would get the papers done RIGHT, if I had an attorney, but I don’t know if I can afford it. I know you can file yourself. Has anyone done this? My sister got a paralegal about 5 years ago, and filed herself. She said it was about 0, but she said the paralegal was helpful in helping her with the paperwork, BUT she did miss a few things. I feel like I’d be paying the lawyer to basically just go to the court and turn in the papers, and come with me to court. I still have to do all the dirty work of course…gathering my bills, filling out all the paperwork, etc…but I’m not sure if ,500 is worth having an attorney. Also, I am confused on this court paper I got. I know that they will eventually file a judgement against me (within 14 days) and start garnishing my checks, I understand bankruptcy can stop this. But is it only after your papers are completely filed and done? Or is it when you START the process? I am so lost! The attorney told me to try and get all this paper work gathered and figured out before 10 days so we can start it before the creditor starts coming after my money through the judgement. Does anyone have any advice? Thank you!

I am getting phone calls from a place called Federal Check Processing System. They claim to be associated with the government, yet the email they sent said they are a debt collecting system towards the bottom. It is because of an unpaid payday advance loan and I am trying to collect the funds to pay for it, just struggling. I only work part time and make around 0 each paycheck which is only every two weeks. They are asking for payments of 9 but I cant do that. What do I do? Can I offer them what I can pay? If I pay, will they settle? I am really trying.

Okay, this is extremely frustrating. I’m a 19 year old student, who works part time. I have all-state insurance full coverage, and I drive a 2001 toyota tacoma, which is paid off. And guess how much Allstate charges me every 6 months? 0!!!!!!!!!!!! That is absolutely ridiculous. These son of a bitches are totally ridiculous charging me that. I’ve never had a ticket, never been in an accident. And I don’t care if i’m 19 that price is absolutely absurd for that car. I’m almost at the point where I just wanna go illegal and drive without insurance. I’m looking sleep every night over this I mean seriously do they think a 19 year old college student is made of money. And the funny thing is it’s under my parents policy and its this much!!!

Beside the fact of me being told I have 3 days before I’m being kicked out the house, the b1tch that’s kicking me out is forcing me down the military route, my original plans were going to Bethune but I literally have the most uncooperative parents ever,the tuition is high, and that’s school is VERY family oriented.my parents would rather smoke w33d or watch "All My Children" before it gets canceled and judge me like I was the reason they are miserable.Brief financial and current situation. . . Father is ex military,literally f***ing psychotic(surprised one of us aren’t dead in all honestly) does get a retirement check but most of that is garnished from child support (bastard child). Hasn’t had a job in 2 years and they year before that he literally had 4 different jobs(quit them) and the job he has now is a entry level job scanning papers into Xerox machine part time (really hard huh?) and wait this is the best part . . . my mom helped him get that job . . . working in the same building. My mom’s job is fairly decent, credentialing specialist, nothing close to where she should be getting for her degree, but that’s another discussion.. They have been in Bankruptcy twice and have been kicked out-TWICE!!! (and they still have the nerve to criticize me on my trivial choices)Meanwhile I scored a 74 on my asvab (i know its average) and I been going back and forth to the recruiters office discussing certain things about the Navy and what they can do for ME. They can’t offer much but I’m very limited on choice so the Navy is where I’m stuck on going. The big discussion that me and the recruiter(s) have is ultimately is that , is this my choice on going or not.I truly don’t want to go to the military,I’ve been told I have a good foundation for it but I shouldn’t go because I just don’t want to go and I have no drive whatsoever to go in enlisted. They tell me I will be miserable. I’m going to be kicked out and soon anyways but whats the point of going into the military if i would probably get an ELS (if you don’t know what that is, you shouldn’t even think of giving me an answer anyways) But if I don’t go, I’m going to be homeless soon (that’s is happening regardless)
So I need alternative options (no snarky or just plain irrelevant remarks please!!!!!!!!!!!!!!!!!)

