Hey, I need a little advice from soneone who has been in a similar situation.
I recently discovered we had an old credit card that had not been paid off, and the account has been adding interest for 5 years. When the account went delinquent, it had a balalnce of ,000, and has now grown to [B],000[/B].
Anyway, the card is in my wife’s name only, and I am looking at calling the collection agency and settling the debt, probably for around 6 or 7K I would imagine.
My question, however, is what happens if I don’t pay it at all? I mean, I know it would fall off my wife’s credit report, but that doesn’t stop collection actions and or garnishment, does it?
I realize it would continue to kill my wife’s credit, but does it do anything to mine? Can they garnish MY wages, as her husband?
Any help in answering this question would be greatly appreciated. I will likely call and settle the debt, but want to know what my options are. Thanks! Mike

I have just been notified that a credit card that I was working with has been charged off and it has been placed with an agency to file suit. They are saying they will garnish wages, freeze accounts and attach a judgement to my property. My employer says that my wages can not be garnished, but what about my account. I was honestly trying to make arrangements with Chase, we had a loss of income and things were very tight for a while. If they attach a judgement what does that mean? Will I have to go to court over this? They are willing to settle for 749 if I can come up with it today!! They just called me yesterday. I do owe this debt and am willing to pay, but they are unwilling to work with me any longer. If I file bankruptcy will that stop the judgement and garnishments? I am not behind with my other creditors and even will be paying 3 off this month. The payments were manageable until my interest rate was increased because of a payment 4 days late and my payments doubled to 4.

I have been trying to teach English here in China for the past 2 years. I’ve encountered a range of problems and found it difficult to keep employment. Once school fired all the teachers, ripped us off then went bankrupt. Other schools have kept me on for a few months and then turned around and found a better teacher because they don’t like my teaching style. The latest company let me go because they were restructuring and downsizing. I was the unlucky one who didn’t have a relationship with the boss so I was the first out the door. The alternative was only a couple of hrs work each week – changing me from full time to barely part time.
So, I have given up on teaching. I think I’m OK but not good enough to maintain a decent career out of it. ESL teaching is difficult to earn money in. Now that I am married, I want a better, more stable job and a different career at home. We were both planning to move back to Australia to live.

She has said some really hurtful things and has been withholding the sex like she doesn’t want to be with me anymore. I’ve questioned her and she tends to close up and when pushed, says she’s not happy, she’s bored. I get upset, she sees that and says that we will be together forever and that she still loves me. I doubt it though by the way she looks and acts now. She told me to be a man and go back to Australia and set everything up (we were only 3.5 months away from moving back).
I’m reminded about how at this time I cannot afford the diamond ring. Also, despite my wages being enough to pay for everything and give us enough money to go out, it hasn’t been enough to save for a honeymoon. We only got married last month. I told her that my work prospects are so much better in Australia but she finds that hard to believe – I didn’t have it in me to change enough to grow and become a good teacher so apparently that reflects on my ability not to change overall.
A bit of history about my working life in Australia: I graduated uni about 1 year before coming to China. I worked for 4 years in a supermarket and became a manager. They wanted me to stay and become a trainee department manager. I had a lot of potential. But it seems that I lost all of that potential when I came here to China. She has just seen all of my failures and compares that against her own successes and the successes of other foreigners who have done well here.
It’s really hurting me to see her become so scathing and nasty and unloving. I told her that it’s worth banging my head against a wall with these jobs for a few more months so that we can still be together (albeit not much because she is busy with her overseas work) and leave the country together. She says that if she had more money and was more successful in her work, she’d leave with me tomorrow. But thinks I should give up the struggle of teaching and just go back and set things up. I’m about to do that. Three months is not long.
But I still feel the sting of her disappointment in me. It’s like something has changed and she can’t see the good in me at all anymore. So I think what’s the point of going home and getting established if she no longer has any feeling for m? She might turn around and refuse to come in a couple of months time. Already I think her mind is definitely changing. She’s not interested in the wedding and when I asked about us going back to see her family one more time before we leave, she said she said I wasn’t welcome in her home anymore because I stay there and get fed like a king instead of working hard. That I should give something back to her family…
So, she is bored, disinterested in me and behaving like she wants me out of her life. Should I return home and get established and forget about her? This is not the departure I had hoped for. I think she kind of resigned when I said I found more employment here and could be earning more than the last school. She’s already told me my teaching is at ground level and I’m a loser – meaning no good at teaching.
It’s really cruel for her to say these things and feel so disappointed as far as I’m concerned because I stayed on longer and pushed through because I wanted to be with her. I could have left about a year ago…My parents wished I had and set myself up with a job and car. Instead, I either leave now or find work here. Last night I had a dream about her being romanced by some other guy. She was really into it. She’s not being intimate with me and looking down upon me.

