I have filed for bankruptcy, and the trustee says they see "fraud". I had a student loan wich I used to pay for aviation classes. Now the judge wants to take back my money from the university, and make me continue to pay the debt!!! (,000)!!!!!!!!!!!! Is this possible?

Today I had my chapter 7 bankruptcy Meeting of Creditors with the trustee. I’m representing myself and have no assets. The trustee asked me if I have ever filed bankruptcy before, and I told him no. This was also a question on my chapter 7 forms that I filed with the court. The question on the forms asked if I had filed bankruptcy in the last eight years. I researched this in a legal help book, and it confirmed that the court is only concerned with the last eight years. As I was going home from court today, I began to worry, because about 13 years ago I did file a chapter 7 bankruptcy in another state. I was assuming that the trustee was referring to the last eight years, but because he didn’t specify, I’m now thinking that he was asking if I had ever filed bankruptcy. Could I get in trouble for this inadvertent omission? I’m recovering from a year of unemployment as a teacher and am a very honest and forthright person. Please let me know your thoughts on this. I would be very grateful. Thank you.
This is considered a lie under oath? What does this mean for me? This was not my intention. Could I get in trouble for this? Thank you.

Help! I was laid off but need a car to look for a new job. If I convert to chapter 7 can I reaffirm my car at the same payments the trustee is making under chapter 13?

My Husband and I filed Chapter 13. However, we have decided it is not a good move for us. So, we have our Creditor Meeting with the Trustee this week and want to know what will happen if we decide not to go through with this? Mainly, does this go on our credit report anyhow?
I wanted to add that we are using a Bankruptcy Attorney and we are just looking for more info to make our decision before we talk to her about it. Thanks for all of your help in advance

I had my 341 meeting today and Im so glad that this is over with. My trustee was a local bankruptcy attorney that advertises WAY too much and my neighboorhood, and he kida looks like skeletor.
Anyways he was particullary found of me since I filed bankruptcy ProSe(By Myself) I had a few tiny problems and he wouldnt be specific on how to fix these problems and am hoping someone can help me and tell me what I have to do
#1 I had lost my wallet a few months ago it had my social security card and everything in it. I went to the SSA builing and filed a replacement card application. I had told the lady at the counter I have a meeting coming up where I need to show proof of my social. She told me " This reciept is all you need to show" I did and the trustee rejected it. I have to get him something with my social
#2 I was told before the 341 meeting that I needed to drop off paperwork to his office. I needed to drop off my bank statements, Paystubs, Income Tax Returns. (SEE MORE BELOW)
And a copy of my Petition. I had a copy of my petition saved on a CD and I had thought that the State Bankruptcy office would have given him a copy. But just to be safe I had printed out a copy of the original petition and handed to his office. He cocked an attitude on me again saying," How am I suppose to verify your signature" i had told all my signatures was on the original and this was a duplicate. I dont remeber him saying anything else needed on this end. But just to be safe
#3 On My list of assets he said I have to amend my return to say the details of my car which Im claiming an exemption on. I wrote "debtors Personal Vehicle" but he wqants I think the make year model etc. And also I claimed my checking account as an assett which only had a hundred and he says I need to put an exemption on that. He wants me to amend schedule C i think it was
He ended it by saying quote"DO NOT CALL MY OFFICE FOR ADVICE ON HOW TO FIX THIS" (SEE MORE)
I remember him saying I had till the 28th two weeks from now. Do I just have to get all my paperwork together and can I mail it to his office or something else? I’m really in the dark and wish I had hired an attorney. PLEASE no smart ass remarks about ohhh you should have gotten an attorney. If I could have afforded the fees I would have. Thanks

and I owe around 66 on it. I am in the process of trying to buy another car. I understand I hv 2 find one under ,000 and the trustee has to approve it. My question is, does the new car go into the bankruptcy or will it be a totally different payment? Please answer only if you hv been in chapter 13 or are familiar with the legal issues. Thanks.

I have a family of 5 and I am worried that if I file for Bankruptcy, I won’t have any cash to spend for clothes and other general expenses like school fees and the occasional rec sport. How does a trustee determine what you can live off of in bankruptcy?
Our family makes just over 6 figures. Our home is adjusting and this is one option to get back in good standing.