I have been trying to teach English here in China for the past 2 years. I’ve encountered a range of problems and found it difficult to keep employment. Once school fired all the teachers, ripped us off then went bankrupt. Other schools have kept me on for a few months and then turned around and found a better teacher because they don’t like my teaching style. The latest company let me go because they were restructuring and downsizing. I was the unlucky one who didn’t have a relationship with the boss so I was the first out the door. The alternative was only a couple of hrs work each week – changing me from full time to barely part time.
So, I have given up on teaching. I think I’m OK but not good enough to maintain a decent career out of it. ESL teaching is difficult to earn money in. Now that I am married, I want a better, more stable job and a different career at home. We were both planning to move back to Australia to live.

She has said some really hurtful things and has been withholding the sex like she doesn’t want to be with me anymore. I’ve questioned her and she tends to close up and when pushed, says she’s not happy, she’s bored. I get upset, she sees that and says that we will be together forever and that she still loves me. I doubt it though by the way she looks and acts now. She told me to be a man and go back to Australia and set everything up (we were only 3.5 months away from moving back).
I’m reminded about how at this time I cannot afford the diamond ring. Also, despite my wages being enough to pay for everything and give us enough money to go out, it hasn’t been enough to save for a honeymoon. We only got married last month. I told her that my work prospects are so much better in Australia but she finds that hard to believe – I didn’t have it in me to change enough to grow and become a good teacher so apparently that reflects on my ability not to change overall.
A bit of history about my working life in Australia: I graduated uni about 1 year before coming to China. I worked for 4 years in a supermarket and became a manager. They wanted me to stay and become a trainee department manager. I had a lot of potential. But it seems that I lost all of that potential when I came here to China. She has just seen all of my failures and compares that against her own successes and the successes of other foreigners who have done well here.
It’s really hurting me to see her become so scathing and nasty and unloving. I told her that it’s worth banging my head against a wall with these jobs for a few more months so that we can still be together (albeit not much because she is busy with her overseas work) and leave the country together. She says that if she had more money and was more successful in her work, she’d leave with me tomorrow. But thinks I should give up the struggle of teaching and just go back and set things up. I’m about to do that. Three months is not long.
But I still feel the sting of her disappointment in me. It’s like something has changed and she can’t see the good in me at all anymore. So I think what’s the point of going home and getting established if she no longer has any feeling for m? She might turn around and refuse to come in a couple of months time. Already I think her mind is definitely changing. She’s not interested in the wedding and when I asked about us going back to see her family one more time before we leave, she said she said I wasn’t welcome in her home anymore because I stay there and get fed like a king instead of working hard. That I should give something back to her family…
So, she is bored, disinterested in me and behaving like she wants me out of her life. Should I return home and get established and forget about her? This is not the departure I had hoped for. I think she kind of resigned when I said I found more employment here and could be earning more than the last school. She’s already told me my teaching is at ground level and I’m a loser – meaning no good at teaching.
It’s really cruel for her to say these things and feel so disappointed as far as I’m concerned because I stayed on longer and pushed through because I wanted to be with her. I could have left about a year ago…My parents wished I had and set myself up with a job and car. Instead, I either leave now or find work here. Last night I had a dream about her being romanced by some other guy. She was really into it. She’s not being intimate with me and looking down upon me.

I am very nervous about what can happen to my home. I am waiting for a closing date as my parents gave me money to purchase a modest home. I am married and my husband and I need to file bankruptcy. We lost our home to forclosure a few years ago, lost our vehicles and had some credit cards. My parents want to see me enjoy part of my my inheritance now and I also have health issues that allow me to only work part time. I know I need to contact an attourney but I dont have the money for that yet. We are still renting but will be closing within the next 2 weeks. What should we do when we file? Again, the home will be only in my name which I am not sure if this will help or not. My husband has some personal credit issues and I as well. But, most of our issues are together. We believe we should file a chapter 13. He is a school teacher and I am a part time self employed music teacher. He also owes a lot of money on student loans from getting his Bachelors degree. I am 51 years old, am very grateful to my parents yet very nervous about losing my home. Thank you !
My parents do not want the home in their name as they do not want to pay Insurance and taxes among other reasons. I have heard of many people owning homes and filing chapter 13. If this is the answer do you think we need to do it soon so the courts do see that we are trying to resolve the issue after recieving this gift? They will also see that our hardship and loss was due to my husband being in the mortgage industry and my health issues.