i had a 2000 dollar credit card about 4 years ago and i just got out of controle. i just recived a letter from a debt collector and the the card is now up to 11000 dollars! i also have some med bills about 4000 dollars. i tried calling the debt collector and he was real slick. he tricked me into telling what i did for a living and then guessed where i worked! (he’s local) he said "just send 100.00 a month but i cant promise there wont be a jugement agasint you, but i promise we wont garnish your wages". anyway he said just send 100.00 a month. he wasent willing to work at all!!! what should i do?

I have a Citi card with 3K debt. 2 years. For 1 year, payments were on time and above minimum. The account is now closed.
I have a Key card with 5K debt. 6 years. For 5 years, payments were on time and far above minimum. The account is open and on a payment plan.
I was out of work for over a year which is when almost all of this debt was accumulated. I eventually had to move across the country to move back with my parents. I now have a new job in a with an expensive (0/week) and long (4 hours/day) commute plus low pay. The job is in NYC and I can’t find a decent place. I’d like to settle with Citi.
Nothing is in collections though the Citi could be soon. I’m now looking for jobs abroad and want to sort out everything before leaving. If they were to attempt to garnish my wages, they would get a lower amount than I am willing to pay. 50% of my income (2K/month net) is going towards paying my debts (I have student loans as well). 30% of it is going towards getting to work. I hope it never comes to this.
I want to settle this by the end of April 09. How do I go about this and what impact will it have on my credit (I will probably return to the US at some point) and what else does it entail?

You don’t understand, we’re living paycheck to paycheck as it is. We do not own a home. We have no assets to seize.

If the insurance co. wins this lawsuit against us, we are so screwed. If they garnish my partner’s wages, we’ll be homeless. We have two children to support as well. Any advice would be greatly appreciated!

My Wife and I have been working with a debt consolidation company for the last few years and they are telling her they can’t settle the last debt of 4,000 even though we have 3,200 and they claim they won’t settle so now they are mailing us a check and taking there fees out of it. Should we attempt to settle ourselves? How much should we offer? Another lady with the consolidation company said we owe 5,500 now so we don’t know who to believe. They are threatening to garnish her wages, this debt is from a credit card she had as a teenager.
And also our state taxes are in withholding and we have no idea how to recover it. And is it fair for the debt consolidation co. to take an early termination fee even though we never cancelled their service they told us they couldn’t get the last one settled.

This is quite a story !!
Back in July 2007 I was working for a small heating business. The owner at that time also had a large profitable business and I had been led to believe that he purposefully made it look like the smaller business hadnt made a profit – for tax reasons I believe.
Now this chap had become a friend after working for him for a few years and he asked i I would like to take the business on so that he could follow other avenues. He showed my figures and made be believe that the company was profitable (I was young and naive) so I took on a £25000 loan.
To cut a long story short he said to me that I did not need to pay him until the company made a profit and to keep the £25,000 as working capital. The trouble is the overheads were so high that it never made a profit. I tried moving premises to work from home and also made the office girl (his daughter) redundant but copped for paying her redundancy (3/4 yrs worth) even though I’d only ran the company for around 8 months. Also to give you an idea she was on £16,500 for part time hours (one of the many overheads !)
Any way after just over a year the business had swallowed my £25,000 and I’d spent my savings (circa £7,000) on wages for myself, so I shut it down and sold the assets (4 vehicles, computor, small amount of stock)
I’m still paying the original loan as I refused to go bankrupt (like an idiot !) and still have 5 years left.
I recieved communication last year from the bloke in question saying that the time to pay had arrived and that I owed him £20,000. I emailed him about the trouble I’d had, the verbal agreement about paying him when the company made a profit and the fact that we had no written contract. He never replied.
He has now contacted me again, apologising for the 14 month delay in coming back to me and stated that I owe him £18,000 unless I want to settle the debt privately, in which case it would be £16,000.
The thought of taking another huge loan scares the crap out of me ! I’m now 29 and only just getting myself straight. I have no mortgage and a car on HP.
Do you think I’d have a case if this went to court ? I’m going to see the Citizens advice bureau as soon as I can as I dont know where to turn or what to do next ?
It has crossed my mind that he’s waited this long so that some of the records are now no longer ‘available’ although I dont know the ins and outs. How long can he chase me for ? I fear that I could be taken for theft as I sold the assets (although the vehicles were transferred to me) ?
I guess I may just have to take the loan ?

