of my paycheck. He is now dying. Should I file bankruptcy for myself, jointly, or not at all and collect the ins and pay my bills only and of course the joint ones. I live in Arizona and we have some joint accounts and some non-joint accounts. We are filing bankruptcy with our house because we are seriously up-side down., should I do this or let them forclosure? We are only a few payments late so there are no proceeding started. They still want me to keep the house through home retention, but their offer stinks. HELP, HELP, HELP

So, the dreaded question… File bankruptcy or not?
I was kicked out of my house at a young age (16 to be exact), and the only thing that helped me not be homeless was the dreaded credit card, since there’s only so much money a 16 year old can make.
So now with the credit debt, the school loan debt, the car payments, etc etc, I am in over my head (over 15k). My question… Should I file bankruptcy or not? Also, should I file Chapter 7? Also, what would the best attorney for me be? (I was looking at Peter Francis Geraci, but I can’t find anyone that has filed with him). Also, what is the time frame i’m looking at till I CAN actually file bankruptcy (I heard it takes over 2 years?)
Please, ANY help will be beneficial. I wasn’t a "bad kid" that got kicked out into the streets… I built myself a life in a state by myself and tried making it, but unsuccessfully.

I bought my home in 2006 and put down $ 100k, yes its 20% down for a $ 500k house. I have put in another $ 50k in upgrades and remodel. Fast forward to 2009, laid off, no income I resort to using my credit card to pay my mortgage while my house was being listed by my realtor. 6 months went by, then a year, the house remained unsold. I’m up to my limit in credit card debt, thinking to sell the house for $ 350k, which will give me approx. $ 50k to pay my credit cards. Year and a half later, house is in foreclosure; credit card at max limit. No job, no car (sold it to pay credit card debt), ..and now living like a deadbeat.
Credit card companies still call and say "hello". Same story told to them over and over, no income, no job, no money etc. They "understand". Then they sell the debt to collection agency, same thing again. I told them my story..and they don’t care. "When are you gona pay?" I say with what? I can sell my t-shirt and underwear, but that might be worth 25 cents. What good will it do? So now, they are suing me in court. Went there and told the same story…judgment for the plaintiff. Okay, now they want to garnish my wage…but I don’t got no job. They want to freeze my bank acct…I have none. They want to..probably kick my ass..that they can definitely do..but that would hurt them, because if I get hurt and sue, they probably owe me money.
So here is my dilema, should I file Bankruptcy ..as there are other creditor waiting in line to sue me. Or should I go to court and and plea guilty but have no way to pay?
Yeah, I know..I’m a deadbeat, but I don’t blame my misfortune on no one except myself. Lost my life savings and people are laughing at me. What a cruel world this is. To file BK or not to file BK? If I do, I will have a fresh start says a friend. If I don’t, my friend says that the creditors will put my balance on my credit report, and renew it every 7 years…meaning that I can call the credit reporting agency to remove it, but they have a right and probably will repost my balance…as nothing had been collected. Is this true? I thought a negative item must be removed after 7 years, but it could be put back in and stay for another 7 years?? Please help. Thanks in advance.

(I know it effects your credit score). I was in an accident over a year ago and had no medical insurance. I have been paying a monthly amount to all the accounts (which they agreed to let me pay) Now I’m getting statements saying they need more money or they are going to send me to collections! Should I file bankruptcy or just leave my medical bills in collection? All my other loans, credit cards etc. have all been paid on time.
I have fairly decent credit (695) and my medical debt is around ,000.

I’m 23 years old and I am in ,000 worth of debt. That includes a repo’d car, a default school loan, and some 0 bills here and there. I’ve never had a credit card and as crazy as it sounds, my mother use to use my name to order off the home shopping network and for her utility bills. I have tried to dispute it but with no luck. I just want to start off fresh. It will take FOREVER to pay off that much debt. So should I file bankruptcy? What chapter? Any advice?

I have 5 credit cards total. 2 with American express, 1 with Washington Mutual, 1 with Capital One, 1 with Barclay. The debt with WaMU has been sold to a company, and is no longer owned by them. The rest of the debts are still ‘owned’ by the original creditors and I can settle the amounts with them, most at 50-60%.
I have not made payment on any of these accounts in over 5-6 months, and am now in a position through assistance from a family member to pay off all the debts via settling. After speaking with a couple of people though as to how this will affect my credit I wanted to know what I should do.
Should I settle the cards? Or should I file bankruptcy? The total debt on credit cards is -14,000K. I also have k in student loans, and a ,000 judgment against me from court. I am fairly certain that me filing bankruptcy would not remove the judgment against me, or my student loan as it is through the federal government. Am I wrong?
My main question though is, what will hurt or be best for my credit? Me settling the debts, or filing bankruptcy? Which helps me the best for rebuilding my credit in the least amount of time?

