bought my townhome in 2006 new for 160 k. and it is now work 95 k. I still owe like 159 k. I want out no matter what. I hate the neighborhood and dont feel safe. I have never missed a payment. but I think im going to just stop making my payments and hire a real estate lawyer. I would rather just rent some where else. so should I file bankruptcy or try to short sale it? any testominies or lawyer advice would be greatful
I filed for Chap 13 in early August. I can no longer afford to live based on the payments that were required because my husband lost his job. I have 1 taken out of my check bi-weekly for the next 5 yrs. I need to stay in it, but now we need this money to live until my husband finds another job. We are in jeopardy of losing our townhome because we can’t come up with the rent because most of my income is going to the Chapter 13. I have kids and right now the load is on me and I have to look out for their best interest. How soon does the creditors come after you for their money, because that would be something else to catch up on. What should I do?
I called my lawyer and he said that since I just filed then the courts may dismiss it because I haven’t been in my case for that long; so I couldn’t get a hardship discharge.
My townhome is scheduled for foreclosure sale date May 13th 2009.
My chapter 7 bankruptcy will be filed 3/25/09. How long will this delay the foreclosure sale?