I got a letter in the mail from the healht care provider saying that they’re going to get a judgement from me and garnish my wages. I owe them 5,000 dollars for past medical bills. Also, I owe about 2,000 past debt for various things (this is not including student loans). A lawyer I talked to said that I qualify for chapter 7 bankruptcy. I don’t own a home and I have a car that I’m making payments on. (they said that Icould keep my car if I keep making payments on time). I have no way to pay the medical bills all at once (which is what they’re asking) what should I DO???????????/

I’m in Texas and Citicards has hired Allen Adkins and Associates to sue me. I have an attorney and a hearing date is set. What usually happens in these cases. I know in Texas they can’t garnish your wages, but what happens? Will I be able to settle? Soemone please help.

Wisconsin teachers are paid an average of ,000 in wages and benefits. And they don’t want to work. NFL players are multimillionaires and are demanding more. In both cases, the unions produce nothing.
We have free enterprise in the auto industry, world wide. Cars sell for a low of ,500 to a high of one million dollars. There are so many to pick from that I cannot keep track of them all. Because of unions, the government had to bail out US auto industries to keep them from going bankrupt.

I just started getting my wages garnished from something that happened 8 years ago. Now my family is suffering because of my mistake, and we are now on the verge of becoming homeless and loosing everything. I tried to file bankruptcy, I paid my last 00 and 4 months have gone by. The bankruptcy attorneys will not return my calls and my wife and I are at a loss. We have no more money and we don’t know what to do….any help?

Hi, I have settled on an old medical debt. The collection agency had several accounts and threatened to take my husbands assets and garnish his wages for debt made before we even knew one another. So, we settled the debts and was faxed a letter with all the accounts and amounts the of the accounts that were settled. We settled them Feb 28th 2009 and we just recieved a letter in the mail of them wanting to settle the remainder on one of the accounts we have already settled. What also upsets my husband is that they sent the letter to HIM and not under my name. I checked the account numbers on both the letter and the settlement letter, they match.
My questions are, in the state of IL can they come after us for the remainder of a settled account? Are they able to bash my husbands credit by putting the account in his name even though it is not his? What can I do to stop them?

I want to killing myself right now. My company was filed bankruptcy last week hasn’t paid of my last wages. Saturday when I was refilled my prescriptions I found out my medical FSB account locked up couldn’t paid for my prescriptions. I still have 0 in this FSB account. what can I do? I really need this money, coming I have a few doctor appointment in this 2 months. What can I do? I need someone tell me where and what should I do? One more thing the CEO said he was not fired us so I can’t file unemployment benefit. He only told us to wait for the trustees to contact us. How come a CEO can do that for his people. I feel so sad and how can the people do that for me. Hope someone can help me of my question. Thanks.

this is from a consumer loan company I filed bankruptcy on..now they are trying to put a lien on real estate I do not own…my ex wife does..i never received a summons or notification…just saw it online when looking something else up
the court action is against me in this case…she had already been notified that the loan co was going to garnish her wages for the loan (joint)..the divorce decree states I have to pay the loan..I couldn’t and filed BK …how can the loan co come after me? I have been told by attorneys to pay her the wages back she is having garnished…because of the ruling in the divorce
Isn’t it if I don’t answer this action although I have no summons…that they win by default? obviously they are not telling the courts I filed bk…

I have several medical bills, and some of them are currently suing me for payment. One is currently garnishing my wages while the others are waiting or in process of garnishing. I do not want to file bankruptcy over medical bills. I have just started rebuilding my credit with a small credit card I just recently aquired (very small limit). What can I do other than bankruptcy that will stop these companies from suing and garnishing, yet I can make payments to (credit counciling, etc)?

