A friend of mine is on SSI and wants to file bankruptcy. Can he do this?

He has a lot of old credit that he has tried to pay off, but with the interest it is just not going anywhere. How does he go about filing bankruptcy with him being on SSI? He owes about 12,000. What are the steps, such as filing in court, getting a credit report to ensure all have been included and so on? What are the court fees? Thanks….

Is chapter 7 bankruptcy the right thing to do?

My sister has been on SSI ( social security income ) due to a disability for a few years. She got 3judgmentsered judgments against her from creditors ( about $ 10,000), she has no way to pay now. I advised her to file chapter 7 bankruptcy to wipe out this debt, Is it legal to file for chapter 7 bankruptcy in this case ?

file bankruptcy or try to settle debts?

i live with two senior citizens who are both on SSI and who depend on me. Would you file for bankruptcy if you are having problems making ends meet. What would you cancel:
sat service, phone with internet, cell phone
plus we also have house insurance, electricity, water and sewer also trash.

i am making at least 1,000.00 per month would you file for bankruptcy knowing it would be the best thing to do

If you file for bankruptcy will the housing authority?

If you have filed for bankruptcy, will the housing authority still consider you for an apartment if you are on SSI and they know you have a lot of mental and emotional problems?

What can I do about someone causing me pain & something I can't control ?

There is someone in my life who has caused me great pain. So much pain that I feel it has touched my soul, and really harmed me in some way that is almost beyond repair. I am seeing a therapist. However, my therapist keeps telling me there is nothing I can do about this particular subject, and I need to let it go. I pray about the situation every day.

My problem, if you forgive me for it being too long:

My husbands ex-wife.

She is 52. She is a two time convicted criminal (for murder and attempted murder). She was charged with first degree murder and made a plea. She has served time in prison for this crime (convicted of a felony). She is a drug user. She hates all men. She has been recognized as being psychotic and a liar. She has applied for and recently been approved for SSI for being insane. She is also a hoarder (you know, like on TV where there is trash and fifth piled high to the sky and the home stinks like a trash dump). She has been convicted of murdering her daughter (11 months old) by holding her baby under the water in the bath-tub with her feet until the baby drowned. She served time in prison for this. She has been convicted of hitting (another felony) my husband over the head and cracking open his skill. My Father-in-Law rushed to the house to save his son (my husband’s) life until the ambulance came.

My Father-in-Law.

My Father-in-Law is 84 and he is a Doctor. We used to be on warm and loving terms. We lived together. He said he loved me. I said I loved him. His wife (my Mother-in-Law, a writer and professor) were also on warm and loving terms. She got ill with a brain tumor. While we were in another state (Virginia) preparing to move here (California), my husbands ex-wife (who was not allowed in their home under normal circumstances, moved into the home without our knowledge.

My Mother-in-Law has since passed away. Before she passed, my husbands ex-wife fired all of the nurses because she said it was too expensive and she could care for her. Now, remember, my Mother-in-Law hated her guts. When my husband went, she said: What is that woman doing in my home ? She hated her for killing her grand-daughter. She saw the autopsy records and the body. She saw the bruises and "foot" marks all over the body.

My husband ex-wife turned them against us. She had them change their will. She lives off of their millions (she has hardly ever worked because she would like about the criminal history, it would be found out, she would be fired). The entire family hates us. We don’t know why. We get no Holiday invites any more since she moved in. We don’t know why or what she has told people.

There are three children involved (13, 16, and 17). They used to live with us. They used to call me Mommy. Then, the ex-wife found out and demanded them back. When they lived with us they were getting straight A’s and involved with after school activities. With her, they get F’s. They have no after school activities except for the compouter. They are on psychiatric drugs. They do not attend school with frequency. One has been expelled. Once has been in the psychiatric hospital for cutting. One sleeps around and drinks.

I was under the impression that there was some kind of law in California that says anyone who commits violence against a child can’t live with them ?

Well, she lives there. As a guest.

I guess my question is: how do I get over this anger that no one cares about the children ? That we are supposed to see them, but the visitation orders are not enforced (we have gone bankrupt taking this issue to court because my Father-in-Law uses his money to fight us). Motions have been filed with the court (since we were denied visits time and time again) and they have not been responded to.

I need to stop worrying about the children. One of them wrote me again today and said they miss us and want to see us but were told they can’t without a person to pick them up and drop them off (they are being told this monitor is needed for their safety). This is, of course, a lie.

We have been paying for the "monitor" since 2005.

Since my husband and I don’t work (he lost his job due to a bankruptcy by the DoD company he worked for and has not been able to get a job since). I lost my job last week due to the program I was on being canceled by the government.

