My GF has about 30k in debt…mostly credit cards Just found this out a few days ago and asked her to sit with me and tabulate everything. She has not defaulted on any part of it, but, I guess that could be a possibility down the road. Anyway, the only thing that I have my name on with her is the lease to our apartment (though the bill comes in my name and in the lease it specifically says that any money from the security deposit goes back to me and only me) Also, we have our names together on our internet/tv/phone bill.
I can cover these bills on my own if it becomes absolutely necessary. Obviously I don’t want to and don’t plan to…but I can if the only alternative is being evicted or having services cut off.
My concern stems from this. If a person declares ch 7, I understand that the creditors can basically take anything and everything you own. Would this have any impact on MY personal assets?

I have a few qustions regarding chapter 7 bankruptcy – not sure if anyone would know the answers to any of them. I haven’t filed yet but it is a consideration.
1. I bought a new car last year – my father is the primary on the loan and i am the cosigner – how does this affect his credit? I am current on payments and will continue to be current.
2. My ex husband and I bought a house together when we were married. I am the primary on mortgage and he is second. In the divorce he got the house and modified the mortgage based on his income. If I file will that mess up anything with him?
3. I am an authorized user on my fathers credit card although I haven’t used it in years – will my filing affect this on his credit report?
4. I am in desperate need of a new bed – if I buy one before I file will this have any affect on the filing (not buying with credit – paying outright).
THanks for your help. I hate the idea of filing bankruptcy but Im now being sued because a creditor won’t work with me for a manageable payment plan (they want more than I make in a month). If anyone has any other alternatives I would appreciate that too.

I am unfortunately getting ready to file for Ch.13 bankruptcy. I know that my student loans will not be included in this filing so, my question is….will my father, who cosigned my student loan, know that I have filed? I would like for this information to stay between myself, the creditors and my lawyer. Thanks for your help…

When deciding whether I can afford to attend a college or not, do I first apply to the school, find out how much financial aid/scholarship money I would receive, then see if I could cover the rest with bank loans (assuming I really want to go to this college)?
I really don’t know if I can afford the college I am looking into, but will do pretty much anything to go there. I just would like to know the best way to find out if I can afford to go to this college without going bankrupt. I have already contacted the financial aid department of the school. He basically told me to apply, and if I get in, then apply for scholarships and financial aid.
Let’s say I do this and see how much money I would get. Who would I go to to find out about loans? I don’t even know how you get loans as a student. Do you get them for your bachelors degree and then apply for another if you want your masters degree? I am completely lost in what to do and how to go about doing it.

My court date is next week. Should I contact the creditor/ collector that I will be filing a bankruptcy and there is no need for this small claim? I can I earn some time to file a bankruptcy before my court date for this small claim?
Actually this small claim is not for me and the bankruptcy is not for me either. I’m a single and taking care of my ill parents. I tried paying their bills off but if is overwhelming with my bills and my responsibilities. My parents have no assets, no bank account, no property (sold last year) and no retirement plans. Is bankruptcy a smart choice here or should I contact the creditors and arrange a manageable payment? Thanks for your help in advance.

I am an ‘Alien’ currently employed in the US on an O-1B (Extraordinary Artist) visa at Company 1. Sadly, this company went bankrupt last week. I am still working there to help them out as they are nice people, but they can no longer afford to pay me.
I found a new job a day after the bankruptcy was announced at Company 2, and have prepared a new application for a new O-1B visa, using form I-129, Petition for a Non-Immigrant Worker.
This is my question. Company 2 wants me to start working for them immediately. However, visa requirements (as far as I’m aware) state that an O-1B visa must be APPROVED by USCIS and employer must be sent form i-1797A, Notice of Action (Approval) before a Worker can begin work. I checked on the USCIS site and processing time is currently set at 45 days!
What are the legal implications if I start work for company B while my visa approval is pending? Could I (for instance) work my first 1-2 months unpaid, or have my pay put on hold till my visa is approved? Could this be considered training? I need to know fast as I will lose the job if I do not start work on Monday.
I know that the H-1B has a new ‘Portability’ rule as of Oct 2000, which states that a Worker may start work for a Sponsoring Company immediately upon FILING the visa application. Does anyone know if this new ‘portability’ rule also applies to the O-1B?

