I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.

I can pay my mortgage and live on my salary of 40,000 a year without a problem. I have no credit card debt and drive an older paid for car. I do not eat out except on rare occasions. I am frugal but comfortable.

I’m a 29 year old teacher. I’ve accumulated about 00 in credit card debt since I was in college. I cut up my credit cards about three years ago & have been paying on the balances, but card I fell 9 months behind. The minimum payment was over 200 a month and on a teacher’s salary, I just could not make it. They’d send me settlement deals, but I didn’t even have money to settle. I’d send them periodic payments to try to show them I was at least trying. Now, they’ve sent my account to a Debt Collection Agency. The collection agency seems to want me to come up with the entire amount or file bankrupcy. Is there any way I can get a big debt collection company to work with me on small payments until I can get ahead? I recently took a part time job to give me extra income to work with. I don’t want file bankrupcy @ this age and it is the only marr on my credit report. How can I get them to give me repayment options in writing? They want me to do everything over the phone. Help!
The lame teacher’s excuse, is not an excuse. In the state of Montana, a beginning teacher’s salary is barely ,000 a year and with student loans, a rent payment, insurance, etc., at the end of the month I have maybe left over.
Also, I have tried debt consolidation and because I work "-" in the red each month, they would not take me.

I am in over my head in debt. Every month I have to "borrow" at least 0 extra dollars just to pay my bills. My husband and I recently separated. He left me to take care of all the bills. Currently I am a 4th grade teacher and make about ,000 a year. That would be a great salary if I didn’t have to pay every cent to a bill collector.
Every debt is in my name (including a car that I got in my name for him, that he now refuses to pay for because someone else put another car in their name for him–his sister). I already had a car of my own. Now I have two. He didn’t have a job at the time, so most of the major stuff that we have gotten was in my name when we got married.
I am probably about ,000 in debt with credit cards; ,000 in student loans–I know you can’t put them on bankruptcy…I plan to pay them and go back to school next summer; 00 in personal loans; ,000 in car payments (2 cars–1 is almost paid for).
I have no extra income other than the child support (5 a month for 2 small babies that I raise alone). I use the child support on them instead of on me or bills because that is what it is for.
Am I an idiot for trying to pay all these bills off monthly and have no money extra to buy groceries and gas???Should I just file bankruptcy?

Has anyone ever gone bankruptcy? If so, what was it like? Did it completely destroy you financially.? Or were you able to tough it out and survive? I wanted to be able to buy a house in the near future, but my credit is totally screwed due to my recent separation (divorce pending) from my ex.
I have over ,000 in student loans, over ,000 in medical bills, a ,000 consollidation loan, an ,000 car loan, a 00 car loan (it will be mine in June of 2009), over ,000 in credit card bills. Not to mention that I am over the limit on all the cards. I have not been able to pay bills like I should because my husband left me and now I have to take care of 2 small children (22 months, 7 months), daycare and all the expenses at home–rent, lights, gas, cable, insurance, car payments, etc.
There is no way I can get another job. My school district doesn’t allow us to work more than 12 hours on a second job and we can’t work past 10p.m. on a school night. I am a teacher in MS and make only ,000 a year…that’s a good salary, but my debt exceeds my salary.
So should I file bankruptcy???

No teachers don’t make much but are required to work miracles. I am thinking of changing professions.

Long story short..
My home is 0000 upside down. I have two mortgages. I’ve had to relocate out of state and I can’t afford the mortgage and my new rent with my new lower salary. I don’t plan on moving back into the house. I would like to sell the house but like I said… I bought it for 8000 and it’s now worth 0000 and dropping. I have decided to stop paying my mortgage (not easily, I’ve been thinking about it every day for almost 2 year). I’ve used up almost all of my savings to fill in the gaps. I have no assets. I have a great credit score and no other debt but my home right now. I know that banks will foreclose eventually. I’m worried about getting a deficiency judgment. I’ve read that filing for bankruptcy is an option but does it make sense if I have no other debt? Can I even qualify? Should I wait and see if they even try to get a deficiency judgment first?
I don’t want to hear anyone talk to me about responsibility, I KNOW that I got myself into this mess. I need to know how to get out of it or make it less messy. Thanks.
The house is in Nevada. I have rented it out but I’m still in the red every month. I know my credit will be ruined and I can accept that. I just need to know what I can do to prevent or decrease the chances of a deficiency judgment. Again, if my only debt is my house can I file for bankruptcy and should I. Is there a chance that I won’t get a deficiency judgement? I make an ok salary, but my mortgage and rent alone leave me in the red every month not to mention all the other expenses associated with survival! I just want to know the best way to start over with my life.