So, we are supposed to pay $ 85.00 per week (no checks or creditor cards) to a person to pick up and drop off the kids. Well, needless to say, we can’t afford it. So "they" (the ex-wife and Father-Law) have been allowing us to see the kids without paying this fee. They bring the children to Ralph’s and we drop them off at Ralph’s. The main reason they do this: we hae been told by the children that, since the home is so messy, no one is allowed in and their Mother is afraid we will complain.

They are all of a sudden being told that this pick up / drop off person is demand
That is a lie they are being told. We had an understanding that the "monitor" was not necessary because we could not afford one. However, my husband says I can’t write them that. No one in the entire state of California seems to care about the children. In her original murder trial, the Judge ruled she should never be around any child in any kind of capacity without someone being in charge of her because she is so unstable and crazy (based on Psychiatric reports the Judge had presented to him by the Prosecutor).

So, my question to you (I pray you can help):

What do I do with my anger ? My frustration that no one seems to care about the children or their downward spiral ? My worry about the children (their future, their ability to have healthy relationships, the possibility that they will use sex and alcohol and drugs as an escape?). Thanks for your help !

if i file bankruptcy after served summons for unsecured credit can a judge still request my bank account stat?

I am in a pickle, got served summons for unsecured credit debt, 6700.00, i am seeing an attorney wed to file chapter 7, no other choice! After i file, can a judge then request my bank statements? Reason asking, is i am receiving ssi (for real disability) and my spouse did not have his own checking account and i have been depositing his unemployment checks in mine for like 3 YEARS!

what can i expect to lose if we file Chapter 7 Bankruptcy?

my wife an i are going in to see a bankruptcy lawyer next thursday. we have two cars 10 years old and are still paying on one we got last year. the other is paided off. we owe about 60,000 on credit cards and hospital bills and school loans. she was caught in a down sizing and i was put on ssi because of medical problems. we do have a mortage on our house. what can we expect to lose if we file for bankruptcy. how much will they take inside the house and if they will take one or both of our cars and even the house. this is very scary cause its was all good until i started having too many surgery and she lost her 16+ an hr job and now has to take a 10 hr. myself was put on SSI for good.

How can SSI stall your determination?

My daughter was seriously burned and nearly died. She is having numerous surgeries. Now, she is having a reconstruction of her windpipe. She was taken off medicaid because her twins turned 18. She applied for Disability and was turned down. We got a lawyer and were told on April 5 that a determination had been made but it was under review and we would know on April 14. When I called (my daughter cannot speak), we were told that her husband had to send in pay stubs from June 09 to March 10 and we would hear in 15 days. Meantime, the hospital wants to know who is paying for the surgery? I am putting out 0 a week and I am ill and can only work part time ( I was paralyzed with Guilliane-Barre last year.)I am going bankrupt. Why are they stalling when this is a life or death matter? Is there any suggestions that I can do?
Why did they say that a determination had been made and that it was under review and we would have an answer by April 14. They lied. Then wanted more information that they should have gotten before.
If my daughter had money to put out for medicine and surgeries, she would not be asking for SSI. She has no money at all. Without her medicine she dies
I think that Social Security is stalling because the think she will die and they will not have to pay,

Do you agree or disagree about this statement on the U.S. economy?

America is a country based on debt, your debt the national debt its all the same! You cant control your own silly spending but when politicians do it you feign surprise? You were not surprised when the new highway was paved or when supplies came in after the disaster. You were not surprised when the local bums collected their food stamps and WIC, or even when the SSI wagon came around for all of the illegitimate kids "payments". But now, after all these years, because we’re at the edge of financial collapse you act like the last guy with the pocketbook caused the problem.

Hilarious, mixed with a crap ton of irony I think.

Also, how can someone honestly look you in the eyes and with a straight face tell you health care needs to be passed and needs to be passed now? We pass it, we go bankrupt and guess what? No health care for anyone at all.

Anyone with a rational, logical mind would focus on the economy, get people working again. Then focus on such things such as health care.

Your health insurance industry adds about .500 dollars to the price of every car made in USA over the cost of a car made in a country with socialized health insurance.

That’s the unions, maybe the 28 dollar an hour auto worker needs a pay cut. Ever think about that O_o

I am filing chapter 7 and need advice on possibly short selling my home. (Or not…)?

I have listed all of my outstanding debts on my bankruptcy (including the 2 mortgages on my home), although I had planned on keeping our home and continuing to keep up the payments. My atty told me that if I needed to walk away from the home at any point after the discharge, that the bankruptcy would help me to avoid any judgements as long as I didn’t refinance the loans. But even without paying the debts that I am filing on, we are still finding that our monthly expenses are far outstrapping our income, so we are thinking about short selling and getting a smaller rental home for a while until we get back on our feet. My domestic partner is on SSI, and is "judgement proof" from what my atty says, so between that and my chapter 7 simply walking away is an alternative to short selling. My question is: what is the best thing to do for the long term?? At this point, both my partner and my credit scores are in the toilet anyway. I’m just worried about never having credit again.