Just today I printed my credit report and I called to start settling all my debts. All went well considering and I made arraignments to pay my Capital One credit card bill off in six months. My Chase collector is in TN where I used to live. The lady informed me they will be serving me in a few days. I hadn’t yet told her my new address as I did for my other collectors. She said I could pay the 1,515 (my credit reports it as 989). I spoke to my mother afterwords and she told me someone was by her home looking for me. I am 21 and haven’t lived at that address since I was 18 and I applied for the credit.
What is the likely-hood they will settle when I explain to them tomorrow I don’t live in TN, I live in OH. I am a student who receives non-garnishable federal-aid. I am a server that makes .00 a week in a state that only lets you garnish 25% MAXIMUM of expendable income. I don’t have a bank account to freeze. I don’t own a car or home to put a lien on, and frankly I am offering them all I have when I say I’ll pay you 0.00.
I asked a similar question earlier but more people were focusing on telling me to get some integrity or make sure they are even really suing me. They are trying to serve me…but what do they have to really gain from that when they could just take a hunk of change. It will cost me what I have to give them to get to TN ,if they can sue me there, just in travel.
I am trying to get as many points of view and opinions based off experience and understanding of what they legally can do out of my jurisdiction. There are a lot of conflicting answers but I need well articulated answers.
To who asked me how I am settling my others. I make 50.00 in paid wages. I make like 200 in tips a night. They don’t know that. I know I probably seem retarded when I keep asking but my point is, how can they even touch me in OH with a TN court decision that I havent been served for! Why bother serving people if you dont have to? I get they are probably going to get their settlement…and I’ll just pay it. Its not even really THAT much, I just can’t understand, again, how TN who has very different laws as to collecting after a judgment can push those on me here. I seriously dont even object to them suing me here where I can be present and aware of it. Beyond it all, I think I am most annoyed that the company on my report wasnt even these people. They had passed it on to two other agencies that I had to hunt down just to try and make it all right. Thats why there is nothing about this 500 buck increase anywhere in the past 11 months on my report and its my dumba$$ for looking for it.

This debt is 20k with interest accruing. Looks like this company is gonna succeed in garnishing my wages but I can’t afford it because it would be a hardship on me. Six months ago, I was involved in an auto accident (my fault) and my insurance policy had expired a week before. There were no injuries or fatalities but my car was totaled because I was knocked out of control and hit a guard rail. I have been paying my car notes even though the car is sitting in some impound lot, but until recently I have not been able to make anymore payments. I owe about ,000 on the car although it is worth ,000. I am 100% sure that my car finance company will sue me. I have debt totaling about ,000 (car loan included). If I file bankruptcy, can they still sue me or garnish my wages. What is my best way to get out of this without have to pay much? I also qualify for SSDI (which can not be garnished by creditors), should I just quit my job, get the SSDI, and lay low until this storm blows over?

My credit is terrible I have quite a few accounts in collections, charged off and delinquent and wage garnishment. Some of the accounts are not mine but the process of filing a dispute with the credit bureau has proven unhelpful because they would not remove the accounts. So I am trying to move forward in my life and get my finances and everything together but I am not sure if I should file bankruptcy because I feel like I can not obtain new credit anyway and either way it would take at least 6 months to a year to show that I am being more responsible but my main concern is my garnishment that will stay on for about 20 more months and I really need that extra money due to the fact that I am a single parent trying to get on my feet after leaving an abusive relationship and I just don’t know what to do. Morally I think the right thing to do is to pay off my bills but I don’t have any extra money to do so the money they are taking from my wages could be used to pay off my debt but the only way I can get it off is to file bankruptcy so what to do I am very confused and defeated right now please any advice on finances that could help!!
when I say the accounts are not mine that means I did not sign anything I did not ok anything and I was unaware of the accounts until I looked at my credit report. I have had my personal information stolen on 2 seperate occasions so while yes my name may be on the account I did not sign for them. I am woman enough to admit the accounts I opened I neglected but I do not want to pay back money for accounts or loans that I had no part of and I do understand that bankruptcy will effect my credit for years to come but I have 2 kids a job and school so yes finding another job sounds logical but physically and mentally I am not capable right now of taking on that extra stress and losing the 4 hours of sleep i get each night now. Thank you all for your insight and help Busso, Melvin and Irv thanks a lot you guys your answers don’t make me feel like a complete idiot.

I evicted my tenant for unpaid rent and will go to court on 7-08 for a judgement as to the exact amount still owed. We have information that the tenant intends to file BK so he won’t have to pay and that he quit his job so that we can’t garnish his wages. Knowing this guy, I have to believe both things are true. Any recourse for me at this point?

In 2008, I lost my job and got behind on my Capital One credit card. My balance was roughly 1400 and Capital One told me if I agreed to pay I think 40% of my balance in two payments they would do a debt forgiveness for 60%. So I agreed and called on the day I was to pay on my debt and the rep told me that they no longer have my account and gave me a number to call for a collection agency. Well I called the collection agency and they said they wanted the full 1,400 and were willing to let me make 0 monthly payments. I make the last payment at the end of this month. I just got a 1099-C from Capital One saying they wrote off the 60% as a tax forgiveness to me and Im to add the 800 and some dollars to my wages for the year. Is this right? Do I have to do this considering they really didn’t give me a debt forgiveness, they sold the debt to a collect agency?
