of my paycheck. He is now dying. Should I file bankruptcy for myself, jointly, or not at all and collect the ins and pay my bills only and of course the joint ones. I live in Arizona and we have some joint accounts and some non-joint accounts. We are filing bankruptcy with our house because we are seriously up-side down., should I do this or let them forclosure? We are only a few payments late so there are no proceeding started. They still want me to keep the house through home retention, but their offer stinks. HELP, HELP, HELP

Is there any thing I can do after my creditor already garnished my paycheck? I can’t keep up with the payment because I don’t make enough money. Can any lawyer help me to nogotaite with the collection agency to possibly settle my debt in reduced amount?

I am getting phone calls from a place called Federal Check Processing System. They claim to be associated with the government, yet the email they sent said they are a debt collecting system towards the bottom. It is because of an unpaid payday advance loan and I am trying to collect the funds to pay for it, just struggling. I only work part time and make around 0 each paycheck which is only every two weeks. They are asking for payments of 9 but I cant do that. What do I do? Can I offer them what I can pay? If I pay, will they settle? I am really trying.

The chapter 13 takes alot of my paycheck and I want to go back to normal bills. My percentage rate on my home is 13.50%. That is crazy. I know there is enough equity, so that is why I want to get the "13" off me and reduce my percentage rate. Hopefully there is a financial institution that can help me. Any suggestions???

Like most people, I also have my debts to pay after graduation. I am a fresh grad and the government has been asking me to pay my loan even before I get the chance to earn my first paycheck. Is getting the services of a debt settlement company a good option?

I had unauthorized deposit to my account. earlier this week I had my account overdraft because I paid my insurance company and they took more than they were supposed. I told my mom to ask her for help and she was furious saying that it is my fault that i will go bankrupt and I will never recover from this. Now I have deposit that I don’t know what it is from and I googled they name of the company and it is a cash loan company. I want to close my account, but I am afraid I will not receive my paycheck because my company I work for requires direct deposit. So what do I do? How do I make sure I get my money.
I feel horrible my mom is going to make remarks and say i deserved what I got. I am 27 and wants me to report everything I do to her. She told this is what happens to people like me. I am not a bad girl at all.

First and foremost I want to say thank you for all answers I recieve. This is obvisously not an easy time in life and all answers are carefully read, as I hope that you take into consideration all that my situation entails.
When I was 19 I set out to get myself a great credit score, something both of my parents could never do. And I did, I went through my credit report took off somthing that my dad had put in my name as a kid and got my first credit card, making on time payments and just having a balance of on the 0 limit. Well, then I, after my dad moved and other bad things happened in life (theres a long story there) I kept getting more and more cards I think trying to distract myself from my situation at the time. So I eventually realized that crap I was in a lot debt (00) which on my Starbucks paycheck of 0 bi weekly and rent in Detroit and car repairs, I was already making minumium payments so I moved to Charlotte NC to stay with my mother and pay this off. I got into debt counseling (which I feel was a mistake) I reduced all my payments from 0+ a month to 200. Well now I live in TN where the taxes and cost of living is lower. I sold my piece of crap car for a whooping 0 after it broke down and my gf and I have been sharing her car for the last 4 months and the budern as been great on us both.
Now I find myself so stressed. I let my dad use my eBay account after he lost his job so he could start making money to help himself live, but he sold stuff he didnt really have and now my paypal accoutn is at -00 and he hasnt paid on our cell phone plan (which is under my name) going for a total of new debt thanks to my dad (this is all dad related) to 00.
Well My credit card debt hasnt moved too much. And heres roughly where I lay now:
-00 in credit cards being paid off through credit counselling
-00 in medical bills I havent even touched (oh and I dont have health insurance either I took another job that promised more money but turned out I dont get medical for another 6 months)
-00 because of my dad and my sere stupidity
-00 in student loans (which I know cant go away with bankruptcy)

I make 12000 a year and I cant just get another job because I dont have a car and my gf and I share one. I never thought I would consider this move but Ive tried for years now to do it the honest and hard working way and its gotten me nothing.

I know that filing that would mean I couldnt get a car loan and some places wouldnt hire me but trust me that doesnt seem like a bad sacrifice even though Ch 7 would be on my record for 10 years. And once again thank you!