Has anyone ever gone bankruptcy? If so, what was it like? Did it completely destroy you financially.? Or were you able to tough it out and survive? I wanted to be able to buy a house in the near future, but my credit is totally screwed due to my recent separation (divorce pending) from my ex.
I have over ,000 in student loans, over ,000 in medical bills, a ,000 consollidation loan, an ,000 car loan, a 00 car loan (it will be mine in June of 2009), over ,000 in credit card bills. Not to mention that I am over the limit on all the cards. I have not been able to pay bills like I should because my husband left me and now I have to take care of 2 small children (22 months, 7 months), daycare and all the expenses at home–rent, lights, gas, cable, insurance, car payments, etc.
There is no way I can get another job. My school district doesn’t allow us to work more than 12 hours on a second job and we can’t work past 10p.m. on a school night. I am a teacher in MS and make only ,000 a year…that’s a good salary, but my debt exceeds my salary.
So should I file bankruptcy???

I am 25 years old. I am a full time College student (I go to school with the help of financial aid). I live in Chicago, IL if it matters. I am ,000.00 in debt, mostly due to interest and overlimit fees. I have a car that I pay 0.00 a month for which will be paid off in 2 months. However, I only make 0 a month. That 0 includes my gas bill, electric, cell phone, car payment, insurance, groceries, ect. What should I do? What are my best options? I can only pay about 0 a month towards my debt? Should I file bankruptcy?
Sorry, I forgot to mention that I haven’t paid any of my creditors in almost 2 years. Also I was summoned by a sheriff yesterday, I am being sued by a collection agency (for an HSBC cc) in the amount of 00.00. I have court tuesday morning.

I am 23yrs old my debts are from 07 i have a car repossession, 2 credit cards, a loan, a cell phone bill, some medical bills in my credit including a judgment and all that equals out to about 10k in debt. I have dreams of someday owning a house. maybe when I’m 30? but for now i would like to obtain a credit car for everyday expenses. Should i file bankruptcy? I am obviously more conscious about the responsibility and importance of a good credit history that’s why my debts are all from 2007 but idk what steps to take. should i? is it beneficial?

bought my townhome in 2006 new for 160 k. and it is now work 95 k. I still owe like 159 k. I want out no matter what. I hate the neighborhood and dont feel safe. I have never missed a payment. but I think im going to just stop making my payments and hire a real estate lawyer. Due to permenent disability which occurred 2 years ago I can no longer afford my monthly mortgage. Normally I would just sale my home but my house in Las Vegas is currently about 0,000 up side down and I do not have that kind of cash to make up the difference. I have spoke to the lender (Chase) in length and the only thing that they are offering is temporary solutions so I know that I will have to move. Luckily I have a excellent family support system that will allow me to live within the confines of my limited disability income. but I’m concerned about the mortgage company harassing me for the mortgage deficiency, so should I file bankruptcy now or wait until I’m out and wait for the bank’s deficiency judgement? Please understand that I have always been responsible with my financial responsibilities but I did not choose to get sick, so I’m trying my best to play with the cards that have been dealt to me! I am almost exactly 0,000.00 dollars in debt and I am single with one income and earn around ,200.00 per month.
The highest paying job I had after 5 years on college has been at .00 an hour where I worked for two years before getting laid off. Ever since, I have not been able to get a really good paying job with my degree.
Here are my debts:
,000.000 (and rising) to the IRS. After I bought my home, the IRS stopped working with me and everything became all threats with them answering every question with "I see you have a home, we don’t have to work with you-we can simply put the tax lien against your home) which they did.
I’m desperate to get from under this debt and I have heard stories about people making ridiculous settlement offers to the IRS and paying pennies on the dollar but the only settlement they will offer me is around ,900.00 (a 0 dollar reduction) IF I pay right away.
And this amount is originally ,000.00 with the rest being penalties and fees.
I owe ,000.00 on my home
I owe ,000.00 in medical bills
I owe ,000.00 in credit card bills
i owe ,000.00 in miscellaneous bills
I owe the utility company ,500.00
I owe Sallie mae (I had my student loans consolidated) ,000.00.
I can’t pay on any of them right now besides my home and my payment on that is 2.00 per month. I also live away from my home out of state and I pay 0.00 dollars for an efficiency.
Should I file bankruptcy? Which chapter should I file and how do you think it will help me?
PS-
I forgot to mention I just had a judgement filed against me by the lawyers for my HOA for 1,700.00 dollars and NOooooooooo I DO NOT want to sell my home. It will be lightyears before I’m able to buy another one.
The first answer given is why I want only "knowlegeable" folks to answer because they take the home if you file Ch. 7 NOT Ch. 13.