Where to begin…you know I accept the fact that life is unfair but WTF did I do to deserve to be in the situation I’m in now. Well my life sucks and I have no clue how to make it any better. This story starts about 6 years when I gave up on feeling anything and realized I am depressed but I did not let it get to me because I have a vanity that burns greater than anything, it consider it my most prized possession that no one can take away. So I even accept the fact that I’m depressed but I move on and put a mask on that I’m just great and nothing wrong. Anyway my rich grandmother died and left all the grand kids 0,000 but she put it in a account with a trustee and my uncle who was the trustee took all the money and left the country. So I’m out 0,000 and on top of that my grandmother had a family company that my other uncle stole and bankrupted and took all the money to himself and left my mother and other uncle with nothing from that. Aside form easy money my mother was a real estate broker and the market dried up 6 years ago and now we are poor. On top of all that my parents got a divorce when I was 13. Let’s fast forward, to 2009. I had few friends in high school, never had a girlfriend and hated most of the people there. I finished high school and my parents have no money for school and no one will cosign with me for a student loan so I am forced to go to a community college even tho I am much smarter than that. Also I live in the suburbs so I can’t walk anywhere and got no car and can’t a job because I got no ride. Also the job market is awful and it’s so hard to find a job. The money I saved over the years I used to pay for my classes and books with no help form anyone. My mother was not getting paid on time at her old job and she foreclosed on the house and we have to get out by next month to a apartment. I am 19 and I feel my life passing me by without even living and that makes me very depressed because I am very nice person who will go out of the way to help someone and do charity work at my church sometimes. The fact that I could have had it all with that 0,000 is the biggest slap in the face ever. So everyone else is busy doing their own thing looking out for themselves and no one care about me. IDK I hope things get better, any help or input would be nice.
Also I think I kinda ugly too so any self improvement tip are welcomed, sorry for it being so long but I feel a lot better having all this off my chest.

I always get a nice tax refund, and want to protect it from the trustee because she filed before we decided to get married. Is it better to file married but separately, and who should write off the dependant(child)?
We will be married before the bankruptcy is final. But it was filed before there were wedding plans.
The trustee wants 2010 tax filinging reported to him before April 15, 2011. We will be married this year.

A house I am buying in Las Vegas, Nevada is still in escrow and I am just waiting for order from the court for release property from the bankrupty court which would happen when all the payments to the trustee are fully paid. Unfortunately, the case was closed for non compliance of payment. Since the Bankruptcy case is now closed, and the debtor( seller of the property I am buying) is no longer protected by Chapter 13 from all her debts which went back to ,000. What happens to the house I am buying now that the bankruptcy case is closed? Can the debtors run after the property which is now in escrow?

I’m getting ready for bankruptcy after losing my job last year in a company lay-off. I finally got all the necessary documents to my lawyer and am just waiting to hear from them what to do next. Has anyone out there been through this before and can tell me how long everything is supposed to take? I have noe idea how long it will take my attorney to actually file with the court and once he does that how long it will take to get my court date to talk with the trustee.

Here is my current situation, I have the trustee meeting coming up very soon and I need to talk to a financial expert to go over my finances and to finally decide on what to do.
Currently I have filed chapter 13 but the more I think of it I feel like chapter 7 would be the best option but I need help!

My court hearing for meeting the creditors/trustee is on July 10th for Chapter 7 bankruptcy in Florida. I was wonder since my household only have 1 car. I really need to have a extra car for me to use for work instead of using my spouse car. I’m planning to pay cash for a cheap used car but I need to know will it be a problem once after I do my court hearing?
Well I guess I have to wait for the letter of discharge right?? How long does that usually take?

I am thinking of filing for Chapter 13 bankruptcy. I already have one judgment against me and I am worried another collection agency will be taking further action. How do they calculate the amount that the Trustee will accept for repayment? I am already paying close to 00 for my unsecured debtors. I am concerned because I am going to have some large medical bills in the near future. Any help would be appreciated. Thanks.

I am considering filing Chapter 13 Bankruptcy and know that I will have to pay back the creditors under the repayment plan between 3 and 5 years. I am trying to figure out how much I will be paying per month to the trustee.
I live in Florida, have 000 in unsecured credit card debt, 000 in a car loan and pay 00 a month in child support.
I make about 000 a year gross.

How do you convert a Chapter 13 bankruptcy to a 7 in Oklahoma if you dont qualify or make too much to do a 7? I may have to do a 13 soon but Im concerned with what I read about people not being able to make their payments to the trustee.