My boyfriend of 2 years just moved in with me from another city and we’ve talked about marriage quite a bit; however, we have different views on spending money. I’m a saver/invester (life insurance, 401k, just bought a house and fixing it up to increase resale) and although he doesn’t blow his money, he isn’t saving for retirement (i.e.401k) and is carrying 4k of credit card debt that he’s slowly paying off (he isn’t using his CC anymore to avoid building the debt) He pays all his other bills, though, including 15k of student loans.
I wouldn’t say he’s not responsible, but he doesn’t appear to see the importance of saving or taking care of his debt (or perhaps he’s avoiding the hassle). He works from home as a freelance writer and makes decent money, but he doesn’t have the option of direct deposit and gets no employee benefits like a 401k to make it easy for him to put the money away before seeing it in his paycheck. And now that he’s saving by living with me, he appears to be spending money on other things (not like crazy, but enough to notice) when (I think) he should be paying down his credit card debt.
I’ve brought up the topic, but only in a half-joking way that probably comes across as condescending, but I don’t know how else to approach it. Getting engaged is probably going to happen in the next 6 months, but I honestly don’t want to start planning a wedding until he gets his financial ducks in a row. Since I don’t have a ring on my finger, I don’t feel I have the right to say what he should/shouldn’t do with his money, but at the same time I’m taking mental notes of how it could delay the next step in our relationship or cause problems down the road. I want to bring it up with him now so that he’s at least aware of my concerns so I can avoid being condescending, but I’m not sure how to approach the topic without him getting defensive.
Other notes: I’m 28, he’s 29. My parents raised me to be very responsible with my money. I don’t know how his parents mentored him in money management, but I do know when they divorced when he was 16 they both went bankrupt, even though they lived comfortable previous to that. I came from a wealthier family, but that’s only because my parents worked their butts off and saved whatever they could. His parents are great and also worked hard for their money, but I don’t think they were ‘planners’ when it came to what they made.

I’m married but filing for Chapter 7 myself, not joint. My wife will be getting tuition reimbursement in a paycheck coming up. Can this income be deducted in the Means Test? Should we change her direct deposit so that it gets deposited into her personal checking account without my name on it? I don’t want this income to count against me as it will be used for her class tuition. Any help on this would be appreciated.

I know Im a jerk i dont even know what to feel. how bad did i break this girls heart?
this girl is beautiful inside out, trusting, kind to everybody and alot of people take advantage of that including me. prior to meeting me, she was raped by 3 guys.
we are highschool sweethearts. im a player ignored her, treated her like crap, used her for sex and money while having other chicks on the side. she was always kind to me, by my side when i went bankrupt, bailed me out of jail and always, always there for me. one day I realized i loved her and asked her for marriage over and over, she turned me down every time.
Finally she broke up with me, cut contact for nearly 1 year. I missed her but then i fell in love with another woman K. However, 6 months ago i found her on facebook. she sent me a message to "let it go" but i insisted to talk, lost in the moment i confessed my undying love to her. Bam then i was on two boats, i kept her on the side as a "bootycall" but led her on with forever promises.
During this time, my businesses went into debt. this girl took out 00 student loans without asking for it back to help me. gave me her paycheck when my family was in trouble. so i kept leading her on with sweet words till one day she discovered about my cheating. then i disappeared with the other woman K without an explanation.
she was outrageous and sent me many mean messages, then yesterday I got this,
"I sent you many hurtful messages because I was in pain. I never blamed you for loving someone else, we don’t choose who we love. But I can never forgive you for leading me on for sex and money. I truly loved you even when you were broke, sick, selfish and manipulative. You were my first love, I loved you with pure, pure feelings for who you are. When you don’t feel the same, you should have just walked away. When people use me for a few days, a few months, I can just say fuk them. But you, a man who "loves" me, who knows the person I am, the kind of love I had for you, played me for years and years, is unforgivable. I will never forgive you in this life, and life after life. You have hurt and scarred me for life. If everything is a game for you, then you won".

All payments were made on time through garnishment from paycheck. Late payments were posted in 2007-2009, but I filed in 2006. Is it even legal for them to post late payments while in Chapter 13.

