When I file for bankruptcy does my spouse have to file with me? I live in California

    No. Individual debts are yours.

    Any joint debts in the bankruptcy WILL impact your spouse. As joint accounts, the creditor will simply go to your spouse for payment.

    yes. I dont think it matters what state, they want both. I know, I got dragged down with my spouse, when I had excellent credit, we are now divorced. Our 7 years are up in October. Now the problem will be getting the big 3 credit report companies to do their job and remove the bankruptcy from our credit reports. I understand it take a bulldozer to get them to move! We goofed and sold our house to his daughter and decided to travel after he retired. She decided she didnt want it after all and moved and bought another house we were traveling and it went to default, by the time it caught up to us, the bank wouldnt work with us at all to catch up. They wanted everything at once. We didnt have that kind of money. We had both worked hard all of our lives and had excellent credit till this happened. We had no choice. We have since rebuilt our credit to 714 but people still see the word bankruptcy and turn you away. or want to charge you an exorbiant amount of interest. No one ever looks at why it happened or what your payment history was, BUT if you are a business person and file bankruptcy it is a whole different ballgame. My personal opinion is if you can wait 6 months get a divorce now and have the attorney give one of you the bills. You can remarry if you chose or do what we are doing now. Just live together. Government makes it hard on seniors if your married. most of our friends have divorced also. What with the rising cost of everything, if something happens to one the other isnt responsible for the others bills.

    No you dont. You are going bankruptcy on your own debts. If your husband is on them he can take them back.

    And whatever these idiots are saying dont believe them they post 1000 posts a day and dont know anything. Just ask your attorney.
