I am concerned because some say they can garnish my wages; others say they can seize an asset, or two. However, I’ve also been told they can only put a lien on my home and nothing more. Could I go to jail? What can they legally do to me? Can they take my home or personal property? Or just mess my credit up more than it already is? And to boot, we offered to settle this debt with them 14-months ago, they refused to put anything in writing and we never heard from them again, until Friday; right before Christmas!

Here’s my problem… I am 22 years old, and I went to college for 2 years. during that time I racked up some pretty large bills that I couldn’t handle. I have about 7500 dollars charged off and in collections from credit cards. 2200 of that I have a judgment against me for and they said that they could garnish my wages soon if I don’t pay it off. I had a repossession 14 months ago and owe Wells Fargo ,000 to pay it off. Last but not least, I subleased an apartment to a stranger 2 years ago and I moved out of town. Now I have found out that that person stopped paying the rent and that because I subleased the apartment I am responsible for the rent that was not paid which come out to about 00. So, all together I owe about ,000. I have called all of the creditors and asked what it would take to settle. After calculating that all up it comes out to about ,000. The only thing I have paid perfect is 2 student loans and that’s it. I have no car and I cant get a car loan. I have been rejected for an apartment because of the judgment on the sublease issue. Basically, I am better off dead but I cant bring myself to do that. So I have to decide what to do….Is bankruptcy the way to go?

My husband is being sued for a car accident that he caused a year ago,for 0,000… we dont make alot of money and we recently bought our first home 4 months ago. If the plaintiff wins and we are not able to pay and he garnishes my husbands wages we will need to file for bankruptcy. Will our lender have attend the bankruptcy hearing and will this at all affect our loan with the mortgage lender? Thanks for your help!
lol..landlord, no of course not. The accident happened over a year and half ago and no, he was not hurt, he didnt even go in an ambulance and his car only had a dent in it…he is suing us for emotional damage and "physicall therapy" and loss of work…he is a total fraud and hopefully we will win in court but just in case we dont, I was just wondering…stop being so judgemental

I was unemployed for a year and got a little bit behind on my house payments. I finally found a job that paid half of what I used to make, but was unable to make the entire payment so I applied for a modification from BofA and from WF (HELOC) and was given a temporary modification. However, every month, BofA reports it to the credit bureau as "paying late", even though I am paying on time. Now, WF has raised my monthly payment, which I cannot afford, or they want me to pay the entire ,000 loan in full. They have reported it to the credit bureau as "charged off as bad debt". What are my options? Other than these two debts, mortgage and heloc, I have no other debt. Can they come after me and garnish my wages? Should I file bankruptcy? Should I sell the house on a short sale?

I had a credit card with Chase and their attorney sent me a letter saying I have 30 days to dispute or else they will take legal action. They said they will garnish my wages and also put a lean on my house? Is this legal?

My partner has been on an IVA for 2 years but cannot keep up with the payments anymore so has no option but to go bankrupt really. We are not married but live together, all of our furniture, car and possesions were purchased in my name. I no longer work, I am a stay at home mum so technically have no income. We rent a house which is in a joint tenancy. How would I be affected and if we wanted to rent again would we be accepted? Im just wondering if they will still take his income into account because I dont work. He plans to have his wages and everything paid into my bank account. Is there anything I should be aware of?
He ran up his debt before we met, years ago. Everything we own has been paid for in full by me. And the reason I included the bit about the bank is for when we go to get a tenancy, I dont work but will his income in my account count?
and why the hell would he go bankrupt if I was the one in debt!? Im not completely stupid, thanks.

Can the credit card companies get my disability money like they garnish wages?
Will my credit clear-up in 6 year if I don’t file bankruptcy?
It has been 15 months since I have charged anything on any credit card account.It has been 12 months since I have paid on any of my credit card debt. It is well over 10 times the reported national average. My life situation changed dramatically. My old job was great money and I would be back in it in a heart-beat , if I could. Income from disability doesn’t cover the unsecured debt I have.
I hope to heal and someday go back to work; however, what looks worse a bankruptcy or bad credit? I need advice that will help pull my life together in a way that I can return to the mainstream without some creditor popping up to sabotage my attempts to become productive again. (next time without credit cards- I have made it a year and I am determined to go longer even though the idiots keep sending cards(with hugh credit lines) in the mail.

I have about 6 credit cards way past due. Most of them are in collection agencies. The highest balance I have on any card is around ,300. All together less than ,500. This law firm called me and informed me that they will get a jugdement against me and garnish my wages if I do not settle the debt(this account has balance of around 0) I DO WANT TO PAY BACK. But I have a small job and planning to go back to school!!!Will a judgement deny me a US passport? Do you think they will go to court for such a low debt??? People with much higher debt get away from it. I do accept my mistake though

I had a judgment entered against me in January of this year. I could not pay it, and they would not accept payments from me. Now they began garnishing my wages. If I can somehow scrounge up the money from family members or something, can I still settle it and stop the wage garnishing?