I’ve recently been contemplating filing for Bankruptcy (Ch. 7) because I am in so much debt it hurts my brain to even think about it!! I am currently over k in debt. Most of the accumulated debt I owe is from past bills I ran behind on due to some unnecessary circumstances. Right now I am attending school full time and working part time making a measly 20/month as my take home pay. With my salary I pay for all the usual bills: rent, utilities, wsg, car insurance, car note, and use whatever I have left over to pay down my debt. For the past year and a half I haven’t opened any new credit accounts and I’ve been on a tight budget. I take full responsibility for all of the finanical debt I put myself into but am stressed and afraid that some of the creditors I owe will soon take legal action (as some have stated in their threatning letters). I’ve attempted to set up payment plans and have tried to negotiate a reasonable payment plan with my creditors but even with some agreeing to this others are not as willing. I am just seeking some advice because my credit is already horrible and even if I decide to paydown my debt it will take well over 5 years relinquish. I figured if I file for Chapter 7 it will stay on my credit just as long as if I tried to paydown all my debt on my own.

I have been trying to stay optimistic about the whole ordeal and I have to give it up to you because I understand first hand how hard juggling work and going to school full time can be. I understand my debt is nothing compared to others but it is still a debt I have to take care of. I appreciate the encouragement and will look into other wage earning opportunities and try other ways to cut back!
Barnaby J: Thank you, I didn’t really factor in my wage earnings after college because they are still unbeknowest to me. (maybe if I looked into a crystal ball I’d know for sure..lol) But, since you have mentioned it I am predicting my salary wages will increase quite significantly after college which will help me drastically in cutting my debt!! However, I am not trying to rely entirely on those predictions! Thank you!!

Are you happy you did it? Any suggested companies? I am currently leasing an Audi and it runs up in a year and i am afraid i won’t be able to lease another car if i am in either of the programs. i have never missed a payment and as of now i am current on all my bills, but i lost my high paying job and took a lower salary so i have debt built up and i need help. suggestions anyone? I am a construction estimator. I have about 10 large jobs over 0,000 that have not started. When they go bankrupt and can not do these projects or pay my salary, can I approach one of our competitors and offer my services with these large jobs.
Is it legal and ethical?

I worked for 4 months without getting paid then the doors are closed and bankruptcy is filed? I was on salary and had 10% ownership, which cost me and made me file personal bankruptcy when the company filed. What legal rights do I have? What are my options?

I need to file Chapter 7 Bankruptcy. My income for the last six months is about ,800, well below the median test for NY State. However, my salary comes from my small business, which is an S Corporation. I am the only owner, and I pay myself out of that corporation. Am I able to continue to run my company and declare Bankruptcy at the same time, or would I be forced to close the corporation?

I make a good salary, but our home moretgage is too much for us to handle (it was a teaser rate and we are not even covering the interest). It is causing us not to have ANY money to do anything else. Considering I am the only one on the mortgage, would it be wise to go ahead and just file for bankruptcy and leave the home?
What happens to my other debts (credit cards, personal loans, rental property, etc)?????
Will it negatively affect my wife’s credit profile?
Will I still be able to finance cars, future homes, etc?

I am in a bind… My wife left me and I cannot afford my mortgage without her salary. She does not care if we default on the loan. I don’t want to file for bankruptcy.
The house was built 2 years ago and is in perfect shape. It has been on the market for 2 months, but I haven’t received any offers.
Do I have any alternatives to filing for bankruptcy?