We had put down a chunk of money for escrow. We were to close a few weeks ago until Fannie Mae said that they need go over the homes forclosure papers. Something was not done exact. I and Fannie Mae signed an extension. Can I back out of the deal and do the bankruptcy then look again for a home again? Or, will I lose the escrow money which my dad would kill me for that. That is my concern now?

What is the best way to settle on tax debt? As in settlements for paying less then what you owe.
My parents made bad decisions young in there life and had a HIGH credit debt, to get out of it my mother worked a full time job and a part time & my father for more than 8 years had two full time jobs just so they could clear all that debt. Within the past year they got it down tremendously and for the first time in years my parents oonly have to have one full time job. But now because they were making more money the IRS came in and wants 30k of it. They just got a letter saying th IRS is going to start taking money from there bank accounts.
If any one has any advice please let me know, it is greatly appreciated!

This is quite a story !!
Back in July 2007 I was working for a small heating business. The owner at that time also had a large profitable business and I had been led to believe that he purposefully made it look like the smaller business hadnt made a profit – for tax reasons I believe.
Now this chap had become a friend after working for him for a few years and he asked i I would like to take the business on so that he could follow other avenues. He showed my figures and made be believe that the company was profitable (I was young and naive) so I took on a £25000 loan.
To cut a long story short he said to me that I did not need to pay him until the company made a profit and to keep the £25,000 as working capital. The trouble is the overheads were so high that it never made a profit. I tried moving premises to work from home and also made the office girl (his daughter) redundant but copped for paying her redundancy (3/4 yrs worth) even though I’d only ran the company for around 8 months. Also to give you an idea she was on £16,500 for part time hours (one of the many overheads !)
Any way after just over a year the business had swallowed my £25,000 and I’d spent my savings (circa £7,000) on wages for myself, so I shut it down and sold the assets (4 vehicles, computor, small amount of stock)
I’m still paying the original loan as I refused to go bankrupt (like an idiot !) and still have 5 years left.
I recieved communication last year from the bloke in question saying that the time to pay had arrived and that I owed him £20,000. I emailed him about the trouble I’d had, the verbal agreement about paying him when the company made a profit and the fact that we had no written contract. He never replied.
He has now contacted me again, apologising for the 14 month delay in coming back to me and stated that I owe him £18,000 unless I want to settle the debt privately, in which case it would be £16,000.
The thought of taking another huge loan scares the crap out of me ! I’m now 29 and only just getting myself straight. I have no mortgage and a car on HP.
Do you think I’d have a case if this went to court ? I’m going to see the Citizens advice bureau as soon as I can as I dont know where to turn or what to do next ?
It has crossed my mind that he’s waited this long so that some of the records are now no longer ‘available’ although I dont know the ins and outs. How long can he chase me for ? I fear that I could be taken for theft as I sold the assets (although the vehicles were transferred to me) ?
I guess I may just have to take the loan ?

I had 14 different credit cards charged off 2 years ago for a combined ,000. The statute of limitations in CA. is 4 yrs so after 2 yrs i finally got a letter from an attorney threatening Litigation for one of the accounts of ,000. Should I just file ch. 7 BK because if I pay this account I still got 13 other accounts to worry about ?
BTW I only work part-time & berly support myself & dont have any assets so i dont want to get garnished..

After credit counseling filing chapter 7 has been recommended since I am on disability and working only part time. Problem is attorneys I’ve contacted want 00, 500 upfront before they’ll even submit the paperwork. Obviously I do not have this. Legal aid is not available in my county or city for bankruptcy. Can I just get the paperwork from the clerk of courts and do it myself?

I’m 22 years old. I’m a college student. I am in 20,000 in debt. The creditors are constantly calling me. I only work part time. I’ll be in school for the next 6 years due to me getting my M.D in Psychiatry. I am stressed out and I think bankruptcy is my only option.
Note: These are not student loans, i only have 6g of student loans. My debt is from credit cards and loans, thats it, my student loans are not part of it.