I am considering filing for chapter 7 bankruptcy. I qualify based on the means test, but I purchased an investment property with a business partner 2 years ago. there is no mortgage on the property and it’s only worth about 40k. How would a trustee normally handle this property since there is another owner who is not filing for bk and is not my spouse? does that make that property exempt?

We got a large tax return this year in early February. We are now in the process of filing chapter 13 and have to provide 6 months worth of income history. Will the trustee consider our 5,000 tax return as part of our income? I know that they will take future returns. We actually had to file an amendment and now have to pay 2,700 of that back anyway, so it was really only 2,300 in excess. Also, can I include this tax debt in my repayment plan?

I have been working on a "plan" with my attorney and trustee for almost a year now. Now they want to increase my payments to a point where I cannot afford it. I may want to dismiss my case but what happens when I do that? I know I am thrown back to the sharks so to speak as far as my creditors go. Do I have to wait to re-file another Chapter 13 plan with a different attorney?

I know that the trustee has to sell whatever assets you have, to partially pay back the creditors, but what ARE those assets? Like Furniture? Dishes?
Please dont tell me how bankruptcy can ruin credit, etc. I know it already, and after all of this hell with the credit card companies and the mortgage company, who the hell in their right mind would want to deal with credit ever again? Just, if you have the answer, then great, please answer. If not, then keep your opinion to yourself and move on. Thanks.
I dont even have the money to buy food or toilet paper, let alone a boat. If they are only looking at major purchases, then they are going to be in for a shock.

A chapter 13 bk is likely in my future. I’m looking for some real world pros and cons about this scenario:
I’m in chap 13 and making my payments, and I see a 00 auto repair coming at me. Would the trustee let me slide on 00 worth of payments to take care of the critical auto need ? IE, how do judges handle unanticipated expenses that happen while you’re in chapter 13 ?
The other alternative that I see is – stop paying my mortgage and bank those funds. Hire the bk attorney, get it all ready to file, then sit on it. Keep ignoring the mortgage and accumulate some cash until the foreclosure sale is imminent, THEN have my attorney file the chapter 13 to stop the foreclosure and add the mortgage arrears into the payment plan. This gives me a cash cushion to handle the surprise expenses.

The trustee will not confirm our Chapter 13 BK because we have too much debt per the guidelines for a 13. We were self employed but aren’t any longer, but the majority of the debt is from our previous business.

I paid some debts with no intention of filing bankruptcy. I was trying to settle on a car accident claim, but the other party decided to sue rather than settle. This pushed me into bankruptcy 2 months later. Now the Trustee in this case is claiming "Preferential Treatment" and requiring me to pay this amount to the estate because a debt was paid within 90 days of filing. Doesn’t the intent have any bearing in this case? There was no "Preferential Treatment" on my part, as I tried to resolve my debts without bankruptcy, but had no alternative after I was sued. I have records to prove that I retained an attorney to settle the accident prior to being sued and filing bankruptcy.
One payment in question was to my father who put a new engine in my car. I am not going to let the Trustee contact my father to get the money back. I wasn’t attempting to hide any money, just repaying the people and creditors that I owed. The Trustee has contacted other creditor to collect close to ,000 that I had paid prior to filing.

Today I called about my gift card for Bennigan’s and I received the following message.
"S&A Restaurant Corp. and certain affiliates have filed for bankruptcy under Chapter 7 of the bankruptcy code. The companies that filed bankruptcy cases are popularly known as Steak & Ale, Bennigan’s and Tavern restaurants. However, not all stores using these trade names have filed bankruptcy. For example, stores operated by franchisees are not named as debtors in these filings.
"It is our understanding the Michelle Chow will be appointed as Chapter 7 trustee for the entities that have filed. These are filed as liquidation cases. Future decisions regarding the affairs of the debtor companies will be determined and administered by the trustee.
"If you wish to file a claim, the form Proof of Claim can be found online at: http://www.uscourts.gov/rules/BK_Forms_1207/B_010_1207f.pdf.

My question is…

I am currently living out of the country to help my in-laws while they are experiencing some medical problems. I want to know if my parents can file bankruptcy for me if they have power of attorney (in the state of GA)? I know I would have to go back for the meeting with the trustee and the counseling, but if they could file for me, that would really help in our situation. Any help would be greatly appreciated!