Hi every one, hope you all having nice weekend!
I have recently done my credit check for some thing, and i found out how bad my credit score is. I mean when i was teen and few cards were stolen back in 2005, my credit got bad:/ and i didn’t make payments on time. Plus i have one medical bill from 2003 and Fitness center bill.
*So all together my total collection balance on my credit report is ,030.
Which i should pay, and even with bad economy and having less money and more bill, i can try to add this bill to my paycheck too. But i need some help from ya all. If i can get any toll free # to collection dept. Or how do i contact them. I have no record of previous bills or statements. All i have is Credit report from TransUnion.
Any help will be greatly appreciated.

I did report the cards, that were stolen. They got stolen at Theme park, i was young and frighten cause that never happen to me or someone i knew. The security at the theme park helped looked but nothing. :/ i did called c-card companies the next working day and canceled the cards. There were few purchases made. I paid for couple, i was student at that time, not enough $$ plus i procrastinate too. But now i want to pay it all off to fix my credit.

I work for a company that’s a not-for-profit medical provider (any "profit" at the end of the year gets divided up and paid to the doctors as "bonuses" so the balance is always zero).
I’ve never had any Security Security tax withheld from my paycheck, nor paid by my employer. When I asked why, they said it was because they were non-profit.
My worry is that this might affect how much Social Security income I’m entitled to when I retire (please save the jokes about SS going bankrupt before I can collect…)
So, is what they’re doing legal? If not, what should I do? (My big concern is that, if it’s reported, SS will demand all the employees to immediately pay up tens-of-thousands of dollars in owed back taxes!)

I have a credit card that started charging me 30% interest two years ago. (I have good credit and was always on time). I pay them about 0/month for the past two years, haven’t used it, and they say I have 0 available. I have a chunk of $ to offer them to settle this and close out the account. I am not delinquent on the account, but there are a lot of months I am borrowing against my paycheck to pay it. If I couldn’t do that, i’d be delinquent. (Like everyone else, I’m just being squeezed to death by the economy and am feeling the strain).
I’d like to call and offer them 70% of the amount. I feel they’ve gotten the rest of their money and more in interest alone. Would it be possible for me to get anywhere with them at this point?
How do I go about doing it? (If you’re going to give me a lecture, please don’t bother, I’m just looking for some info.)

Schools, the food market, everyday people, planes… Everyone is being effected.
Screw that gas tax holiday, what will we save? 13 cents a gallon while it slowly raises to five bucks a gallon?
Even ASE are being looked at. Many independant companies asking them to use their skills to figure out something. There are predictions going around that we’ll have a major bankruptcy wave, then gas prices will finally fall in about 8 years because of alternative energy sources…
And during all this Exxon Mobile… Who has nothing to do with the prices, so they say, are making even larger record profits than last year, even when gas sales are down.
Oh I am very ungrateful when 25% of my paycheck pays for me to go to work.

I have around k in debt. The debt is all personal debt and there are no co-signers nor assets in question. As for my personal assets, I don’t believe I really have any. My car is eight years old and I live in an apartment. I was considering filing bankruptcy before I begin a new job and get better pay (therefore, they do not see a bigger paycheck and feel I can pay back my loans).
So, the question is, what bankruptcy should I do if there are no assets which can be liquidated to pay back my debtors?
Funny how many people jump down someone’s neck when they talk about bankruptcy. I guess Enron, K-Mart and others are fine, but regular humans are not? Get a life, people…

What is the process for debt settlement? I understand that when ur sent to collections ur able to settle the debt with them for a fraction of what u owe. But before that, will u get harrassed by all the calls from the bank about the missed payments? Can the bank sue u? Can they put a lien on ur house or car or take it away from u? Will they garnish ur paycheck? Any feedback is appreciated, thanks!

Could they take your money out of your bank account when you have debts and collection agency always looking for you? I am planning on filing bankruptcy but I will need to have money for other things like attorney and money to live. Does anybody of you know if after a while those debts if you don’t file bankruptcy they go into your w4 ?
Then you’ll find yourself owing money to the IRS through the franchise tax board. I saw it in a movie and is worrying me. I thought at the very least they can take what you own, like cars. houses, or anything in your propriety , but I never heard that, IRS or whoever, can take actually money out of your account…
I heard they can take money out of your paycheck.Yes,even giving you bench warrants like they did to me, when is court fines or law-legated debts.
But actually withdrew money from your account I never heard of it…please if you know anything about it let me know otherwise I have to be careful to put my rescue money in a bank account