I’ve recently been contemplating filing for Bankruptcy (Ch. 7) because I am in so much debt it hurts my brain to even think about it!! I am currently over k in debt. Most of the accumulated debt I owe is from past bills I ran behind on due to some unnecessary circumstances. Right now I am attending school full time and working part time making a measly 20/month as my take home pay. With my salary I pay for all the usual bills: rent, utilities, wsg, car insurance, car note, and use whatever I have left over to pay down my debt. For the past year and a half I haven’t opened any new credit accounts and I’ve been on a tight budget. I take full responsibility for all of the finanical debt I put myself into but am stressed and afraid that some of the creditors I owe will soon take legal action (as some have stated in their threatning letters). I’ve attempted to set up payment plans and have tried to negotiate a reasonable payment plan with my creditors but even with some agreeing to this others are not as willing. I am just seeking some advice because my credit is already horrible and even if I decide to paydown my debt it will take well over 5 years relinquish. I figured if I file for Chapter 7 it will stay on my credit just as long as if I tried to paydown all my debt on my own.
Big T: THank you very much for the advice and the many suggestions. I have been trying to stay optimistic about the whole ordeal and I have to give it up to you because I understand first hand how hard juggling work and going to school full time can be. I understand my debt is nothing compared to others but it is still a debt I have to take care of. I appreciate the encouragement and will look into other wage earning opportunities and try other ways to cut back!
Barnaby J: Thank you, I didn’t really factor in my wage earnings after college because they are still unbeknowest to me. (maybe if I looked into a crystal ball I’d know for sure..lol) But, since you have mentioned it I am predicting my salary wages will increase quite significantly after college which will help me drastically in cutting my debt!! I know this may be rather irresponsible of me but I have backed myself into a corner and I see no escapes other than declaring chapter 7. If I never would have financed my car (at age 19 now 22), then I would not be here asking about it. I still have 3 years left of payments on my car and insurance on top of that plus living expenses. I DO NOT wish to work full-time like I have been for the past 3 years because I want to just focus on school and not worry about bills. I only work part-time now and my income does not meet my needs. I figured why not since I won’t be buying a house anytime soon. I plan on saving up for a cheap car (about 2 grand) to have until way after graduate school and an established career. I was very naive and ill-advised a few years back and would rather suffer with a bad credit report now than deal with the bills and be forced into full-time work again. Please, I need some honest, sensible opinions. Thanks!

I had filed bankruptcy 4 1/2 yrs ago and was approved. The I got back into debt because of unforseen occurance befell me. I have medical bills that need to be paid, I have students loans I need to pay off, but are on deferment or forberance, and interested has accumlated, I got laid off my day job, working part-time evenings (14 to 15 hrs a wk, 7.50hrly) been looking for fulltime work for 2 mths, tried filing unemployment, owe the bank 0.00 because my accnt is a negative, I am behind on my gas utility bill, my car is in the shop for the 3rd time in 4 mths. Spent already 790.00 total in last month on car. Yes, I live by myself and have been looking for a roomate, because I can’t afford to renew my apartment lease when I’m not making enough money to pay all my expenses. Would I still be able to file bankruptcy with out any hassles? I want to file Chapter 7, I just don’t see any other way out right now. Please give me your answer…….

My daughter was seriously burned and nearly died. She is having numerous surgeries. Now, she is having a reconstruction of her windpipe. She was taken off medicaid because her twins turned 18. She applied for Disability and was turned down. We got a lawyer and were told on April 5 that a determination had been made but it was under review and we would know on April 14. When I called (my daughter cannot speak), we were told that her husband had to send in pay stubs from June 09 to March 10 and we would hear in 15 days. Meantime, the hospital wants to know who is paying for the surgery? I am putting out 0 a week and I am ill and can only work part time ( I was paralyzed with Guilliane-Barre last year.)I am going bankrupt. Why are they stalling when this is a life or death matter? Is there any suggestions that I can do?
Why did they say that a determination had been made and that it was under review and we would have an answer by April 14. They lied. Then wanted more information that they should have gotten before.
If my daughter had money to put out for medicine and surgeries, she would not be asking for SSI. She has no money at all. Without her medicine she dies
I think that Social Security is stalling because the think she will die and they will not have to pay,

I am looking to file bankruptcy after a long medical illness. (I was working 2 jobs to pay off my debt, because I know I AM responsible for it). Now, I can not work 2 jobs, only one, part time at that. I have saved up a lot if my 401k. Can the courts touch that if I file bankruptcy?
