what happens to an account that isnt yours when u file bankruptcy?

My brother is going to file bankruptcy next week. On one of his credit report there is an account that is MINE. How did it get there, i dont even have him as authorized user. (FYI we have same address, same last name). Experts tell me me not to worry about doing anything because when the court calls the creditor, (citibank) they wouldn’t have a record of having a credit card with them. I just wanted to get some comments here. Good Day :)

What you were told is true – when the accounts are verified, this one will show as not belonging to your brother, and so that account will not be included in the bankruptcy.

I would bet that you have SSNs that are very close, and that is how it got included on the wrong report. You should check your credit statement as well, just to make sure that there isn’t something there that actually should be included in the bankruptcy.

    Good luck

I am going to bet his BK attorney will advise him to add it to his bankruptcy.

The creditor still has to provide some proof…but we all know collection agents tend to lie and forge documents all of the time. If you don’t add this, it may come back to haunt you in the future.