Ok, I have 5 negative and 5 positive credit marks on my credit report. My fiance has 0 positive and 2 negative. We both have a negative mark for a joint automobile. We were both in a wreck (not our fault) and have been w/o transportation and a job b/c of the wreck. It caused a lot of things to become negative marks.
I dont see how I have positives b/c we were unable to pay everything other than rent/electric/water. We got some money from the insurance company for pain & suffering and lost wages. Currently, I have paid off 1 of his negatives (not the vehicle, but the credit card he has)… and 3 credit cards that were negative. I am still months late on one loan (which is still deemed positive). The other credit card I never used and had closed a yr ago. And the other positive I am making minimum payments on (but was late 2 months).
So, all the APRS have shot through the roof… combined, we are about 12-13000 in debt (most being the vehicle, followed by my loan and credit card). The APR on the vehicle is outrageous…and payments more than doubled. Only 1/9 goes towards the vehicle…the other 8/9 goes towards the finance charges. The vehicle is on a Honda credit card.
Should I file bankruptcy? What about 3 yr bankruptcy term (or shorter)? How does that work…will it show in the future after 3 years?
Also….if I filed bankruptcy….would the vehicle be only his repsonsibilit then? How can we get the vehicle out of our life…lol! Its a pain, monthly payments are outrageous…and its not worth what we owe now.
I do have a old vehicle that was given to be as a present a few years ago as a graduation present. Its pretty old, but it runs ok (not well). Its probably only worth about 1000. I use it as backup if I have an emergency…but it doesnt run very well so I dont like to drive it.
If I filed bankruptcy…would they take that away?

My husband and I have about ,000 in past due debt right now. My main question, should I file bankruptcy if our debts are already old? According to Experian, "This account is scheduled to continue on record until Nov 2012" …actually some start coming off 2010 through 2012. I don’t know how confident I am that they will be off my record come 2010-2012…but if I file bankruptcy it will be 2019! can anyone give me advice on this…do the negative reports actually come off and if so, when? Or should I file bankruptcy? Sooo confused!!

I’m a 20 yr old single mother almost homeless without a job with up to 30k in debts that at this pace will never get paid and become higher every month should i file bankruptcy? what should i do? i’m desperate!

I am 26 years old and over ,000 in debt. About ,500 of it is in credit card debt, 00 in car loans, and 00 is in a lien for an accident I caused. There is another 0 in miscellaneous debt. I am married with two small children. My husband and I have a monthly gross income of about 00. In about a year, I will be needing a student loan for my last bit of college. We do not own a house, but we do own one car (the other we are paying off). We would, in about three or four years, ideally, like to try and get a house. Should i file bankruptcy now? What would I lose, if anything? The two cars we have are 6 and seven years old. I appreciate any advice.
I have not used any cards in a great while. I really do not see putting off college any longer, plus with my degree I will be able to earn a considerable amount more that i do at this time. As for asking creditors to lower the rate I would definately consider that. Is it really that easy–just call the company and explain that i want to pay the debt off? What about the lien–can I do anything there? Thank you again.

I was unemployed for a year and got a little bit behind on my house payments. I finally found a job that paid half of what I used to make, but was unable to make the entire payment so I applied for a modification from BofA and from WF (HELOC) and was given a temporary modification. However, every month, BofA reports it to the credit bureau as "paying late", even though I am paying on time. Now, WF has raised my monthly payment, which I cannot afford, or they want me to pay the entire ,000 loan in full. They have reported it to the credit bureau as "charged off as bad debt". What are my options? Other than these two debts, mortgage and heloc, I have no other debt. Can they come after me and garnish my wages? Should I file bankruptcy? Should I sell the house on a short sale?

On Thursday I’m due to see a lawyer about filing Chapter 7 Bankruptcy. The problem is I need to try and get another car this month. Should I file bankruptcy before or after I get another car. My current car which I have a debt consolidation loan on is sitting at a mechanic collecting dust because I can’t afford to get it fixed and the debt folks wont release my title even though its a useless car. I can easily get another car with low monthly payments but will that look bad if I file bankruptcy?

last year my wife changed careers, we risked no insurance for 2 weeks, i had a heart attack in those 2 weeks, almost 0,000 i am doing ok, i have depleted our saving, sold my 57 nomad, and cashed in my life ins., to pay the bills. these "wolves still call everyday wanting me to increase my payment(to over 0 i have 2 different bills wanting this much) i cannot afford this, i haven’t been able to pay my credit cards, they are huge now with all the late fees, i can barely put food on the table. i would like to keep my house. should i file bankruptcy and rid myself of all the stress? for my health’s sake

I just got off the phone with a good friend of mine, he was repeatedly asking me the question "should i file bankruptcy"?
He and his wife owe about 0K in credit cards. The both of them originally held great well-paying jobs which they lost due to the economy and recent cost-cutting by their companies.
They were intending to repay the debt but as a result of their job loss, their current employment which is only paying a fraction of their original income is significantly not enough. They are being hounded frequently by creditors as well. I’m unsure what is the best option for him.
I am hoping i will be able to answer his question "should i file bankruptcy" in a assured manner to calm his nerves down. Is it the only option with regards to this issue of his? Any alternatives?

I’m in a situation and need some outside advice. Lost my job and am taking a 50% pay cut to get another job. Should I file bankruptcy or use a credit counseling agency to consolidate my bills? Am between 15,000 and 20,000 in debt. Didn’t file when I lost my job, but have now used all my savings while living with no income for 7 months. Any advice would be helpful.

I just found out that I will be loosing my job in 30 days. I will be job hunting of course, but it’s possible that I will have to declare bankruptcy if I can’t find a job that will pay the bills. If so, I will want to stay current on my mortgage to avoid loosing the house. But when should I file bankruptcy? Should I wait until I loose my income, or should I start the process sooner?