I got a letter today from Midland Credit Management, asking for a debt in the amount of ,181.56. The Debt is from Aspire Visa, a card I used to have .. I could not pay it all off since I lost my job and i’m having trouble finding a new one. I can’t pay off this debt in this amount .. it originally was NOT over ,000, it was 0. They added on all these late fees / interest when I could not pay over a amount of time. I tried to make small payments, but obviously they didn’t help, it just got larger and larger. The account has been in collections for a while and so, it doesn’t matter how much I pay, it’s still not enough.
They sent me a letter saying:
"This letter is to inform you that Midland Credit Mangement, Inc. Is Considering forwarding this account to an attorney with the intent to initate legal action to settle the debt.
Please call our office immediately at 800-939-2353 to make arrangements to pay this debt and prevent any legal action on your account"
What do I do?? I cannot afford this .. I have absolutely no funds, and there no point in calling telling them that because well, what are they gonna do?
I’ve told them that I can pay it when I get a job, which I am currently looking for, but if the case goes to an attorney, what are they gonna do? even if I will have to go to court, that’s still not going to get them money .. because I don’t have it. I also have no assets, no car, no house, or anything. So what can they do?
I’m really worried. I am still trying to find any job I can, but even if I do, it will take me a while to save up that much money.

oh, and if you’re wondering, i’m posting this from my aunt’s house, I cannot even afford my own internet. LOL
CAN they take me to court though, over this debt??

My husband is being sued for a car accident that he caused a year ago,for 0,000… we dont make alot of money and we recently bought our first home 4 months ago. If the plaintiff wins and we are not able to pay and he garnishes my husbands wages we will need to file for bankruptcy. Will our lender have attend the bankruptcy hearing and will this at all affect our loan with the mortgage lender? Thanks for your help!
lol..landlord, no of course not. The accident happened over a year and half ago and no, he was not hurt, he didnt even go in an ambulance and his car only had a dent in it…he is suing us for emotional damage and "physicall therapy" and loss of work…he is a total fraud and hopefully we will win in court but just in case we dont, I was just wondering…stop being so judgemental

Before I was married I filed both ch 13 and 7 bankruptcies. The 13 was dismissed in 2004 and I later filed ch 7, which was discharged in 2005. I am now married and don’t know if my husband and I can file ch 13. He has never filed bankruptcy. Or can he file individually, even though we are married? We’ve suffered a traumatic loss of income and are at risk of losing our home. Thanks for your help.

I had cell phone account with Sprint. Due to financial difficulties, I was unable to pay my bill and my phone was cut off. My account is now in collection. The early termination fee is 0 because I signed the contract before Nov 2, 2008. I know I owe the etf, but the collection agency says I owe 305.00 which I am assuming is a fee they tack on. Is there anyway I can pay just the 200.00 and also have the account taken off my credit reports?? It was assigned to the collection agency in Sept 2009 and is not currently charged off. Thanks for your help!!!

I have had two collection agencies recently try to settle debts with me that are very old and do not show on any three of the credit agencies’ reports. Do I have to pay them or are they just trying to make money off me? I have heard this referred to as "zombie debt." Thanks for your help.

My wife and I both lost our jobs a month ago and now we’ve decided to head to college together.
–> bad credit car loan about to be repoed, 2 credit cards (i already been sold to collections), apartment bill about to be sent to collections, and some medical bills
Can we get enough aid to pay for college and then for my dental school IF we decided to file bankruptcy?
Also, how much does bankruptcy cost?

We have to ruin our credit first and then they might talk to us… We have have the properties on the market but cannot sell without going to the table with large amounts of cash.
If these properties foreclose or we go into bankruptcy.. Can the creditors attach or take our retirement savings to satisfy debt?
