I filed for Chap 13 in early August. I can no longer afford to live based on the payments that were required because my husband lost his job. I have 1 taken out of my check bi-weekly for the next 5 yrs. I need to stay in it, but now we need this money to live until my husband finds another job. We are in jeopardy of losing our townhome because we can’t come up with the rent because most of my income is going to the Chapter 13. I have kids and right now the load is on me and I have to look out for their best interest. How soon does the creditors come after you for their money, because that would be something else to catch up on. What should I do?
I called my lawyer and he said that since I just filed then the courts may dismiss it because I haven’t been in my case for that long; so I couldn’t get a hardship discharge.