I’m 23 bills include BofA credit card which they are taking me to court for..Personal Loans…Medical etc..
Some people say its to little other people say start clean what do you think?
BTW because the debt is so little I was gonna have a paralegal/typist do all the forms for me at 5 im worried when I get a job they are gonna garnish my wages

My husband has a ,000 hospital bill and in the state of California, the spouse is also responsible to foot the bill. So now, we have a court ordered judgment against us. Since our house is now in foreclosure I was planning on filing bankruptcy anyways. Will filing bankruptcy stop this court ordered judgment? If not, can they garnish my wages? -note, My husband lost his job and I am the sole provider for a family of 4

I am going to be going through chapter 7 bankruptcy next month (November). My car has 70,000 miles and it is five years, and four months old since I purchased it in 2001 (it had 13 miles when I bought it). If I keep my car for two and a half more years before trading it in, can i get a decent loan after filing for chapter 7 bankruptcy this november? My attorney told me that it wouldn’t hurt me that bad because I get a VA compensation and they can’t garnish my wages. Please help. And if I can get a loan, what kind of interest rate would it be?

I filed bankruptcy before I never imagened that I would ever let myself get in this kind of trouble again. But I have bill collectors calling and now threatning to garnish wages . Most of what I owe is late and over limit fees. I bareley have enough money coming in now to just survive. what can I do?

My wages are being garnished 25% due to a collection that I have for an old car. I already filed for an exemption because I am a single parent with 4 kids. They said they would take out per pay period, but that means it will take me about 10 years to pay it off. Does anyone know if bankruptcy would cover a court ordered judgement?

i couple of years back i brought a car that i couldnt afford. i returned the car a voluntary repo and that is on my credit. The Lender now wants to garnish my wages to pay back the loan. I do not want to file bankruptcy I would like to know if there are any alternatives to help me with this debt and the other things on my report because now i’m a position where I have enough money to repair and repay the thingson my credit.

This is a question related to last week’s question kindly answered by helpful person…"is not paying unsecured credit card debt an alternative to bankruptcy [?] ". The answer included info that my wages could not be garnished in TX. I now need to know about NM & AZ.
Considering I can’t do debt consol and would very much like to avoid bankruptcy….I am trying to put my life back together after ex husband in TX surprised me by divorcing me after 14 yrs. and then filed bankruptcy himself instead of filing as a couple (which he had told me he would do-as a couple) and in doing so dumped debts on me. Collectors who can’t collect from him are now calling me. THANKS GREATLY FOR YOUR HELP.

My mom is in risk of losing her home due to credit cards raising interest rates and their not being able to keep up with payments. Her wages are going to be garnished and is worried about not being able to make mortgage payments. She refinanced once. Can she file bankruptcy if she refinanced?

Does anybody know if you can file bankruptcy on a Federal school loan? If you have already defalted on the loan but they have not garinish your wages yet, and you can not make any payment on the loan at all, can you file an the federal school loans too, when you file?

Brief background: Moved from one state to another for a job, which was lost. Income has dropped to about 50% of what it was. We’ve gone through our savings to try and pay things. Bring home pay now covers ONLY new house payment, utilities, groceries, life insurance, and government student loan. Have previously surrendered 2nd vehicle, (1st vehicle is paid in full). Old house in old state foreclosed on and being sold tomorrow. Credit cards remaining unpaid and sent for collections, etc.
My question is this: should bankruptcy proceedings begin or should we continue as is? What, if anything, can our creditors do to us (other than trash our credit – which has already happened). We live in Texas. I would appreciate any suggestions. However please refrain from replies such as "get a job", because we are both working full time jobs and have cut ALL unnecessary spending. We dread the thought of bankruptcy, but see no other alternative.
We’ve done the credit counseling, etc., and the funds are simply not there.
Can they garnish wages for debt in Texas?

I have around 15,000 in credit card debt (major I know-my husband got hurt and so did our income). I got a call today from a collection agency at my job saying he was only contacting me this one time and since I can’t pay the 1700 up front he was going to start taking it out of my pay checks. Can they do this? I don’t pay every month but every couple of months I try to send in a very small amount to show I care. But because of all the different bills I can’t catch up. I am very upset because if they take my wages I wont be able to pay my bills that I have to have. Also should I file bankruptcy for this large debt, I am only 24, or should I try to pay it off. I want a house and don’t want this to hurt us to bad.

I filed Chapter 7 bankruptcy in Aug 2001 and it was discharged in Dec 2001 in IL. I now live in Vegas and have a writ against me and they are going to garnish my wages. I have 2 options file a "Claim of Exemption" or file bankruptcy?

How does one file Bankruptcy after job loss and stuck with a foreclosed home and repo'd automobile? Is this a long process and is it recommended? What are the key negative points if one chooses this route? Thank you!
Also, how likely is it that a broke jobless person will get sued and have wages garnished and bank accounts seized due to owing on a repo'd car?
